RE: Lease of Twenty-Eight Shares of Fulton Ditch for the 2016 Irrigation Season
Dear Mr. Petrocco,
It is my understanding that you wish to lease twenty-eight (28) shares of Fulton Ditch from
Weld County for the 2016 irrigation season at a rate of$66 per share. This lease is for a single
year and the lease for this year in no way guarantees you the right to lease those shares in any
subsequent year. Based on your bid amount of $66 per share, the total cost for the 28 shares is
$1,848.00.
Weld County also requires that you provide records at the conclusion of the irrigation season
regarding the amount of water diverted, a legal description of the irrigated acreage, and the
crops irrigated with the shares leased from Weld County. You agree to provide that information
via letter to Weld County prior to November 30, 2016. Please send irrigation records to:

If you are agreeable, please sign two copies of this letter and return the originals along with a
check for $1848.00 made payable to Weld County to me at the address above before March 16th
of this year. This agreement will become final once it is ratified by the Board of County

Mr. Domenico:
It is my understanding that you wish to lease two (2) shares of Lupton Bottom West
Lateral from Weld County for the 2016 irrigation season at a rate of$1,405 per share.
This lease is for a single year and the lease for this year in no way guarantees you the
right to lease those shares in any subsequent year. Based on your bid amount of
$1,405 per share, the total cost for the two shares is $2810.00.
Weld County also requires that you provide records at the conclusion of the irrigation
season including the amount of water diverted, a legal description of the irrigated
acreage, and the crops irrigated with the shares leased from Weld County. You agree

SUBJECT: Lease Agreement for Fulton Ditch Shares
The agreements for the lease of 28 shares of Fulton Ditch water and 2 shares of Lupton Bottom Ditch
water are on the BOCC Agenda for Wednesday March 16, 2016.
Weld County currently owns 28 Shares of Fulton Ditch water and two shares of Lupton Bottom Ditch
water for use in future water court cases. Since the ditch shares are not currently allocated to any
substitute water supply plan, the water is leased each year to show continued use of the water. Failure to
show continued use of the water will severely injure the County's ability to use the water for future
augmentation uses.
An advertisement was published in the Greeley Tribune(see attached advertisement and bid quote form)
announcing the acceptance of bids for the lease of the ditch shares. The minimum bids were set at the
amounts needed to cover the assessments charged by each ditch company. Individual landowners in the
vicinity of the ditch were notified. We also notified the Ditch Company, each share owner, and previous
bidders. The following bids were received for the 2016 irrigation season:
• Petrocco Farms, Inc. desires to lease the Fulton Ditch water at the rate of$66 per share for a
total of$1848.00.
• Ray Domenico Farms, Inc. desires to lease the Lupton Bottom water at the rate of$1,405.00 per
share for a total of$2810.00
Both farms bid more than the minimum bid, so all ditch company assessments will be more than covered
for the 2016 irrigation season.
Petrocco Farms, Inc. and Ray Domenico Farms, Inc. have agreed to provide us with the type of crops
grown, location of the crops grown, and the amount of water used prior to November 30, 2016.
Public Works recommends approval of these bids. Once the agreements have been approved and
signed, please return one signed original for each farm to me so I can send them to Mr. Petrocco and Mr.
Domenico respectively.
I will plan on attending the BOCC hearing to answer any questions that the Board may have regarding
this agreement.

NOTICE OF BIDS/PROPOSALS:
Re: WATER IRRIGATION RIGHTS FOR LEASE-#61600043
The Weld Board of County Commissioners owns two ditch rights (28 Shares of Fulton Ditch and 2
Shares of Lupton Bottom West Lateral) and is seeking to lease those rights to interested property
owners for one (1) season only. If you are interested in bidding please view the Weld County
Purchasing website (listed below)for more information.
Ditch shares must be used for irrigation purposes. Depending on the location of the winning bidder's point
of diversion, the ditch company may reduce the amount of water delivered to account for ditch seepage and
evaporation. The Winning Bidder is responsible for notifying the ditch company that they will be utilizing Weld
County Shares. The Winning Bidder will be responsible for signing a lease with Weld County and must provide
evidence that the water is actually put to beneficial agricultural use.
