Exhibit A - Statement of Water Supply Pawnee Waste E&P Landfill USR Application Pawnee will purchase potable water from the neighboring parcel, owned by Grassland Water Solutions LLC (Grassland). Grassland has agreed to supply potable to the Pawnee facility from one of their existing wells (permit number 78412-F). A waterline would then be extended from the Grassland well to the Pawnee property. The Pawnee facility will have restroom facilities in the office/scale house and at the maintenance facility. The well will provide water for these restroom facilities. Depending on the quality of the water from the well, bottled water may be provided for drinking water at the facility. Pawnee will work with Grassland to obtain approval from the Colorado Department of Water Resources and the Colorado Department of Public Health and Environment to permit this water use. When it comes to water for dust suppression, Pawnee will load a water truck with water from Grassland's existing water load out facility (USR-1787), which is on the adjacent property. Attached is a copy of well permit 78412-F as well as a copy of the Water Supply Information Summary Form. The allowed average annual withdrawal from this well and all other wells withdrawing from the Upper Laramie aquifer beneath the 5,054.46 acres of Overlying Land, as described in the Findings referenced above, shall not exceed 394 acre-feet. 6) The use of ground water under this permit is limited to: industrial, irrigation, commercial, livestock, fish rearing, recreation, and pond filling on the above described 5,054.46 acres of overlying land, and additionally industrial and commercual use in all of Weld, Adams, Larimer, Morgan, Washington, Boulder, Logan, Denver, Sedgwick, Phillips, Yuma and Arapahoe Counties. 7) This well must be constructed to withdraw water from only the Upper Laramie aquifer. The top of the Upper Laramie aquifer is located approximately 125 feet below the ground surface. The bottom of the Upper Laramie aquifer is located approximately 425 feet below the ground surface. Plain casing must be installed and grouted to prevent the diversion of water from other aquifers and the movement of water between aquifers. 8) The owner shall mark the well in a conspicuous place with well permit number(s), name of the aquifer, and court case number(s) as appropriate. The owner shall take necessary means and precautions to preserve these markings. 9) A totalizing flow meter or Commission approved measuring device must be installed on this well and maintained in good working order. Permanent records of all diversions must be maintained by the well owner (collected at least annually) and submitted to the Ground Water Commission upon request. 10) This well shall be constructed within 200 feet of the location specified on this permit. 11) The use of water from the well under this permit must have occurred, and a completed Statement of Beneficial Use (including the pumping rate and annual appropriation) must be filed by the well owner, within three years of the date of issuance of this permit. 12) Conditions of Approval #5 was amended on April 7, 2015 pursuant to the Amended Findings of April 7, 2015.
