1 . How is the proposed rezoning consistent with the policies of the Weld County Code, Chapter 22:
Our intent of this rezoning is to put property back into Ag use. The previous owners had completed the first
2 steps of the 3 step P.U.D. process, rezoning from AG into P.U.D., never finishing the entire process due
to the death of one of the owners.
We feel that we meet virtually every goal outlined in Weld County Code, Chapter 22.
Goal 1. Respects and encourages the continuation of Ag land
Goal 2. Continue the commitment to viable Ag in Weld County
Goal 4. Keep property from having unsightly refuse
Goal 5. Provide for minimum buildable lot size
Goal 6. Provides for returning the land to Ag us
Goal 7. Protects the property owners rights
Goal 8. Assured that adequate services are available
Goal 9. Reduces conflicts with various land uses
Goal 10. Right to Farm
2. How will the uses allowed by the proposed rezoning be compatible with the surrounding land uses?
100% of the adjacent properties surrounding the proposed site are Agriculture Use. Our proposal of
bringing this back to Ag zoning compliments adjacent properties.
3. Property will eventually have a septic system for a single family residence
4. Water will be by well. We have contacted Steve Ingram of Ingram Drilling. He reported various wells in
surrounding area of between 340 ft to 420 ft deep and with flows of 16 gpm to 50 gpm. He will submit
domestic well permit application for single family residence to state upon completion of zoning change.
5. We do not anticipate any unusual soil conditions
6. Road Access will be from CR 84, Weld County, entering through north side of parcel 070510200021 as
approved by Access Permit, Weld County Public Works Dept.

BIRGENHEIER REZONE
The subject property consists of two parcels of land which are situated in the North Half of
Section 10, Township 7 North, Range 67 West of the 6th Principal Meridian, County of Weld,
State of Colorado. The property is bounded on the north by Weld County Road 84, on the east
and south by the Larimer County Canal, and on the west by vacant dry farm land. The
properties are located between Weld County Roads 19 and 21 .
According to "Special Publication 5-B, Atlas of Sand , Gravel, and Quarry Aggregate Resources,
Colorado Front Range Counties" for Colorado Geological Survey, Department of Natural
Resources, State of Colorado, Published in 1974, Revised 1975, there are no floodplain or
stream terrace deposits per the resource classification of aggregates on this property.
