RE: APPROVE WAIVER OF ANNEXATION IMPACT REPORT - TOWN OF PLATTEVILLE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a request to waive the requirement for
submittal of Annexation Impact Report for the Olinger Annexation which is encumbered by the
Town's sewer lagoons, in conformance with Section 31-12-108.5, C.R.S, and
WHEREAS, after review, the Board deems it advisable to approve said request of waiver
in adherence to the statue, that states, "Such report shall not be required for annexations of ten
acres or less in total area or when the municipality and the board of county commissioners
governing the area proposed to be annexed agree that the report may be waived."
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of waiver from the Town of Platteville to the County of Weld,
State of Colorado, by and through the Board of County Commissioners of Weld County, be, and
hereby is, approved.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of October, A.D., 2016.

Brief description of the problem/issue:

The Town of Platteville is annexing a property adjacent to CR 32.5 known as the "Olinger Annexation". Per Colorado
Revised Statues (CRS) Platteville is required to submit an annexation impact report (C.R.S. § 31-12-108.5). Platteville is
requesting a waiver under C.R.S. § 31-12-108.5 which allows the County to waive the impact report. p p rt.
31-12-108.5. Annexation impact report - requirements
"(1) The municipality shall prepare an impact report concerning the proposed annexation at least twenty-five days before
the date of the hearing established pursuant to section 31-12-108 and shall file one copy with the board of county
commissioners governing the area proposed to be annexed within five days thereafter. Such report shall not he required
for annexations of ten acres or less in total area or when the municipality and the board of county commissioners
governing the area proposed to be annexed agree that the report may be waived".

Recommendation:
See attached letter and associated maps from the Town of Platteville requesting the waiver. The Town is requesting the

the proposed annexation, Platteville will annex County Road 32.5, which is currently maintained by County. Coun . Once
this portion of road is annexed the Town of Platteville will have full control over the road and will remove our
maintenance obligations. The Commissioners waived an annexation impact report for the Town of Ault in 2015 for a
similar situation. Staff recommends that the Commissioners waive the impact report because there are no apparent issues
or impacts to the County. If the Commissioners agree to waive the report the item will be placed on the agenda and a
Resolution will be prepared.

RE: Town of Platteville Waiver Request
Dear Mr. Parko:
The Town of Platteville owns the property where the Town sewer lagoons (Parcel 4 120913001001) are located
and it is still within unincorporated Weld County. The site is at the southeast intersection of WCR 32.5 and
Sterkel Drive (WCR 23.5) I am attaching a copy of the annexation plat so you can see where the site is located.
The Town is initiating the annexation of the property.
Pursuant to § 15-1-90(a) of the Town Code, annexation impact reports are required "for each annexation of five
(5) acres or more" and "shall meet all of the requirements imposed for annexation impact reports by Section 31-
12-108.5, C.R.S." Because the Town property is 18.916 acres in size an impact report is required. There is a
provision in C.R.S. § 31-12-108.5 allowing the County to waive the impact report requirement if they are
willing.
As you know, CR 23 1/2 (Sterkel Drive) was paved recently as a joint project between Weld County and the
Town of Platteville. The Town agreed to annex and maintain the quarter mile of 32 1/2 as part of this joint
project. The annexation proposal will satisfy the Town's contribution. We believe road maintenance would be
the largest impact to the County which will be eliminated with approval of the annexation.
We respectfully request that you waive the annexation impact report requirement. Thank you for your
consideration in this matter.

Before I send this over to the Commissioners for a read and pass around and review and let me
know if you have any concerns or questions. Platteville is requesting a waiver of the annexation
impact report. I don't see any issues with it. As part of the Olinger annexation, Platteville intends
to annex a portion of CR 32.5, which is currently in the County and is maintained by us. Once
they annex we can remove it from our maintenance schedule. The Oligner property is currently
where the Town's sewer lagoons are located so it also makes since for them to take it. I want to
get this over to the Board tomorrow so I can get it on their agenda. Sorry for the late notice, but
Platteville is under a time crunch.
