RE: APPROVAL OF CONDITIONAL USE PERMIT NO. 32: 78 : 1 FOR A SINGLE
FAMILY RESIDENCE ON A TRACT OF LAND LOCATED IN PART OF THE
N1/2 OF THE NW4 OF SECTION 15, T 1 NORTH, R 68 WEST OF THE
6TH P.M. , WELD COUNTY, COLORADO - GEORGE RUFF.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 27th day of March, 1978
at the hour of 9: 00 o' clock A.M. , for the purpose of hearing the
application of George Ruff for the granting of a Conditional
Use Permit for a new single family residence on the following
described real estate, to-wit:
That part of the North one-half Northwest one-quarter of
Section 1, Township 1 North, Range 68 West of the 6th
Principal Meridian, Weld County, Colorado, described as:
Beginning at the Northwest corner said Section thence
589°51'00" E on an assumed hoaring along the North line
said action a distance of 1383.98 feet to a point 300.00
feet Westerly of, measured right angles to the centerline of
the Union Pacific Railroad; thence Southeasterly parallel
with said centerline and along the arc of a curve to right;
the chord of which bars 545°37'30"E, 487.18 feet; thence
S44°24'00"Eparallel with said centerline a distance of
1365.76 feet to a point on the South line said North one-
half Northwest one-quarter; thence N89°59'00" West along
said South line a distance of 2683.03 feet to the Southwest
corner of the North one-half Northwest one-quarter a distance
of 1322.40 feet to the point of beginning.

WHEREAS , the petitioner was present, and
WHEREAS, evidence was presented in support of the grant of
the Conditional Use Permit for a new residence, and
WHEREAS, Section 3. 3.D. (2) (u. ) of the Weld County Zoning
Resolution authorizes such a use in an Agricultural District on
the grant of a Conditional Use Permit by the Board of County Com-
missioners, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, heard all the testimony and statements of those present,
has studied the request of the petitioner and the recommendations
of the Weld County Planning Commission and all of the exhibits
and evidence presented in this matter, and having been fully in-

formed and satisfied that the request for a Conditional Use Permit
for a new residence on the hereinabove described real estate,
complies with all of the conditions as set out in Section
3 . 3.D. (2) (u) of the Weld County Zoning Resolution;
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the application of
George Ruff for a Conditional Use Permit for a new residence
on the hereinabove described tract of land, be, and hereby is,
granted, subject to the development standards contained in
the Conditional Use Permit.
BE IT FURTHER RESOLVED by the Board of County Commissioners
of Weld County, Colorado, that the reasons for approval contained
in the Planning Commission Recommendations dated March 21, 1978
be, and hereby are, incorporated as the findings of fact of the
Board of County Commissioners in this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 27th day of
March, A.D. , 1978 .

3. It is the opinion of the Planning Commission that this request
is in compliance with the provisions of Section 3. 3.D(2) of
the Weld County Zoning Resolution which states :
"The Planning Commission and Board of County Commissioners
shall consider the following in making their determination
in approving or denying a Conditional Use Permit : Compat-
ibility with the surrounding area, harmony with the
character of the neighborhood and existing agricultural
uses, need for the proposed use , its effect upon the
immediate area, its effect on future development of the
area and the health, safety and welfare of the inhabitants
of the area and the County. "
This determination is based upon the following:
A. It is the opinion of the Planning Commission that the
addition of one single-family residence on the property
in question will be compatible with the surrounding
agricultural uses .
B. The Weld County Engineer's Department has indicated they
could not identify any engineering problems with the
request .
C. The Weld County Health Department has indicated they
could not identify any problems with the request .
D. The Town of Erie Planning Commission has no objections
to the request .
E. The Dacono area Fire Protection District has indicated
they have no problems with the request.
F. The applicant has submitted a petition form signed by
six of the surrounding property owners in support of
the request . To date , none of the other property owners
in the area have indicated any opposition to the
request.
In addition, the Planning Commission ' s recommendation for
approval is subject to the following conditions :
1. The applicant shall obtain a soils foundation investigation
and sewage disposal study prior to construction of the
single-family residence on the property as recommended by
the Colorado Geological Survey in a letter dated
February 23 , 1978, and the Boulder Valley Soil Con-
servation Service in a letter dated February 21, 1978.

3. No building permits for any structure shall be issued

1. The permitted uses on the hereon described parcel shall

Service recommendations .
3. The sewage disposal system shall conform with all applicable
Weld County and State Health Standards and Regulations.
4. All accesses shall have the approval of the Weld County
Engineer' s Department .
5. The CUP area shall be maintained in such a manner so as to
prevent soil erosion , fugitive dust , and the growth of
noxious weeds.
6 . The CUP shall be limited to the plans shown hereon and
governed by the Development Standards stated above and
all applicable Weld County regulations. Any change to the
plans and/or Development Standards shall require the
approval of another CUP before such changes shall be
permitted.

DISCUSSION: Mr. Ruff explained that he is proposing to place a
single-family residence on the front portion of approximately 63
acres of now unproductive non-irrigated property which is ahead
of the irrigation ditch. He also stated there are five shares of
water involved with this particular piece of property . Mr . Ruff

proposed to improve it by putting a portion of it into intense
irrigation for best productivity. There are six areas proposed
for use. There is also a domestic water tap , gas tap , electricity ,
• and phone service to the area. Production on the property will
• probably take place over a four to five year time period. Dis-
cussion followed regarding the gas tap and liability and assets
against Weld County regarding general , school and fire districts
with regard to the proposal . There being no questions , Chuck
Cunliffe read the staff ' s recommendation for approval of the
application along with the Development Standards. Chairman
Carlson asked why there was only one access stating that he feels
there should also be an access to the field which is not indicated
on the plan as submitted. Mr. Ruff said there is an access on
the north side of the property, but did not think it was a county
approved access . Mr. Hiatt also commended Mr. Ruff for the
material Mr. Ruff submitted on the liabilities and asset section
of the application .
MOTION: Be it therefore resolved to recommend approval with the
Development Standards based on the staff ' s recommendation and
amendment of #4 of the Development Standards to the Board of
County Commissioners . Amendment #4 of the Development Standards /
shall read : 'All accesses shall have the approval of the Weld

DISCUSSION: Mr. Norton , engineering consultant , explained the
proposal for the change of zone that being that the owner of the
property would like to develop the property and also extend the
Scientific zoning beyond its present zoning. The request for a
change of zone from Scientific to Residential is an attempt to
make the over-all land use fit with the proposal , so the changes
are for development because it is close to the City of Greeley
and adjacent to Aims College. The City of Greeley has already
annexed up to Aims College. Mr . Hiatt asked for the meaning of
Scientific zoning and what it was designed for. Mr. Norton
explained that it is for the purpose of light manufacturing
facilities in which the facility is completely contained within
itself , so there would he no outside storage, vehicles , etc .
in the area. Ernie Scott also helped further explain its use .

The owner has a good background in land use and management as
he grew up on a 2200 acre wheat farm in northwestern Kansas. This
farm produced wheat, milo, cane and range cattle. This land was all dry
land farming so the use of irrigation will be new, but will be learned
by _advice from knowledgeable sources.
A complete mapping of field sizes and irrigation ditch layout
is being completed by Longmont Soil Conservation District. The District
rates this soil as class 2I and rates this soil very geed for the
intended uses. Colorado Forest Service is preparing mapping of design
layout for all trees planted for best productivity.
This proposal his been prepared by the owners using only factual
data supplied by Soil Conservation, U. G. Forest Ger•vice, Colorado
Forest Service, Farmers Irrigation Co. , Sabelln Nurseries and Teople
in the farming community of held County.
Both owners of this land, George and Judy Ruff, are currently employed
by the City S County of Denver and have the a .sets to follor, thru with
all things discussed in this proposal. Frouf of solvency is available,
if necessary, upon roquest.
The following is the breik/own of land use for each of -the
lettered areas and anticipated yields to owners Jnd Weld County.

Area A: This 20 acre parcel is to be sueled with an alfalfa grass
mix that contains 4.-S lbs. (Ranger) alfalfa, 2 lbs. orchard -grass
(Latar) and 6.5 lbs. smooth brome per acre. Water ditches will be
surveyed in by a Longmont Soil Conservation District engineer from
head-gate located on reference map by an (X) . 'Phis area will be one-
wayed to turn all ground and harrowed to level and break up soil.
Seed will -then be drilled in to the amount specified by Soil
Conservation. Records from past years from like ground and average
water of 12" of irrigation plus average rainfall of 13" show a
potential crop of 3.5 tons per acre yield. If this crop was sold
at $60.00 per ton this would generate $2_10.00 gross return per
acre. This land is now appraised at approximately $9.00 per acre for
a yield of tax to held County of approximately $30.00. An increase
of at least 40010 should generate $1720.00 per year to the County
because of the change of productivity and re—classification to
irrigated status. Fencing will be placed on the -south line of
this area using 3 strands of smooth wire with 15' spacing of wood
posts.
Area B: This approximate R_2 acre piece of land will be
seeded with 6.5 lbs. _created hbott (:'or'on) .ard 1.5lbs. alfalfa

Conservation District to be 1 to FL tons per acre with fall grazing
of no more than 5 aninals for 3 to 4 months. County appraisal
-of $9.00 per acre should be increased to $16.00. This estimate
was arrived it by checking records in field County Assessors Office
for a like usage. The tax yield of approximately $33.00 for this
• area should _go up to about $60.00 per year. This area is to be
completely fenced using the same fence as the south side of Area A.
If average yields arc achieved, an income in cash or feed for
livestock should be about $100.00 per acre.

Area C: This 7 acre tract of land is proposed to he used
for the planting of nursery stock. -The soil tests furnished and
reviewed by the Soil Conservation Service indicate very good
growth potential. This area is sheltered by higher land to the
north and west and has good deep loam soil. About 3000 trees can
be planted in this area using 12' -spacing to allow for cultivation.
the trees planted will be geared for starting production in about
4 years and, by selection of stock and replanting, about 20%
will be harvested each year. The following are trees recommended
by Sabells Nursery at 5535 W. Ohio, Denver, who has guaranteed
professional help each year .nd proposed distribution thru its
outlets.

The taxes on this $9.00 an acre appraised land should increase
more than 10 times as have other Weld County nurseries. A tax
yield of $14.00 should go up to $140.00 for this 7 acres after
production starts. A return of $300.00 net per acre per year is
very reasonable.
It has been suggested by Soil Conservation that this land be
deep chiseled before planting to allow better moisture penetration
for the nursery stock. Fertilizer in pellet form will be used
around each tree with wind shielding for all plants.

Area D: This 5.34 .,tire area will be prepared and seeded the
same as Area B. This acreage will he used in part later for
feeding and raising some cattle. Once some production on Area A
and Area B are achieved, owner proposes to use some of this
production to feed out cattle. This area is now generating $7.00
to SS.CO per year for 'acid County and should produce $14.DC to
$16.00 after grass seeding only. Owner was unable to make an
estimate of tax appraisals for land used for raising cattle. •
This area should produce 6 to 7 tons of grass hay worth approximately
$400.00 or $d5.00 Ter acre.
.area E: This 4 acre portion of ground will Hu Prepared the

!heat with 6 lbs. per acre. This area should not increase in tax
value but will hold the same for one year. Iii the second year,
nursery stock will be planted that requires irrigation that can
be obtained by pumping from installed catch basin below ditch.
• This tlq;e of irrigation will catch waste water at lowest spot.
This water will then be pumped to the top of the crop again.
Small ornamental shrubs will he planted to be sold as potted
plants to retail outlets. The tax base of this area will increase
by a factor of 3 in the third year and then should stabilize at
about $100.0O appraised value by the fourth year for a taxable
income to held County of $30.00 per acre per year.
Area F: This 2 acre piece of lard will be used for a new
(1) one family residence with attached garage. There will be a
• barn for storage and animal shelter. '.then a cattle feeding
oper:tion is started in the second year, a three sided shelter
will be constructed for a loafing shed.
The house will be approximately 1100 sq. feet with one floor
of standard frame construction. It will have wood siding (painted)
with asphalt shingles on the roof. The garage will be approximately
700 sq. feet with the same construction but with a concrete floor
and extended apron.

The barn will be pole construction with rough sawn siding
(painted) and asphalt shingles on the roof. The south side of
the burn will have a three sided open hay storage shed with a
metal roof.
Using current mill levies and comparable homes as a reference,
the residence should generate taxes to 'aeld County oC $125.700
General, $340.00 School and $36.0e for the Fire District. This
area now generates taxes of about $4.00 for all sources.
The Fire District now receives about 15 cents a year from
this area and it would receive approximately $3o.Gc. Statistics
of costs throughout the state to operate a Volunteer Fire T)epartment
show a cost of -$4.00 per person served. Many rural Fir4 _Departments
operate at a cost of much less but this is an average. Data on
cost impact on the Sheriffs Department of '.fold County was not
available, but normally the budget of a paid law enforcement
agency is 927, to 9E,', for salaries. This proposed increase -to
General Taxes should more than cover any cost impact.
LIABILITIES AND ASSETS
• The only liabilities generated against Weld County wi/1 be
a very small impact on road maint-ence, fire protection, police
protection, libraries and all services too numerous to mention.
These liabilities are too minute to be capable of calculation.
Bringing investment money into Weld County to create a new
business, using local sources of supply for needed materials
or help, will help to create a stronger county structure.
The owners anticipate an annual gross in-come in the first
three years of operation of approximately $6500.00. -After the
nursery stock marketing begins the annual gross should be $11,000.60.

proposed new income to Weld County, and a total net gain if
this proposal _is accepted.

of George II, and Judy Ruff for a conditional use permit for -a single family
residence and other uses of a partial of land in southern Weld County, located
in Section 15, TIN, h6ti4',
The fire district feels the area in question is not used to -any value at
the present time and the use plan as presented would be of greater value to
all concerned.
Lay I also state the Dacono Area Fire Protection District has no objections
to the uses of this land as presented in -the application. We are prepared to
give the necessary fire protection to the home and accessory uses as described.
It is therefor recommended by the Dacono Area Fire District that the
decisions and recommendations of the Department of Planning of Weld County
be followed and approved as they decide.
Thank you for your notification to the fire district, and since there was
no complaints, I had neglected to return an answer. Please accept my apologies
for this. We very much appreciate the co-operation the planning commission has
given the fire district in these matters.

We have reviewed the above referenced application and find that geologic
contraints to development generally are minimal . However, swelling
soils and rapid percolation rates could adversely affect residence cons-
truction and sewage disposal . We recommend that a soils foundation inves-
tigation and sewage disposal study be conducted prior to construction.
This study should formulate proper foundation designs so that the proposed
residence will not be damaged or destroyed by swelling soils.
If the above study is conducted, we feel that development can be accom-
plished in a safe and economic manner.

Dear Chuck:
I have reviewed the above item and submit the following:
1 . The soils for the parcel of land are classified as Weld loam,
Ulm clay loam and Nunn loam, all with an agricultural land
use classification of II and III which will support all the
irrigated crops locally adapted.
2. A major irrigation canal crosses the parcel of land from
south to north and the easements for maintenance should be
understood and recognized by the applicant .
3. Flooding and a flood hazard are not a problem with the site.
4. The building site is located on Weld loam soil which has a
good potential for urban development. The soils are high in
shrink-swell in the subsoil and an on-site soil sample for
foundation design and septic systems would be advisable.
