HomeMy WebLinkAbout20163338.tiffRECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO OCTOBER 31, 2016 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, October 31, 2016, at the hour of 9:00 a.m. ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of October 26, 2016, as printed. Commissioner Moreno seconded the motion, and it carried unanimously. CERTIFICATION OF HEARINGS: Commissioner Cozad moved to approve the Certification of Hearings conducted on October 26, 2016, as follows: 1) USR16-0031 - Alliance Investment Group — Fort Lupton, LLC, c/o Discovery DJ Services, LLC. Commissioner Conway seconded the motion, which carried unanimously. ei AMENDMENTS TO AGENDA: There were no amendments to the agenda. PRESENTATIONS: el 1) RECOGNITION OF SERVICE, FAIR BOARD- PATRICIA KINDVALL: Chair Freeman read the certificate for the record thanking Ms. Kindvall for her years of service on the Fair Board. Each one of the Commissioners recognized Ms. Kindvall for her dedication and service to the community she lives in. 2) SHERIFF'S OFFICE, RECOGNITION OF SERVICES - LANDON SAUER, STEVEN JARAMILLO, GRANT YOUNT, AND DEREK KINCH: Donnie Patch, Sheriff's Office, acknowledged the heroic acts of the officers and thanked them each for their unselfish assistance to the citizens of Weld County. Ron Worley, resident of Weld County, thanked the officers for coming to his assistance when he experienced a life-threating event. Each one of the Commissioners thanked the officers for serving and protecting the citizens of Weld County. NEW BUSINESS: 1) CONSIDER AGREEMENT FOR PROFESSIONAL SERVICES FOR DISASTER PLANNING AND AUTHORIZE CHAIR TO SIGN FUTURITY IT, INC. /ORION: Roy Rudisill, Director of Office of Emergency Management, presented the agreement for a damage assessment program that will act as a tool to be used during times of emergency or disaster in the amount of $17,500.00. Commissioner Kirkmeyer moved to approve said agreement and authorize the Chair to sign. The motion, which was seconded by Commissioner Moreno, carried unanimously. • 2) CONSIDER GRANT APPLICATION FOR THE JUVENILE DIVERSION PROGRAM AND AUTHORIZE CHAIR TO SIGN: Michael Rourke, District Attorney, reviewed the terms of the application of funds for the Division of Criminal Justice Diversion for the fiscal years of 2017, and 2018. Commissioner Conway moved to approve said application and authorize the Chair to sign. Seconded by Commissioner Cozad, the motion carried unanimously. 3) CONSIDER APPOINTMENT TO FAIR BOARD: Commissioner Cozad moved to approve the appointment to the Fair Board. The motion was seconded by Commissioner Kirkmeyer, and it carried unanimously. • 4) CONSIDER EXTENSION OF TEMPORARY CLOSURE OF CR 30 BETWEEN CRS 47 AND 49: Janet Lundquist, Department of Public Works, reviewed the details of the request for an extension of the temporary closure for an additional seven (7) days and explained IHC has experienced an unanticipated delay due to the utility relocation. Commissioner Moreno moved to approve said extension. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously. PLANNING: re 1) FINAL READING OF CODE ORDINANCE #2016-10, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING (SIGNS), OF THE WELD COUNTY CODE: Commissioner Kirkmeyer moved to read Code Ordinance #2016-10 by title only. Seconded by Commissioner Conway, the motion carried unanimously. Bruce Barker, County Attorney, read the title for the record. Michelle Martin, Department of Planning Services, explained the change aeffects Section 23-4-70 under definitions for changeable copy sign and there have been no changes between the Second and Final Readings. No public testimony was offered concerning this matter. The motion to approve on Final Reading was made by Commissioner Cozad and seconded by Commissioner Conway, and it carried unanimously. • 2) FINAL READING OF CODE ORDINANCE #2016-11, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 (UTILITY SERVICE FACILITY), OF THE WELD COUNTY CODE: Commissioner Kirkmeyer moved to read Code Ordinance #2016-11 by title only. The motion was seconded by Commissioner Conway, and it carried unanimously. Mr. Barker read the title for the record. Ms. Martin stated there have been no changes since the Second Reading. No public testimony was offered concerning this matter. Commissioner Conway moved to approve on Final Reading. Commissioner Cozad seconded the motion, and it carried unanimously. Commissioner Cozad thanked the Planning staff for their work on this Code change. 3) SECOND READING OF CODE ORDINANCE #2015-26, IN THE MATTER OF REPEALING AND REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING (OIL AND GAS), OF THE WELD Minutes, October 31, 2016 Page 2 2016-3338 BC0016 COUNTY CODE (CON'T FROM 10/17/2016): Commissioner Kirkmeyer moved to read Code Ordinance #2015-26 by title only. The motion was seconded by Commissioner Conway, and it carried unanimously. Mr. Barker read the title for the record. Tom Parko, Director of Department of Planning Services, reviewed the changes to the Code, which deals with Oil and Gas Production Facilities and is to provide framework for land use and states the County has purview over certain uses on the surface. He reviewed each one of the changes made after First reading during several discussions and work sessions. a In response to Commissioner Cozad, Mr. Parko explained the notice requirement is in place to stay consistent with the notice process which resulted from discussions with stakeholders. El Commissioner Moreno requested clarification on the paragraph for the one time expansion to the Oil and Gas Facility. Mr. Parko explained this applies to existing Oil and Gas Facilities and should they stay under 50% expansion, they will not be required to obtain a permit. a Craig Rasmusen, representative of Synergy Resources Corporation, stated he is an Oil and Gas Operator and commended the Planning staff and Bruce Barker for the work and effort that was put into this code. a Ashley Campbell, representative of Colorado Oil and Gas Association, thanked all the staff for their work on this matter and requested another stakeholders' meeting. El Susan Fakharzadeh, representative of PDC Energy, acknowledged staff with regards to the time, effort and input from the work group, as well as input from the landowners. .e Kim Cook, representative of Anadarko Petroleum, expressed appreciation of staff's time and commitment and having meetings with the surface owners. a Doug Dennison, representative of Bill Barret Corporation, expressed his belief that getting the surface owners involved helped with a lot of the issues. Ryan Antonio, representative of Noble Energy, stated he is in support of the Second Reading and concurs with everything already said. a Melissa Mayer, representing Bonanza Energy and Kurt Moore, stated they are in support of the Second Reading and thanked staff for listening to the stakeholders' suggestions. Bruce White, resident of Greeley, stated there have been tremendous strides made during the stakeholders' meetings. He expressed his appreciation to all the Commissioners, and stated he is proud of the industry. He believes there is a little more work that needs to be done before the final reading. Commissioner Cozad stated she is in favor of having another stakeholders meeting before the final reading. Commissioner Moreno thanked everyone for their input on this matter. Commissioner Kirkmeyer moved to approve on Second Reading. The motion was seconded by Commissioner Moreno, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. Code Ordinance #2016-10 and #2016-11 were approved on Final Reading and Code Ordinance #2015-26 was approved on Second Reading.
