Staff comments made during this phase of the application process may not be all-inclusive, as other issues may arise during the remaining application process. COMMENTS: This project is a power transmission line project with three substations between CR14 north to CR50 between CR31 east to CR51. Roads: From the application materials it appears the transmission line crosses the following rights of way. Vehicles vary from pickup trucks to tractor trailers. After construction the project would generate infrequent trips to the transmission line and substations during operation. The line would be inspected annually and occasionally for maintenance. Access: An Access Permit is required. For new accesses and/or change of use of an existing access, the fee and photos are required (Access permit instructions and application can be found at http://www.co.weld.co.us/Departments/PublicWorks/Permits/Applications.html.) Chapter 6, Sections 6.3, 6.4 and 6.5 of the Weld County Engineering and Construction Criteria, offer access design guidance. (This document can be found at http://www.co.weld.co.us/Departments/Pu blicW orks/Engi neeringand RightofW ay/EngineeringCriteriaand P olicies.html) Existing access points with change of use or new access points may or may not be granted. Questions pertaining to access permits or access design shall be directed to the Public Works Department. TRACKING CONTROL: Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are listed below. Temporary Tracking Control shall be used during construction unless permanent tracking control is installed ahead of construction activities. For the substations it is anticipated there will be minimal traffic once construction is complete with Less than 20 passenger vehicle round trips/day therefore no permanent tracking control requirements however a gravel surface is recommended. During construction a vehicle tracking pad will be required at all crossings to keep from tracking mud or debris on to publically maintained roads. A development standard will be included on the recorded site plan. "The site shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking." Improvements and Road Maintenance Agreement: No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day or 50 round passenger vehicle trips/day. A development standard will be applied to the recorded plan indicating any impacts to the road must be mitigated by the owner. There shall be no tracking from the site onto publically maintained roads. The applicant is responsible for mitigation of any damage or offsite tracking and upgrading and/or maintaining onsite tracking control. Drainage Requirements: The application materials indicated the stormwater runoff from the substations will be collected by detention facilities. A drainage report and certification of compliance was supplied for the Colfer and Milton sites. A draft drainage report was submitted for the Rattle Snake Ridge site as Public Works and the applicant finalize this area with regards to CR49 widening. The transmission line project does not require a detention pond design or water quality treatment as it falls under an exception to stormwater detention in the new drainage code. Grading Permit For the substations, a Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications are accepted after the planning process is complete (plan recorded). An Early Release Request Form may be entertained only after the applicant and Planning Department have reviewed the referral and surrounding property owner comments.The Early Release Request may or may not be granted depending on referral comments and surrounding property owner concerns. Contact an Engineering representative from the Planning Department for more information. A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact: Colorado Department of Public Health and Environment,Water Quality Control Division, Rik Gay, 303-692- 3575. A grading permit is not required for transmission lines. Unless more than 1 acre is disturbed for construction of non-transmission line items such as structures, parking lots, laydown yards etc...,a Weld County grading permit will be required prior to the start of construction. Contact the Planning Department for more information. Geologic Hazard Area: This area IS NOT in a Geologic Hazard Area. Floodplain: This project crosses a portion of the Box Elder Creek floodplain. A flood hazard development permit is required for any development in the floodplain. Contact the floodplain planner Diana Aungst at 970-353- 6100. Permits: Contact the Permitting/Inspection agent for Weld County Public Works, at (970) 304-6496, ext. 3764 for a Right-of-Way permit for any work that may be required in the right-of-way. A special transport permit will be required for any oversized or overweight vehicles that may access the site and may also be obtained through the same office. CONDITIONS OF APPROVAL: A. The applicant shall contact Weld County Department of Public Works to complete a Non-Exclusive License Agreement for the upgrade and maintenance of Weld County Road section line Rights-of-Way (Department of Public Works) B. A Final Drainage Report and Certification of Compliance stamped and signed by a Professional Engineer registered in the State of Colorado is required for the Rattlesnake Ridge substation. (Department of Planning Services-Engineer) C. The plan shall be amended to delineate the following: 1. County Roads 6, 10, 12, 18, and 20 are designated on the Weld County Road Classification Plan as gravel local roads, which require 60 feet of right-of-way at full build out. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the map. All setbacks shall be measured from the edge of future right-of-way. These roads are maintained by Weld County. 2. County Roads 6, 10, 12, 18, and 20 are designated on the Weld County Road Classification Plan as paved local roads, which require 60 feet of right-of-way at full build out. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the map. All setbacks shall be measured from the edge of future right-of-way. These roads are maintained by Weld County. 3. County Road 8 is designated on the Weld County Road Classification Plan as a paved collector road, which requires 80 feet of right-of-way at full build out. There is presently 60 feet of right-of- way. An additional 10 feet shall be delineated on the plat as future right-of-way. All setbacks shall be measured from the edge of future right-of-way. The applicant shall verify the existing right-of- way and the documents creating the right-of-way and this information shall be noted on the plat. This road is maintained by Weld County. 4. County Road 22 is designated on the Weld County Road Classification Plan as a paved arterial road, which requires 140 feet of right-of-way at full build out. There is presently 60 feet of right-of-way. An additional 70 feet shall be delineated on the plat as future right-of-way. All setbacks shall be measured from the edge of future right-of-way. The applicant shall verify the existing right-of-way and the documents creating the right-of-way and this information shall be noted on the plat. This road is maintained by Weld County. 5. The applicant shall delineate the existing right-of-way on the site plan. All setbacks shall be measured from the edge of right-of-way. (Department of Public Works) 6. County Road 49 is designated on the Weld County Classification plan as an arterial road which typically requires 140ft of right-of-way at full build out. Weld County is currently in the process of widening this corridor. The alignment of the road widening project varies along the section line for the corridor. Contact Public Works for the location of the existing and future right of way and easements and delineate these on the site plan. (Department of Planning Services-Engineer) 7. Show and label the approved Non-Exclusive License Agreement and recorded reception number and date on the site plan. (Department of Planning Services-Engineer) 8. Show and label the approved accesses, and the appropriate turning radii on the site plan for the substations. (Department of Planning Services-Engineer) 9. Show and label all easements with the recorded document reception number and date on the site plan. (Planning) 10. Show and label the accepted drainage features and drainage flow arrows on the site plan. Water quality features or stormwater ponds should be labeled as "Water Quality Feature/Stormwater Detention, No-Build or Storage Area, Volume =TBD" (Department of Planning Services-Engineer) Prior to Construction: A. The approved access and tracking control shall be constructed prior to on-site construction. (Department of Planning Services-Engineer) B. If more than one (1) acre is to be disturbed for construction of non-transmission line items such as substations, structures, parking lots, laydown yards etc..., a Weld County grading permit will be required. (Department of Planning Services-Engineer) C. If more than one (1) acre is to be disturbed, a Weld County Grading Permit will be required. (Department of Planning Services-Engineer) DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN) 1. Should noxious weeds exist on the property or become established as a result of the proposed development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant to Chapter 15, Articles I and II, of the Weld County Code. (Department of Planning Services-Engineer) 2. The substation sites shall be maintained to mitigate any impacts to the public road including damages and/or offsite tracking. (Planning and Engineering) 3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized. (Department of Public Works) 4. The historical flow patterns and runoff amounts will be maintained on the site. (Department of Planning Services-Engineer) 5.
