RESOLUTION
RE: APPROVAL OF UNIT DEVELOPMENT PLAN FOR LAND LOCATED IN PART
OF SECTION 10 AND PART OF SECTION 15 , TOWNSHIP 2 NORTH,
RANGE 68 WEST OF THE 6TH P.M. , WELD COUNTY, COLORADO OWNED
BY HAROLD AND FRED REESE.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado held a public hearing on the 23rd day of April, 1979
at the hour of 9 : 00 o' clock A.M. for the purpose of hearing the
application of Harold and Fred Reese for approval of a Unit
Development Plan on the following described real estate, to-wit:
That part of the East one-half Southeast one-
quarter of Section 10, and that part of the
Northeast one-quarter Northeast one-quarter
of Section 15, Township 2 North, Range 68
West of the 6th Principal Meridian, Weld County,
Colorado, described as: Beginning at the North-
east corner of said East one-half Southeast
one-quarter; thence N89°51'57"W on an assumed
bearing along the North line of said East one-
half Southeast one-quarter a distance of 50.20
feet to a point on the Westerly R.O.W. line
of Interstate 25, said point being the true
point of beginning; thence continuing N89°51'57"W
along said North line, a distance of 1274.04 feet
to the Northwest corner of said East one-half
Southeast one-quarter; thence S00°27'38"W along
the West line of said East one-half Southeast
one-quarter a distance of 2695.47 feet to a
point 30.00 feet South of the Southwest corner
of said East one-half Southeast one-quarter;
thence 589°46'03"E, parallel with the South
line of said East one-half Southeast one-quarter,
a distance of 1076.78 feet to a point on said
Westerly R.O.W. line of Interstate 25; thence
Northerly along said Westerly R.O.W. line as
follows:
N00°03'30"W, 210.50 feet;
N05°41'40"E, 2182.24 feet;
N00°28'00"E, 314.80 feet to the true
point of beginning.
Contains 72.94 Acres more or less.
WHEREAS, the petitioner was present, and
WHEREAS, evidence was presented in support of the approval
of the Unit Development Plan upon the aforementioned tract of
land, and

WHEREAS, Section 6. 6 of the Weld County Zoning Resolution
authorizes the Board of County Commissioners to grant approval
of a Unit Development Plan upon the showing by the Petitioner
of compliance with all of the requirements of Section 6. 6 of
the Weld County Zoning Resolution, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado heard all of the testimony and statements of those
present, has studied the request of the petitioner and having
been fully informed, is satisfied that the request for approval
of the application for a Unit Development Plan complies with
all of the conditions set forth in Section 6. 6 of the Weld County
Zoning Resolution.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado that the petition of Harold
and Fred Reese for approval of a Unit Development Plan on the
tract of land set forth above be, and hereby is, granted subject
to the following:
1. Development Standard #1 as proposed by the applicant
be deleted and replaced with the following:
"1. USES. The uses permitted shall be those which are
are allowed in the C-Commmercial District as de-
fined in the Weld County Zoning Resolution. "
2. The addition of Development Standard #9 which shall
read:
"9. The unit development plans shall be limited to
the plan submitted and governed by the Develop-
ment Standards stated above and applicable Weld
County regulations. Any material deviations from
the plans and/or Development standards as shown
or stated above shall require the approval of
an amendment to the Unit Development Plan by the
Planning Commission and the Board of County Com-
missioners before such changes from the plans
and/or Development Standards shall be permitted.
Any other changes from the plans and/or Develop-
ment Standards shall be filed in the Office of
the Weld County Department of Planning Services . "
BE IT FURTHER RESOLVED by the Board that the reasons for
approval contained in the Department of Planning Services recom-
mendations dated April 3, 1979 be, and hereby are, incorporated
as the findings of fact of the Board of County Commissioners in
this matter.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 23rd day of
April, A.D. , 1979.

for the following reasons:
1. This request is consistent with the sole condition of approval set
forth in the Board of County Commissioners ' Resolution dated
February 7 , 1979 which states that "the property be developed
pursuant to the unit development procedures of Weld County, Colorado
at such time as the development of the property is sought. "
2 . This request is in compliance with Section 6 . 6 Unit Development
of the Weld County Zoning Resolution.
The Planning Commission recoumrendation for approval is conditional
upon the following :
