RE : AUTHORIZE WELD COUNTY TREASURER TO ACCEPT SURETY
BOND AND FURTHER AUTHORIZE THE COUNTY TREASURER
TO ISSUE A DUPLICATE TAX SALE CERTIFICATE.
WHEREAS, Weld County Treasurer, Frances M.
Loustalet , has requested authority to accept a surety
bond indemnifying him against loss be reason of doing so,
and to issue a duplicate tax sale certificate No . 314/1971
issued by the Weld County Treasurer to William Albion Carlson
and Jane Carlson in the amount of Twelve and 56/100 Dollars
($12. 56) , dated in 1971 , and which certificate has been lost ,
misplaced, stolen or destroyed, and
WHEREAS, the Weld County Treasurer has presented
such a Lost Instrument Bond for the Board' s approval and
acceptance, and
WHEREAS , the Board believes it to be in the best
interests of the County to authorize the County Treasurer to
issue a new certificate under proper circumstances of
indemnification of both the Weld County Treasurer and Weld
County, Colorado, and as contained in the aforementioned bond.
NOW, THEREFORE , BE IT RESOLVED, by the Board of
County Commissioners, Weld County , Colorado, that the Weld
County Treasurer, Frances M. Loustalet , be and he hereby is
authorized to issue a duplicate tax sale certificate No . 314/1971
to William Albion Carlson, and Jane Carlson in the amount of
Twelve and 56/100 Dollars ($12 . 56) , subject to receiving a
lost instrument bond in the sum of Nineteen and no/100 Dollars
($19. 00) hereinabove referred to, being a proper bond and in
the proper amount as completed indemnification of the Weld
County Treasurer and Weld County, Colorado.
The above and foregoing Resolution was , on
motion duly made and seconded, adopted by the following vote
on the 8th day of January, A. D. , 1975.

I, WE, Albion Carlson , of the County of
Weld , State of Colorado, being first duly and legally
sworn upon oath, depose and say: That I, We; are the identical person(.%)) to
whom was issued (or assigned) Tax Certificate Numbered 314 of the 19 71
Weld County Tax Sale, covering the 1970 taxes on:
Lot 7 Block 10 1st Add Keota
Assignment being made by Weld County
That said (assigned) Certificate has been misplaced, lost or destroyed
and after the most careful and diligent search, I, We, cannot find the same
nor can I, We-, produce the same for presentation for a Treasurer's or Tax
Deed for the property covered by this Certificate. That I, We, have not
assigned or disposed of this Certificate to any other person or persons, and
that I, We, are still the legal owner of said Certificate. That I, 'Ae, make
this affidavit for the purpose of inducing the county commissioners of said
Weld County, Colorado, to authorize issuance by the County Treasurer of
said Weld County of a new certificate, upon the condition that I, ViWs indemnify
said Weld County and the Weld County Treasurer for and on account of said
lost tax sale certificate.

as Surety, are held and firmly bound unto the County of Weld, State of
Colorado, in the sum of $ 1Q,Q0 , lawful money of the
United States of America, for the payment of which well and truly to be made,
we bind ourselves, each of us, and our heirs, executors, administrators,
jointly and severally by these presents firmly.
Signed, sealed and dated this 20th day of December , A.D. ,
1974.
The condition of this obligation is such that, WHEREAS, a certain Tax
Sales Certificate No. 314 of the 1971 Tax Sale of Weld County, Colorado,
issued and signed by the then Treasurer of Weld County, State of Colorado,
and assigned to Albion Carlson , for the sum of $ 12. 56
the same having been lost, and having established by proof of said loss to the
satisfaction of the Board of County Commissioners of Weld County, Colorado,
and they have by proper Order entered a record authorizing the issuance of a
duplicate Tax Sale Certificate by the County Treasurer Numbered 314
of the 19 71 Tax Sale with all subsequent endorsements thereon.
NOW, THEREFORE, If the said Obligors shall save the County of
Weld and keep harmless the County and all of its officials from all damages,
suits 'and claims of whatever nature, occasioned by the issuance of said
duplicate Tax Sale Certificate without the surrender of the original, then
this
obligation to be void, otherwise to remain in full force and effect.
