An applicant for a Special Review Permit shall demonstrate conformance with and shall continue to meet any DEVELOPMENT STANDARDS approved and adopted by the County. Our physical address is 24589 WCR 38, La Salle, Co. A few years ago we were made aware of the intent to construct and operate the Heartland plant in its current location. I believe it was during this time, Heartland was applying for their USR. We were reassured, as you know from the application process, that there would be no odors. The main concern and drawback from the construction and operation of the plant would be the additional truck traffic on WCR 49. The zoning where we chose to build and live is agriculture. Dust, flies, smells, critters, and a lot of oil and gas activity come with the territory. No complaints. We all knew what we were signing up for when we chose to live here. We never attended a hearing when The Heartland Project pursued their USR. According to them, truck traffic was our only concern. No odors. I am not going to a hearing to complain about traffic. We are not NIMBYS. The not in my backyard acronym. We have never been in court for any dispute. If someone profited from selling the Heartland project land...I applaud them. The idea of someone building a creative and profitable business appeals to me. As does creating jobs. So, we come down to the 600Ib Gorilla in the room. Odor. Heartland was dishonest, the USR was granted on false information . They lied to our neighborhood and they lied to you, the commissioners. They said there would be no odors. If we knew about the odor, we would have protested. We would have attended the hearings when the Heartland project applied for their USR. Even for us, agricultural folks, who are used to the smells in Weld County, the stench from this plant is intolerable. We live an o utdoor lifestyle so there is no escape. It is evident from the construction of our wind breaks and sheds that we have prevailing winds and airflow from the North and West. We smell this plant a lot. It affects o ur quality of life and our property values. I am assuming the commissioners did some research about the odors from these plants. Or did the commissioners take Heartlands word for it when they claimed the plant would be operated without odors? If it is found these plants cannot be operated without odors there is plenty of blame to go around. The commissioners lack of due diligence is potentially negligent. Heartland is guilty of lying to o ur neighborhood and the commissioners, in which case their USR should be revoked. It is becoming apparent that this plant cannot be operated without odors. Since the commissioners meeting in July when Heartland was going to adopt measures to mitigate odors, the problem has only gotten worse. Our request is simple...if Heartland cannot fix this problem soon, please revoke their USR. After all, they lied to the commissioners and our neighborhood when they applied for their USR. If the commissioners will not take action, the neighborhood is within its rights to seek compensation. The odors have caused the loss of property values , quality of life, and pain and suffering for starters. I had planned on attending this morning's Counsel Meeting; however, my elderly mother is ill and cannot leave her at home alone. Both of my elderly parents reside with me. I bought 80 acres of bare land in 1996, fenced it, put up a home, a barn and stocked it with cattle. At great expense, ex , I wanted my children to grow up in the country. When the Weld County Commissioners permitted Headland Biogas to build here, all of our neighborhood wasgiven assurances that there would be no odor and all waste would be put into huge swimming pools and not left out in the open. They have not followed through on any of these promises. The odor is constant and the fly's generated by all the manure is just horrible. I purchase fly predators from Spaulding Labs, and as a result have never had a fly problem at my home. The yearly cost is approximately $600.00 and both my family and my animals are much happier not having the pests. This year, this expense has been a waste as the fly's are breeding across County Road 49 at Heartland and just fly up here. I just love having fly strips in my kitchen. Over the Labor Day weekend, beginning at 0600 in the morning, I began to haul in hay for my stock for the winter. It was foggy that early in the morning and as I drove past Heartland Biogas, I saw black smoke coming out of the Heartland stacks. Whatever this black smoke was, the stench and the smoke hung in the air trapped by the fog. The stench was horrid. The stench is constant now and I am very concerned about Heartland BioGas only being at 40 percent capacity. The environment here has changed for everyone. There is no longer any "fresh country air." We cannot open our windows and enjoy the morning breeze because if you do, the inside air in our homes is contaminated. I pray that you will listen to those of us that reside next to this horrible business and do something about it. We are taxpayers and residents of Weld County. I see Heartland BioGas as an intruder in. our neighborhood who is ruining our lifestyle, lowering the value of our properties and quite possibly ruining our health.
