A public hearing was conducted on June 1 , 2016 , at 10: 00 a. m . . with the following present:

The following business was transacted :
a I hereby certify that pursuant to a notice dated May 13, 2016, and duly published
May 18 , 2016 . in the Greeley Tribune, a public hearing was conducted to consider the request of
RJM Land Company c/o BNN Western . LLC . for minimal modifications to Site Specific
Development Plan and Use by Special Review Permit, USR15-0021 , for Mineral Resource
Development Facilities , Oil and Gas Support and Service (Class II Oilfield Waste Disposal Facility
— saltwater injection facility) in the A (Agricultural) Zone District. Bob Choate, Assistant County
Attorney, made this a matter of record.

[ Chris Gathman , Department of Planning Services, presented a brief summary of the
proposal and reviewed the changes to reflect: the transfer of assets from Whiting Oil and Gas to
BNN Western , LLC ; the designation from non-commercial to standard Class II Oilfield Waste
Disposal Facility: and , the deletion of the second sentence of Development Standard #6 .

= Janet Lundquist, Public Works Department representative . provided a brief overview of the
transportation plans and requirements including the approved Access Permit Number,
AP15-00091 . and required tracking control and Improvements and Road Maintenance
Agreement. In response to Chair Freeman , Ms . Lundquist stated she will review the access
location .

Hayley Brown , Planning Services Engineer representative, stated no changes or concerns
with the drainage requirements.
Ben Frissell , Department of Public Health and Environment, reviewed the water and sewer
provisions stating no concerns or changes .

Ms . Lundquist clarified the correct Access Permit Number as stated earlier and the other
Access Permit Number listed (AP15-00336) should be deleted .
a Cody Wagoner, represented the applicant and stated the modifications requested were
referenced in the presentation of the previous hearing for USR15-0020.

Doc. # 2016- 1654.) Cody Wagoner, represented the applicant with a PowerPoint presentation
outlining the history of operations. related facilities in Weld County. and the current acquisition of
saltwater disposal wells and 30 miles of gathering pipelines. Mr. Wagoner briefly reviewed future
plans to increase pipelines and decrease the number of trucks on the road. He reiterated the
request for certain modifications and clarified it would be preferable to commercially
accommodate other clientele in the future. Mr. Wagoner stated this presentation represented the
requests for both USR15-0020 and USR 15-0021 , to be heard next.
Mr. Gathman recommended Condition of Approval #1 .A be deleted . The Board agreed .
In response to Chair Freeman , Mr. Wagoner, on behalf of RJM Land Company, c/o BNN
Western , LLC , indicated he has reviewed , and agrees to abide by. the Conditions of Approval and
Development Standards, as amended .
Commissioner Kirkmeyer moved to approve the request of RJM Land Company c/o BNN
Western , LLC . for modifications to Site Specific Development Plan and Use by Special Review
Permit, USR15-0021 , for Mineral Resource Development Facilities, Oil and Gas Support and
Service (Class II Oilfield Waste Disposal Facility — saltwater injection facility) in the A (Agricultural)
Zone District, based on the recommendation of Planning staff, with the Conditions of Approval
and Development Standards as amended and entered into the record . The motion was seconded
by Commissioner Cozad , and it carried unanimously. There being no further discussion , the
hearing was completed at 11 : 53 a. m .

L'1,1 Commissioner Kirkmeyer moved to reopen the Hearing to consider the request of RJM Land
Company c/o BNN Western , LLC . for minimal modifications to Site Specific Development Plan
and Use by Special Review Permit. USR15-0021 , for Mineral Resource Development Facilities ,
Oil and Gas Support and Service (Class II Oilfield Waste Disposal Facility — saltwater injection
facility) in the A (Agricultural) Zone District, for the purpose of opening the hearing to Public Input.
The motion was seconded by Commissioner Cozad , and it carried unanimously .
Chair Freeman opened the hearing to Public Input.
Marvin Stanley, neighbor, stated his concerns with the change of zoning to Commercial for
all of Section 19 , which is currently Agricultural .

Mr. Gathman explained the presentation showed the entire area; however. there is a
Subdivision Exemption , SUBX15-0012 , therefore the operation area is a smaller parcel of
5- 10 acres .
P In response to Commissioner Conway, Mr. Stanley stated no opposition . Commissioner
Cozad interjected the USR does not change the zoning for the parcel and it will remain
Agricultural .
Commissioner Kirkmeyer moved to amend the Hearing record to include the Public Input.
The motion was seconded by Commissioner Cozad , and it carried unanimously. There being no
further discussion , the hearing was completed at 12 : 02 p. m .
