HomeMy WebLinkAbout20160329.tiff HEARING CERTIFICATION DOCKET NO. 2016-04.B RE: A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR15-0055, FOR A ONE (1) SINGLE-FAMILY DWELLING UNIT PER LOT OTHER THAN THOSE PERMITTED UNDER SECTION 23-3-20.A (SECOND SINGLE FAMILY DWELLING UNIT) IN THE A (AGRICULTURAL) ZONE DISTRICT- DAVID AND HOLLY NOVAK A public hearing was conducted on January 27, 2016, at 10:00 a.m., with the following present: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: Acting Clerk to the Board, Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative, Diana Aungst Planning Services Engineer representative, Wayne Howard Health Department representative, Lauren Light The following business was transacted: la I hereby certify that pursuant to a notice dated December 28, 2015, and duly published December 31, 2015 in the Greeley Tribune, a public hearing was conducted to consider the request of David and Holly Novak, for a Site Specific Development Plan and Use by Special Review Permit, USR15-0055, for one (1) Single-Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A(second single-family dwelling unit) in the A (Agricultural)Zone District. Bob Choate, Assistant County Attorney, made this a matter of record. El Diana Aungst, Department of Planning Services, presented a brief summary of the proposal and stated 17 referrals were sent out and 14 either did not respond or indicated no concerns. She reviewed the intent for a second single-family dwelling to house family members or caregivers. She explained the application is the result of a Zoning Violation and if it is denied the second dwelling will be removed. Ms. Aungst reviewed the location, nearest residences, and surrounding property uses. She stated staff has not received any correspondence. Ms. Aungst stated the site is within the three (3) mile referral area of the Town of Erie and the Cities of Northglenn and Dacono; furthermore, the Town of Erie and City of Dacono responded with no concerns and the City of Northglenn did not respond. She displayed images of the site and adjacent area and entered the favorable recommendation of the Planning Commission into the record as written. Wayne Howard, Planning Services Engineer representative, provided a brief overview of the transportation plans and requirements and stated the access is off of Johnson Lane which is maintained by Weld County. He clarified the existing residence has two (2) existing accesses and one of the accesses is to be closed per the requirements of Access Permit number, AP15-00471. Mr. Howard stated no traffic counts were available and the traffic narrative indicated minimal use; 2016-0329 CC: , , - PL2392 HEARING CERTIFICATION - DAVID AND HOLLY NOVAK (USR15-0055) PAGE 2 therefore, there is no Improvements Agreement required and the site does fall under the stormwater exemption. Lauren Light, Department of Public Health and Environment, reviewed the water and sewer provisions stating that water will be provided by the Left Hand Water District. She explained the proposed home to the north will be tied into the current septic system and the home to the south will have a new septic which must be installed prior to issuing the Certificate of Occupancy. Ms. Light stated Development Standards (DS) #8-12 reference Environmental Health items. • David Novak, applicant, stated the existing house is empty and he and his wife always wanted to put a second house on the property. • No public testimony was offered concerning this matter. • In response to Commissioner Cozad, Ms. Aungst stated the USR is required because it is located in a subdivision. In further response to Commissioner Cozad, Mr. Novak explained that his wife has always wanted alpacas and the purpose for the second dwelling is for a family member to take care of the property. He clarified the existing house has been vacant for a long time and will be removed and a new home will be constructed. • In response to Chair Freeman, Mr. Novak indicated no concerns or changes to the Conditions of Approval or Development Standards. IE Commissioner Cozad suggested removing Development Standard (DS) #3 because the structure had already been removed. Mr. Novak interjected that it has not been removed. The Board agreed to leave that DS. Commissioner Cozad corrected DS #5 to read, "The access to site...."The Board agreed. • In response to Chair Freeman, Mr. Novak indicated they have reviewed, and agree to abide by, the Conditions of Approval and Development Standards, as amended. El Commissioner Kirkmeyer moved to approve the request of David and Holly Novak for a Site Specific Development Plan and Use by Special Review Permit, USR15-0055, for one (1) Single-Family Dwelling Unit per lot other than those permitted under Section 23-3-20.A (second single-family dwelling unit) in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission, with the Conditions of Approval and Development Standards, as amended and entered into the record. The motion was seconded by Commissioner Conway, and it carried unanimously.
