RE: APPROVAL OF RECORDED EXEMPTION NO. 383 - MR. AND MRS. FAY
GWYNN.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held
on the 21st day of March, 1979 in the Chambers of the Board. of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption No. 383, being the property of
Mr. and Mrs. Fay Gwynn, described as Part of the Southeast Quarter
of Section 32, Township 4 North, Range 68 West of the 6th P.M. ,
Weld County, Colorado, being more particularly described as follows :
A tract of land located in the Southeast Quarter of
Section 32, Township 4 North, Range 68 West of the
6th P.M., Weld County, Colorado, being more particu-
larly described as follows:
Beginning at the South one-quarter corner of Se..Lion 32;
thence along the West line of the Southeast quarter of
said Section 32 North 00°59'04" Fast 981.26 feet to the
Southwest corner of that tract of land described by deed
dated February 1, 1978 as Reception #1743591; thence
along the South line of said tract at Reception #1743591
North 89°55'24" Fast 2274.70 feet to a point on the
Westerly line of the Ide-Starbird Reservoir recorded
November 24, 1905 in Book 228 at Page 433; thence along
the Westerly line of said Ide-Starbird Reservoir the
following courses, South 36°51'11" West 39.43 feet;
thence South 41°19'24" West 115.29 feet; thence South
26°43'24" West 291.04 feet; thence South 61°18'38" West
200.78 feet; thence South 28°16'20" West 196.55 feet;
thence South 20°58'17" Fact 206.82 feet; thence South
30°53'14" East 173.85 feet to a point on the South line
of said Southeast quarter of Section 32; thence North
89°49'56" West 1954.95 feet to the point of beginning,
containing 44.694 acres more or less.
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not within
the purposes of the Weld County Subdivision Regulations and the
Board desires to exempt this particular division of land from the

definitions of "subdivision" and "subdivided land" pursuant to
its authority under Section 30-28-101 (10) (d) , CRS 1973, as
amended, and Section 2-1A(3) of the Weld County Subdivision
Regulations.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the hereinabove described
parcel of land owned by Mr. and Mrs. Fay Gwynn be, and hereby is,
exempt from the definition of the terms "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 21st day of
March, A.D. , 1979.

Dear Commissioners :
The attached applications, plat and related items are in reference
to a request for a lot size variance and a recorded exemption from
Mr. and Mrs . Fay Gwynn. The property on which these requests have
been made is described as Pt. SE4 Section 32, T4N, R68W of the 6th
P. M. , Weld County, Colorado . This property is located 2 miles
northwest of Mead. The property contains approximately 44. 7 acres
of Class II and IV irrigated soils . The request is to split the
property into parcels of 11 . 0 acres and 33 . 7 acres .
The Gwynns wish to convey the 11. 0 acre parcel to their daughter
and son-in-law who have lived on the property in a mobile home for
approximately 10 years . The Gwynns presently have a mobile home
permit for accessory to farm use (MHP-441, dated December 9, 1969) .
Based upon the information submitted and the adopted policies in
the County, the Department of Planning Services Staff recommends
the request be approved for the following reasons :
1. The request conforms with Section 9-2 of the Weld County Subdivi-
sion Regulations (Intent Clause of the recorded exemption pro-
cedure) , Section 3 . 3A. of the Weld County Zoning Resolution
(Intent Clause of the Agricultural Zone District) , and the Weld
County Comprehensive Plan in that each parcel does have an exist-
ing set of improvements . The use will be compatible with
surrounding agricultural uses . The request will allow agricultural
and related uses to be the predominant land use. There will be no
reduction in the amount of land currently being used for agri-
cultural production.

2. The Town of Mead has set forth no objections to this request.
3. The request complies with the provisions of Section 9-4A. of the
Weld County Subdivision Regulations .
The Department of Planning Services Staff approval is conditional
upon the Gwynn' s daughter and son-in-law making application for a
zoning permit for a mobile home as a principal dwelling.
