RE: DESIGNATION OF A PORTION OF COUNTY ROADS 47 AND 49 AS FOUR -LANE
CONTROLLED -ACCESS COUNTY PRIMARY HIGHWAY, PURSUANT TO SECTION
§43-2-110(1.5), C.R.S.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, Section 43-2-110, C.R.S., was amended by the Colorado General Assembly,
in 2016, to add a new Subsection (1.5), which authorizes a board of county commissioners in a
county with a population of 250,000 or more to designate as a primary road any four -lane
controlled -access county highway, commencing construction in 2016, and is located in the
unincorporated area of the county, and intersects with a United States numbered highway, and
WHEREAS, the effect of such designation is for the county to retain those details of
jurisdiction, control and duty listed in Section 43-2-110(1.5), C.R.S., for those portions of the
designated highway that are annexed by a municipality subsequent to the date of designation,
and
WHEREAS, Section 43-2-110(1.5), C.R.S., also lists details of jurisdiction, control and
duty held by the municipality after annexation by the municipality of portions of the designated
highway, and
WHEREAS, in 2016, the Board of County Commissioners of Weld County began
construction of County Roads 47 and 49 as a four -lane controlled -access Weld County Primary
Highway in the unincorporated area of Weld County, proceeding north from the Intersection of
County Roads 18 and 49, through the intersection of County Road 49 and U.S. Highway 34, and
extending north to the intersection of County Road 47 and Colorado State Highway 392, as shown
on the map which is attached hereto and referred to herein as "Exhibit A," and
WHEREAS, the U.S Census Bureau estimates Weld County's population on July 1, 2015,
was 285,174, and
WHEREAS, the Board of County Commissioners now desires to designate that stretch of
County Roads 47 and 49, shown on Exhibit A, as a four -lane controlled -access Weld County
primary highway in accordance with the provisions of Section 43-2-110(1.5), C.R.S.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that County Roads 47 and 49, commencing construction in 2016 as a four -
lane controlled -access highway in the unincorporated area of Weld County, proceeding north from
the Intersection of County Roads 18 and 49, through the intersection of County Road 49 and
U.S. Highway 34, and extending north to the intersection of County Road 47 and Colorado State
Highway 392, as shown on Exhibit A, be, and hereby is, designated as a Weld County Primary
Highway, pursuant to the provisions of Section 43-2-110(1.5), C.R.S.

BE IT FURTHER RESOLVED by the Board that the respective jurisdiction, control, and
duty of Weld County and any municipality that annexes any portion of said Weld County primary
highway County Roads 47and 49 shall be as set forth in Section 43-2-110(1.5), C.R.S.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 10th day of August, A.D., 2016.
