RE: APPROVAL OF RECORDED EXEMPTION NO. 328 - LOUISE FREI MOORE.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, on July 31, 1978, at a regularly scheduled meeting
of the Board of County Commissioners of Weld County, Colorado,
the Board heard the request of Mrs. Louise Frei Moore for a
Recorded Exemption No. 328 on a parcel of land described as part
of the East Half (Eh) of the Southeast Quarter (SE4) of the
Southeast Quarter (SEQ) of Section 3, Township 5 North, Range 65
West of the 6th P.M. , Weld County, Colorado, being more particu-
larly described as follows:
A tract of land located in the Fast Half of the
Southeast Quarter of the Southeast Quarter of
Section 3, Township 5 North, Range 65 West of
the Sixth Principal Meridian, Weld County,
Colorado being more particularly described as
follows:
Beginning at the Southeast Corner of said Section 3
and considering the east line of said Section 3
to hear South 00°00'00" West, and with all other
hearings contained herein being relative thereto;
Thence South 85°39'18" West along the south line
of said Southeast Quarter 668.76 feet;
Thence North 00°42'30" Fast, 308.07 feet along
the easterly boundary and its southerly extension
of that parcel described in Book 532, Reception
No. 1453567, Weld County Records;
Thence North 74°45'30" West, 3.43 feet;
Thence North 00°00'00" East, 219.15 feet along
the easterly boundary and its southerly exten-
sion of that parcel described in Book 1308,
Page 503, Weld County Records, to a point on
the southerly right-of-way of Colorado Highway
No. 263;
Thence along said southerly right-of-way by the
following four courses:
South 88°48'40" Fast, 405.10 feet;
South 89°29'00" Fast, 180.18 feet;
South 47°39'00" East, 88.70 feet;
North 89°48'00" Fast, 15.60 feet to a point on
the east line of said Section 3;
Thence South 00°00'00" West along said east line
407.70 feet to the point of beginning. Said
tract of land contains 7.518 acres which includes
0.284 acres in Weld County Road No. 45 right-of-way.
does not come within the purview of the definition of the terms,
"subdivision" and "subdivided land" , pursuant to its authority

under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (D) , CRS 1973,
as amended, and Section 2-lA(3) of the Weld County Subdivision
Regulations, and
WHEREAS, the State Department of Highways has requested that
an additional right of way to meet a 75-foot requirement on the
south side of the centerline of Colorado Highway No. 263 be pro-
tected by setback.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of Weld County, Colorado, that the hereinabove
described parcel of land owned by Louise Frei Moore, be and here-
by is, exempt from the definition of the terms "subdivision" and
"subdivided land" pursuant to its authority under Section 30-28-
101 (10) (d) , CRS 1973, as amended, subject to the incorporation
of setback as requested by the State Department of Highways.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 31st day of
July, A.D. , 1978 .

Dear Commissioners :
The attached application, plat , and related items are in reference
to a request by Mrs. Louise Frei Moore for a recorded exemption.
The parcel of land on which this request is being made is described
as Pt . of the E* of the SE* of the SE4 of Section 3 , T5N, R65W of
the 6th p.m. , Weld County, Colorado. This property is located at
the southwest corner of the intersection of Fern Avenue and Colorado
Highway 263. The subject property contains 7. 518 acres of industrial
zoned property. The request is to split the property into parcels
of 4. 098 acres and 3.420 acres .
As indicated in a letter dated July 11, 1978, submitted by Mrs.
Moore, Lot A has been purchased by Robert and Elnora Bliss who own
the adjacent property to the west. Mrs . Moore ' s reasons for the
transfer of the property was for financial purposes.
Based upon the information submitted and the adopted policies in the
county, the Department of Planning Services staff recommends the
request be approved for the following reasons :
1. The Greeley Planning Commission has set forth no objections
to the requested split . The Planning Commission indicated
that this request is consistent with the City of Greeley' s
Comprehensive Plan and there appears to be no conflict
with the 20 year Master Plan for the Greeley/Weld County
airport . The Greeley Planning Commission did recommend
that a right-of-way dedication of an additional 20' along
Fern Avenue be made in order to comply with the City
Comprehensive Plan transportation element .

2. The proposed split conforms with the recorded exemption
intent clause and the Weld County Comprehensive Plan. The
use would be compatible with the surrounding land uses .
The present industrial zoning classification would allow
for higher and more productive uses than an agricultural
use of the property.
3. The request complies with the provisions of Section 9-4 A.
of the Weld County Subdivision Regulations.
The Department of Planning Services staff further recommends that
the recorded exemption plat be amended to reflect the additional
20' right-of-way requested by the City of Greeley for Fern Avenue
prior to recording the recorded exemption plat . In addition , the
Colorado Division of Highways has requested in a letter dated
July 12, 1978 , that additional right-of-way to meet the 75'
requirement on the south side of State Highway 263 be protected by
setback, reservation, or dedication.

Dear Sir:
This letter is intended to explain why a request
for recorded exemption made by the undersigned and filed
with you on June 16 , 1978 was made.
The reason for the request is that Robert D. Bliss
and Elnora O. Bliss purchased from the undersigned the
property located west of Lot A several years ago. In other
words, Lot A adjoins the property which the Blisses purchased
from the undersigned and they desire to own the property desig-
nated as Lot A on the plat of the proposed land division.
My home is located on Lot B as delineated on the
plat of the proposed land division. I sold the parcel to
the Blisses for the reason that the purchase price is favorable
and I need the money.

Dear Chuck:
Subject: Recorded Exemption for Louise Moore
East Eighth Street and Fern Avenue
At its regular session on July 25 , the Greeley Planning Commission
reviewed the above referral from Weld County and recommended that
it had no objections to the requested recorded exemption. The
Commission did, however , recommend that a right-of-way dedication
of an additional 20 feet along Fern Avenue be made in order to
comply with the City Comprehensive Plan Transportation Element .
In its review of the recorded exemption, the Highway Department
submitted a request for additional right-of-way dedication off
of Eighth Street . The Fire Department noted that no fire hydrants
exist in the area and that water line sizes are inadequate to

Dear Mr. Cunliffe:
The Colorado Division of Highways has reviewed the Louise Frei Moore applica-
tion for a Recorded Exemption, and we ask your consideration of the following
comments.
1 . Although this is not a development proposal , we do ask that certain highway-
related concerns be addressed at this time. Our projected right-of-way need
for this segment of highway is a total of 150 feet, 75 feet each side of the
centerline. The existing right of way on the south side of the centerline
flares westward from 40 feet to 62 feet as shown on the exemption map. We
request that additional right of way to meet the 75-foot requirement on the
south side of the centerline be protected by setback, reservation, or dedica-
tion. (preferably the latter) as local zoning laws and regulations permit.
2. If this property is to be developed beyond its present use, we would like to
review any such proposal . We are particularly concerned that access to new
development be properly managed. Site runoff and the impact of highway noise
are also elements which are important to our interests.
