RE: APPROVE PARTIAL VACATION OF USE BY SPECIAL REVIEW PERMIT, USR-1036
- CIRCLE B LAND COMPANY, LLC
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, by Resolution #940080, dated January 12, 1994, the Board did approve the
request of Thomas and Beverly Trostel, for a Site Specific Development Plan and Use by Special
Review Permit, USR-1036, for a Single Family Dwelling on a Lot Less than the Minimum Lot Size
in the A (Agricultural) Zone District, on the following described real estate, to -wit:
Part of the E1/2 NW1/4, and a portion of the NE1/4
of Section 9, Township 6 North, Range 66 West of
the 6th P.M., Weld County, Colorado
WHEREAS, the Board has received a request from the current property owner, Circle B
Land Company, LLC, c/o Doug Dennison, 33105 County Road 33, Greeley, Colorado 80631, to
partially vacate Use by Special Review Permit, USR-1036, to satisfy Condition of Approval #2.A
of Recorded Exemption, RECX14-0154, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said partial vacation, conditional
upon the following:
1. Pursuant to Section 23-2-200.G.5 of the Weld County Code, the applicant
shall submit a revised plat, titled "Partial Vacation of Use by Special Review
Permit, USR-1036", conforming to Section 23-2-260.D of the Weld County
Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Use by Special Review Permit, USR-1036, be, and hereby is, partially
vacated, with the abovementioned condition, with said plat to be titled and recorded as Partial
Vacation of Use by Special Review Permit, USR-1036.

ZONE DISTRICT: A (Agricultural)
NARRATIVE: The applicants have been administratively approved on July 8, 2016 for a Two -Lot Recorded
Exemption RECX14-0154; being located on Lot B of Corrected Recorded Exemption RE -
2573, recorded April 2, 2003. RECX14-0154 included the following Condition of Approval:
2.A. "There is a Use by Special Review USR-1036, recorded March 4, 1994 per Reception # 2376650,
for a single family dwelling on a lot less than the minimum lot size (70.069 acres) in the A
(Agricultural) Zone District (80 acres). This USR boundary encompasses both Lot A of Recorded
Exemption RE -2573, recorded June 15, 200O per Reception # 2775025 and Lot B of Corrected
Recorded Exemption RE -2573, recorded April 02, 2003 per Reception # 3048215.
The USR no longer applies to Lot B as the residence related to the USR was separated off onto Lot
A via RE -2573. Additionally, the Weld County Code no longer provides the option to permit a single
family dwelling on a lot less than the minimum lot size in the A (Agricultural) Zone District with a
USR. As a result, USR-1036 is obsolete and is not needed for Lot A of RE -2573 as well as for Lot B
of Corrected RE -2573.
The applicant shall work with the property owner (Dale A. Sanders) of Lot A of RE -2573 to vacate
USR-1036. If the property owner of Lot A of RE -2573 is not willing to vacate the USR, the applicant
shall submit a complete application including a letter and map for the Partial Vacation of USR-1036
prior to recording the Recorded Exemption plat."
Circle B Land Company, LLC decided to proceed with requesting a Partial Vacation of USR-1036 on Lot B
of Corr RE -2573. The Department of Planning Services has received the attached letter and a draft plat
map for the Partial Vacation of USR-1036, dated November 9, 2016, from authorized agent Doug Dennison
with Circle B Land Company, LLC.

The Department of Planning Services staff has reviewed this request and recommends that this
request be approved.
If approved, the B0CC Resolution will satisfy condition 2.A of the RECX14-0154 administrative review and
the RECX14-0154 plat may proceed with recording. The applicant shall also submit and record a revised
USR map per Section 23-2-280 of the Weld County Code.
Background Information
January 12, 1994:
USR-1036 for a single family dwelling on a lot less than the minimum lot size (70
acres) in the A (Agricultural) Zone District (80 acres) was approved by BOCC
Resolution #940080 and recorded March 4, 1994, reception number 2376650. This
case created a legal building lot on the eastern portion of RE -1017.
June 15, 2000: RE -2573 was recorded, reception number 2775025. This case split the lot created
via USR-1036.
April 02, 2003:
Corrected RE -2573 was recorded, reception number 3048215. This case corrected
the location of the building envelope on Lot B of RE -2573. Lot A of RE -2573 was not
affected.
December 17, 2014: A complete application for RECX14-0154 was received. This case seeks to split Lot
B of Corr RE -2573 via a 2 -lot recorded exemption.
July 8, 2016: Revised RECX14-0154 administrative review including Conditions of Approval Item
#2.A regarding the Partial Vacation of USR-1036 was sent to the applicant.
November 9, 2016: A complete Partial Vacation of a USR application per Section 23-2-280 was received
including the request letter and a revised draft USR map.

Dear Michael,
On behalf of Circle B Land Company, LLC, a wholly -owned subsidiary of Bill Barrett
Corporation (BBC), we are hereby requesting a partial vacation of the Use by Special Review
Permit USR-1036. The basis for this request is detailed below.
At the time USR-1036 was approved, the subject property consisted of 70.069 acres of land
and this USR allowed for the construction of a single family dwelling on a lot less than the
minimum lot size that was required by Weld County in the A (Agricultural) Zone District at that
time (1994). This lot was subsequently divided into two lots in 2000 via approval of Recorded
Exemption RE -2573, that was subsequently corrected. The lots created consisted of Lot B,
the parcel of land that is currently owned by Circle B Land Company, LLC, and the smaller Lot
A. The only single family residence that currently exists on either of these lots is on the Lot A
created by RE -2573. In addition, Weld County no longer authorizes single family dwellings on
a lot less than the minimum lot size in the A Zone District via a USR. Therefore, Circle B Land
Company requests that USR-1036 be vacated for Lot B of Corrected RE -2573.
A revised USR plat illustrating the vacated portion of the property is enclosed.

WHEREAS, the Board of County Commissioners of Weld County, Colorado,
pursuant to Colorado statute and the Weld County Home Rule Charter. is vested
with the authority of administering the affairs of Weld County. Colorado. and
WHEREAS, on January 12, 1994, the Board did. by Resolutions 0940080 and
#940081. approve Special Review Permit 01036 and Recorded Exemption 01566.
respectively. for Thomas G. and Beverly Trostel for property which is located in
part of Section 9. Township 6 North, Range 66 West of the 6th P.M.. Weld County,
Colorado, and
WHEREAS, Condition of Approval #1 of said Recorded Exemption #1566 and
Condition of Approval #4.a. of said Special Review Permit 01036 stipulated that
said applicants must obtain a resolution vacating Recorded Exemption #1017. and
WHEREAS, Steve Stencel, Intermi]l Land Surveying. has submitted a letter
on behalf of the applicants requesting said vacation of Recorded Exemption #1017,
and
WHEREAS, after study and review. the Board deems it advisable to vacate
Recorded Exemption 01017, based on the Planning staff's recommendation.
NOW, THEREFORE, BE TT RESOLVED by the Board of County Commissioners of Weld
County, Colorado. that Recorded Exemption #1017 be, and hereby is, vacated.
satisfying Condition of Approval #1 of Recorded Exemption 01566 and Condition of
Approval #4.a. of Special Review Permit #1036 issued to Thomas G. and Beverly
Trostel.
The above and foregoing Resolution was. on motion duly made and seconded.
