The Weld County Department of Planning Services -Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues may
arise during the remaining application process.

It is assumed that Lot B will receive permission to access onto Cherry from WC Public Works based upon
use of Lot B O&G. If required to share access, then:
Show and label a 30 ft. minimum joint access and utility easement to provide legal access and
utilities to the parcel.

URBANIZING VS NON -URBANIZING DRAINAGE AREA:
This area IS within an Urbanizing Drainage Area:
A Drainage Variance request is required and shall be submitted for review and approval in conjunction with
the Drainage Narrative. A drainage narrative is required and full drainage report and detention pond waived
if the site qualifies for an exception to detention requirements listed below.
The drainage narrative must include at the minimum:
1. Description which exception is being applied for and supporting rationale
2. Where the water originates if it flows onto the property from an offsite source
3. Where it flows to as it leaves the property
4. The direction of flow across the property
5. If there have been previous drainage problems with the property
Exceptions.
1. Exceptions to stormwater detention shall not jeopardize the public health, safety, and
welfare of public and private property. Exceptions shall be supported with a drainage
narrative.
a. No stormwater detention will be required for sites that meet any of the following
conditions. Requirements of the Municipal Separate Storm Sewer System (MS4)
areas remain applicable.
1) Use by Right or Accessory Use in the A (Agricultural) Zone District.
15) Approved by a variance.
This site is located within the Municipal Separate Storm Sewer System (MS4) boundary. These areas are
more urbanized or urbanizing with state mandated, higher water quality requirements. Projects that are
within the MS4 area that disturb greater than or equal to 1 acre; or projects less than 1 acre that are part of
a larger common plan of development or sale; require an approved water quality design. Questions
pertaining to the MS4 requirements should be directed to the Public Works Department 970-304-6496.
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant and Planning Department have reviewed the referral and surrounding
property owner comments. The Early Release Request may or may not be granted depending on referral
comments and surrounding property owner concerns. Contact a Engineering representative from the
Planning Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692-
3575.
Geologic Hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This area IS NOT in a FEMA regulatory floodplain.
CONDITIONS OF APPROVAL:
A. A Drainage Variance request is required and shall be submitted for review and approval in conjunction
with the Drainage Narrative. The Variance Request form can be found at the following link

B. The plan shall be amended to delineate the following:
1. See access comment above - Show and label a 30ft minimum joint access and utility easement

2. The applicant shall show and label the accepted drainage features and drainage flow arrows.
Water quality features or stormwater ponds should be labeled as "Water Quality
Feature/Stormwater Detention, No -Build or Storage Area" and shall include the calculated volume.

3. Show and label the parking and traffic circulation flow arrows showing how the traffic moves
around the property.
Prior to Construction:
A. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required.

Environmental Health Services has reviewed this proposal for A Site Specific
Development Plan and Use By Special Review Permit for oil or gas production
facilities (24 wells, 18 oil tanks, 2 water tanks, 24 separators, 2 meter houses, 4
vapor recovery units, 8 emission control devices, and 2 vapor recovery towers)
in the R-1 (Low Density Residential) Zone District.
The application sates there will be no permanent employees located at the site
once construction is complete. Portable toilet and bottled water are acceptable.
We recommend that the following requirements be incorporated into the permit
as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal
Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and
removed for final disposal in a manner that protects against surface and
groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the
definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner
that controls fugitive dust, fugitive particulate emissions, blowing debris,
and other potential nuisance conditions. The applicant shall operate in
accordance with Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on
the property should comply with the Colorado Air Quality Commission's
air quality regulations.

5. The facility shall adhere to the maximum permissible noise levels
allowed in the Residential Zone as delineated in 25-12-103 C.R.S.
6. Adequate drinking, hand washing and toilet facilities shall be provided
for employees, at all times. For employees or contractors on site for
less than 2 consecutive hours a day, and 2 or less full time employees
on site, portable toilets and bottled water are acceptable. Records of
maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County
Department of Public Health and Environment. Portable toilets shall be
serviced by a cleaner licensed in Weld County and shall contain hand
sanitizers.
7. Any stained or contaminated soils on the facility shall be removed and
disposed of in accordance with applicable rules and regulations. All
spills will be documented and records will be kept onsite for WCDPHE
review upon request. All spills will be reported to local, state and federal
agencies in accordance with all state and federal regulations.
8. All potentially hazardous chemicals must be handled in a safe manner
in accordance with product labeling. All chemicals must be stored
secure, on an impervious surface, and in accordance with
manufacturer's recommendations.
9. Secondary containment shall be constructed around tanks to provide
containment for the largest single tank and sufficient freeboard to
contain precipitation. Secondary containment shall be sufficiently
impervious to contain any spilled or released material. Secondary
containment devices shall be inspected at regular intervals and
maintained in good condition. All secondary containment will comply
with the Colorado Oil and Gas Conservation (COGCC) Commission
Rule 604 and/or the provisions of the State Underground and Above
Ground Storage Tank Regulations.
10. The applicant shall acquire an Air Pollution Emission Notice (A.P.E.N.)
and Emissions Permit Application from the Air Pollution Control
Division, Colorado Department of Public Health and Environment, as
applicable.
11.The applicant shall obtain a Colorado Discharge Permit System or
CDPS permit from the Colorado Department of Public Health and
Environment (CDPH&E), Water Quality Control Division, as applicable.
12.A Spill Prevention, Control and Countermeasure Plan, prepared in
accordance with the applicable provisions of 40 CFR, Part 112, shall be
available on site.
13. The operation shall comply with all applicable rules and regulations of
State and Federal agencies and the Weld County Code.

This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide informal comments. The comments do not
address the physical adequacy of the water supply plan for this project or the ability of the
water supply plan to satisfy any County regulations or requirements. In addition, the
comments provided herein cannot be used to guarantee a viable water supply plan or
infrastructure, the issuance of a well permit, or physical availability of water.
The Applicant is seeking a site specific development plan and use by special review permit for
oil or gas production facilities (24 wells, 18 oil tanks, 2 water tanks, 24 separators, 2 meter
houses, 4 vapor recovery units, 8 emission control devices and 2 vapor recovery towers) in the
R-1 (Low Density Residential) Zone District. According to the submitted information, the site
will not require an on -site water source. During drilling and completion operations, modular
large volume tanks will be temporarily installed on -site to store water. It is anticipated that
these tanks will be filled from a local source through use of temporary above ground water
lines. No trucking of water is anticipated. Additionally, all irrigation water to establish
landscaping will be provided by a truck mounted water tank. No permanent irrigation lines
will be installed. The proposal did not specify the source of the water that will be used at
the site. Any water delivered to, and used at, the site must be legally available for such
uses.

The application materials indicate that the proposed development will have detention ponds.
The applicant should be aware that, unless the structure can meet the requirements of a
"storm water detention and infiltration facility" as defined in section 37-92-602(8), Colorado
Revised Statutes, the structure may be subject to administration by this office. The applicant
should review DWR's Administrative Statement Regarding the Management of Storm Water
Detention Facilities and Post-Wildland Fire Facilities in Colorado, attached, to ensure that
the notification, construction and operation of the proposed structure meets statutory and

General
❑ Advisory. The subject site is within the City of Greeley's Long Range Expected Growth
Area. This is the range in which the community anticipates development occurring in the
coming 20+ years. Recommendations are made to increase the compatibility of this
development with the urbanization of this area and to avoid a non -conforming situation in
the future.
❑ Advisory. It is recommended that the applicant propose to utilize Best Management
Practices that are similar to those that were approved by the Greeley City Council for the
Triple Creek site (USR 6:14). The City has found these to be effective mitigation tools in
an urban/urbanizing setting. (See attached.)
❑ Advisory. It is recommended that the applicant host a neighborhood meeting prior to the
public hearing with the Planning Commission to hear and address potential concerns
about the proposal from nearby residents, school workers and parents, and interested
community members.
❑ Advisory. It is expected that the City of Greeley's Parks, Trails, and Open Lands Master
Plan, about to be adopted, will recommend a trail along the Greeley #3 Ditch. Please
situate equipment so that a trail can be placed along the ditch and still maintain a setback
of at least 150 feet from any equipment. Please also ensure that the Greeley #3 Ditch is a
referral agency on this land use proposal.
❑ Advisory. It is recommended that the applicant work to compact their site layout to
minimize the area affected by this use.

City -Recommended Development Standards
❑ Please ensure that the site can meet or exceed the standards, specifically regarding
setbacks, necessary to obtain a 2A permit from the COGCC. Please request that the
applicant provide the 2A submittal and the approved permit, as well as a map of the
bottom -hole locations, to our office.
❑ Cherry Avenue is identified as an arterial roadway in Greeley's 2035 Transportation
Master Plan. It is encouraged that all site improvements, including landscaping and
fencing, be located outside of the required future right-of-way that is detailed in
Engineering comments below to reduce the chance that future roadway improvements
will affect the investment.
As a major thoroughfare through the community, it is recommended that landscaping be
installed adjacent to, but outside of, the future required right-of-way for Cherry Avenue
to help establish an attractive streetscape. It is recommended that plantings be installed at
the following rates:
o Three shade trees per 100 linear feet
o One evergreen tree per 100 linear feet
o Three large shrubs (>8 feet tall at maturity) per 100 linear feet
o Five medium shrubs (4-8 feet tall at maturity) per 100 linear feet
❑ A combination of solid fencing, berming, and landscaping should be provided on all sides
to adequately screen and buffer this use from neighboring uses of different intensities. A
solid fence and/or berm is recommended on all sides. Adjacent to the school and
residences, the following is recommended for every 100 linear feet in a 30 -foot -wide
buffer yard:
o Five shade trees
o Six ornamental trees or large shrubs (>8 feet tall at maturity)
o Four evergreen trees
o Thirty large shrubs (>8 feet tall at maturity)
Adjacent to undeveloped property, the following is recommended for every 100 linear
feet in a 15 -foot -wide buffer yard:
o One shade tree
o One ornamental tree or large shrub (>8 feet tall at maturity)
o Five small shrubs (<4 feet tall at maturity)
❑ It is recommended that the applicant install permanent irrigation and a detailed plan for
landscape maintenance.
❑ Fences or walls ideally should include variation in appearance at least every 50 feet. This
can be achieved by constructing columns or offsetting the angle.

applicant provide the 2A subinittal and the approved permit, as well as a map of the
bottom-hole locations, to our office.
❑ Cherry Avenue is identified as an arterial roadway in Greeley's 2035 "I'ransportation
Master Plan . It is encouraged that all site i�nprovements, including landscaping and
fencing, be located outside of the required future right-of-way that is detailed in
Engineering comments below to reduce the chance that future roadway improvements
will affect the investment.
As a major thoroughfare through the community, it is recommended that landscaping be
installed adjacent to, but outside of, the future required right-of-way for Cherry Avenue
to help establish an attractive streetscape. It is recoinmended that plantiugs be installed at
the following rates:
o Three shade trees per 100 linear feet
o Oue evergreen tree per ] 00 liuear feet
o Three large shrubs (>8 feet tall at maturity) per 100 linear feet
o Five medium shrubs (4-8 feet tall at maturity) per 100 linear feet
❑ A combination of solid fencing, berming, and landscaping should be provided on all s�des
to adequately screen and buffer this use from neighboric�g uses of different intensities. A
solid fence and/or berni is recouunended on all sides. Adjacent to the school aud
residences, the following is recommended for every 100 linear feet in a 30-foot-wide
buffer yard:
o Five shade trees

❑ City of Greeley's 2035 Comprehensive Transportation Plan indicates that Cherry Avenue
will be a 2 lane minor arterial roadway requiring a 100 ' total public right of way (50 ' half
right of way). Please eusure that the site map calls out the future east half of the right of
way for Cherry Avenue and that all wellheads, production equipment and associated
structures are set back a minimum of 150 feet or 1 Yz times the height of the derrick,
whichever is greater, from the future right of way line. [Chupter 18. 56. 040. a. 1J
Traftic
❑ The traffic memo states that water used for hydraulic fracturing will be obtained from a
local source which will reduce the atnount of truck traffic during hydraulic fracturing.
The City of Greeley does not have adequate water systems in the area to provide any
water to the project. Will water be able to be supplied to the site by the Greeley #3 Ditch
aloue? If not please revise the traffic ine�no accordingly.
❑ Portions of Cherry Avenue and 24`�' Street on the proposed truck route are withii� the CiYy
of Greeley. During the drilling and completion phase, the amount of traffic ou these
roads will substantially increase. As such it will be required that the operator enter into a
road �naintenance agreement with the City of Greeley to utilize roads within the City. A
draft of this agreement will be provided once completed by staf£ This agreement will
specify tenns as to which the operator will be required to maintain or repair Cherry
Avenue and 24`" Street due Yo increased traffic during the drilling and completion

Water
❑ The City of Greeley's current water infrastructure in the subject area is not sufficient to
supply water for a fracturing operation. The City will not be able to provide Extraction
with any water for the proposed drill site without improvements being made to the
current water distribution system. If Extraction would like to discuss options for
constructing improvements that would allow for water to be supplied to the proposed
project from the City's distribution system, please contact TJ Heupel at
tj.heupel@greeleygov.com.
Fire
❑ Advisory. The subject development is in the Western Hills Fire Protection District. This
district is a part of the Greeley Fire Department. For this reason the proposed
development will have to meet City fire codes and standards.
❑ Access roads to tank batteries must meet the requirements set forth in IFC Section 503.2.
An all-weather surface is required and the maximum grade of access road is 10%. The
angle of approach and departure for any means of access shall not exceed 8 degrees.
❑ Access roads to tank batteries and wellheads must be a least 20' wide and have a
minimum unobstructed overhead clearance of 13' 6". [Chapter 18.56.090]

D) All tanks on site must be no taller than 12.5 feet.
E) No drilling waste (cuttings, etc.) may be stored or kept on the site permanently.
F) The operator must have regular response personnel available and visiting the site, a
minimum of two visits per daylight hours and one visit per night, with minor exceptions
allowed for weather conditions, etc.
6) Prior to drilling or being preparation of the site, the applicant shall provide evidence to the
