HomeMy WebLinkAbout20161607.tiff RESOLUTION RE: ACTION OF THE BOARD CONCERNING REQUEST TO PURSUE AN INJUNCTION AGAINST EUGENE NELSON DBA NELSON RANCHES, INC., AND SUSIE KESTER, DBA MIDWAY GRILL, FOR VIOLATION OF THE WELD COUNTY CODE - ZCV16-00023 WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, Eugene Nelson, dba Nelson Ranches, Inc., and Susie Kester, dba Midway Grill, ZCV16-00023, are allegedly in violation of the Weld County Code, specifically the operation of a convenience store, food establishment and/or commercial storage that is not permitted, and WHEREAS, despite efforts by the Planning staff to resolve said matter, the violation has not been corrected, and WHEREAS, on the 18th day of May, 2016, a public hearing was held before the Board of County Commissioners for the purpose of hearing testimony relating to said violation, and WHEREAS, Eugene Nelson, dba Nelson Ranches, Inc., and Susie Kester, dba Midway Grill, property owner(s), were present at said hearing and presented testimony, and WHEREAS, the Board of County Commissioners deems it advisable to refer said violation to the Weld County Attorney's Office for legal action, with an instruction for delay of action upon such referral until June 1, 2016, to allow adequate time for the property owner(s) to bring the subject property into compliance and for an inspection of the property by the Department of Planning Services staff. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that ZCV16-00023 be, and hereby is, referred to the Weld County Attorney's Office for legal action against Eugene Nelson dba, Nelson Ranches, Inc., and Susie Kester, dba Midway Grill, to remedy the violation of the Weld County Code, and any other persons occupying the properties, any persons claiming an interest in the properties, and any persons acting in active concert with the identified parties, with an instruction for delay of action upon such referral until June 1, 2016, to allow adequate time for the property owner(s) to bring the subject property into compliance. Additionally, during a recent inspection, it is apparent that the camper/trailer is still not mobile(being moved from site to site). I noted a barn/shed being used in conjunction with the food operation. I also noted 3 trailers still situated on site in addition to the camper/trailer. As we have discussed to have a restaurant, a Use by Special Review(USR) permit is required. In other words, as a Use by Right you would be allowed to have 1 (one) mobile food truck(camper/trailer) provided it comes and goes daily. This would mean the utilization of any existing structure(s), seating area or other commercial storage and/or units would not be allowed without a Use by Special Review permit. Lastly, as we have discussed, prior to any land use case moving forward, the illegal land splits will need to be corrected. Commercial uses that are operating prior to obtaining the required Weld County Land Use permits are immediately scheduled for a Violation Hearing before the Board of County Commissioners. It was also determined that the facility did not have a retail food establishment license. Note: During this inspection the owner(Susie Kester) stated to inspection staff that she was not the owner and didn't know who the owner was, but later came to the office to obtain the license as she was the owner. January 30,2015 The Department issued a Notification of Violation for Failure to Obtain a Retail Food Establishment license to the mobile unit that would later become the convenience store. February 17, 2015 The Department licensed the convenience store mobile unit. During the preopening inspection the owner requested that we visit her other unit that she was thinking of licensing. Department staff discussed with the owner what it would take to license this unit, but that this unit was not licensed and could not operate until such time that it became licensed. January 15,2016 Meeting held with the owner concerning operations at the sales location. During the meeting it was determined that the owner had opened a second unit where grilling operations and food handling were taking place. The owner was informed that the mobile unit was not licensed and that food operations were to cease from this unit until such time that it became licensed. Three scenarios for compliance were provided to the owner to facilitate the licensing process. In addition it was discussed that other buildings and storage areas may not be used in conjunction with the retail food operation. January 15,2016 to February 24, 2016 Unknown to inspection staff the Midway Grill unit that was not licensed continued to operate. Inspection staff confirmed this after the licensing process was completed when it was noted that Midway Grill has a Facebook Page. February 24, 2016 A pre-opening inspection of the grill mobile unit was conducted. During the inspection there was shed noted next to the grill. The shed contained multiple refrigerators, but the area was not inspected as they all had price tags on them and the inspector assumed that the shed was to be used for selling equipment and not food storage or preparation. April 1, 2016 Department staff conducted a regular inspection of the grill mobile unit (where multiple violations were noted) and found that the operation had expanded into another building that was not approved by building or health departments. The facility was operating outside of the regulations. During the time from February 24, 2016, till this inspection ownership had added a sliding glass door to the shed (during the previous visit the opening was covered with a blue tarp). April 4, 2016 Meeting held with owner where it was discussed that operations could not occur in the buildings that were not part of the licensing process. May 4, 2016 Conducted a follow-up inspection where multiple violations were noted. In addition found the facility continuing to operate from areas that were not licensed or approved. It was noted that the operation continues to change- new refrigerators were installed. It was also noted that water appeared to be being supplied by a cistern or well (neither of which was approved).
