RE: VACATE MINING PLAN FOR GEISERT GRAVEL PIT
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on October 18, 1978, the Board of County Commissioners approved the
Mining Plan for the Geisert Gravel Pit ("the Mining Plan"), located in the NE1/4 SW1/4 and the
N1/2 SE1/4 of Section 31, Township 6 North, Range 65 West of the 6th P.M., Weld County,
Colorado, with said Mining Plan being recorded at Book 855, Reception Number 1776594 in the
Office of the Weld County Clerk and Recorder, and
WHEREAS, a copy of said Mining Plan is attached hereto, and
WHEREAS, the mining of the Geisert Pit by Weld County is now complete, and the
property is nearly finished with reclamation procedures performed by Weld County, and
WHEREAS, by and through a Purchase and Sale Agreement approved by the Board on
March 30, 2015, with First and Second Amendments thereto approved by the Board on June 10,
2015, and on September 14, 2016, respectively, the Board has agreed to sell the Geisert Pit to
Central Colorado Water Conservancy District and Groundwater Management Subdistrict
("Central"), and
WHEREAS, in order to close on the sale of the Geisert Pit, it is necessary for the Board
to vacate the Mining Plan, and
WHEREAS, the Board deems it advisable to vacate the Mining Plan because mining of
the Geisert Pit is now complete and such vacation will enable the sale of said property to Central.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Mining Plan for the Geisert Gravel Pit, being recorded at Book 855,
Reception Number 1776594 in the Office of the Weld County Clerk and Recorder, be, and hereby
is, vacated.
BE IT FURTHER RESOLVED by the Board that the Clerk to the Board be, and hereby is,
instructed to record this Resolution in the Office of the Weld County Clerk and Recorder.
