HomeMy WebLinkAbout20163294.tiffRESOLUTION RE: APPROVE AGREEMENT FOR PRELIMINARY ENGINEERING SERVICES AND SUBMITTAL OF EXHIBIT "A" FOR RAILROAD APPROVAL AND AUTHORIZE CHAIR TO SIGN - UNION PACIFIC RAILROAD (UPRR) WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Agreement for Preliminary Engineering Services and Submittal of Exhibit "A" for Railroad Approval between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and Union Pacific Railroad (UPRR), commencing upon full execution and ending with further terms and conditions being as stated in said agreement, and WHEREAS, after review, the Board deems it advisable to approve said agreement, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Agreement for Preliminary Engineering Services and Submittal of Exhibit "A" for Railroad Approval between the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, and the Union Pacific Railroad (UPRR) be and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said agreement. Please place the attached agreement on the BOCC Agenda. Please return a copy of the agreement to me so I can forward to the railroad. The BOCC approved the pass -around request to put this on the BOCC agenda on October 18, 2016. This agreement is between the Union Pacific Railroad (UPRR) and Weld County so UPRR can begin the preliminary design for the CR 49 railroad crossing just north of CR 54. UPRR is to be reimbursed $5,000 for their time and materials to develop the preliminary design. IHC is responsible for the reimbursement through the design -build contract. UPRR is aware the crossing has been listed as exempt by the PUC due to the fact that there are no trains on the line at this time. It is anticipated the preliminary design will include the extension of the concrete panels and the installation of conduits for a future crossing signal. No signaling equipment is anticipated to be installed as part of the CR 49 Corridor project. UPRR requires a preliminary engineering agreement so they can start designing the crossing. The cost for the preliminary engineering provided by UPRR was $5,000. IHC will be responsible for paying all costs associated with the crossing. However, UPRR will not enter into the agreement with IHC. The agreement has to be with Weld County since the road is ultimately ours to maintain. UPRR is aware the crossing has been listed as exempt by the PUC due to the fact that there are no trains on the line at this time. It is anticipated the preliminary design will include the extension of the concrete panels through the width of CR 49 and the relocation of the signaling equipment. It is anticipated the design will include plumbing the crossing for future signals but no signaling equipment will be placed. What options exist for the Board? (Include consequences, impacts, costs, etc. of options) 1. Approve the preliminary engineering agreement so the Segment 3 design for the roadway can be completed. 2. Do not sign the agreement. Monfort Industrial Lead Subdivision County Road 49/DOT No. 805243D Weld County Lance Kippen Manager, Industry & Public Projects Union Pacific Railroad Company 1400 West 52nd Avenue Denver, CO 80221 Dear Mr. Kippen: Weld County and its design -build contractor (IHC) are preparing plans to widen County Road 49 across the existing Union Pacific Railroad tracks crossing at the location referenced above. The proposed work includes widening the roadway, which necessitates extending the crossing surface material and relocating the existing active crossing warning devices or removing the existing active crossing warning devices for salvage. Note the track is currently inactive with "exempt" signage at the project crossing. In connection with the project, Weld County considers it necessary for the successful advancement of the project for Union Pacific Railroad to collaborate in the development of the project by performing the following: • preliminary engineering and other related services; • development of cost estimates; • review of the projects preliminary layouts; and • submit current train and switching moves. Weld County authorizes and agrees to reimburse the Railroad for its expenses and actual costs that are incurred for collaborating in the development of the project's preliminary engineering and other preliminary activities. The Railroad has estimated these preliminary engineering and other preliminary costs will be $5,000.00. Payment will be made within thirty (30) days from agrWeld County's receipt and approval of the Railroad's request for reimbursement. The project may require the Railroad to incur costs for force account activities. Please prepare the railroad force account cost estimate for work activities to be provided by your company, as identified in Exhibit A and submit them as your earliest convenience so that they may be attached to the railroad generated Construction & Maintenance (C&M) agreement. Please verify the number of current regular trains (Q) (line inactive) and switching movements (0) with a Maximum Speed of N/A MPH at this location as currently shown in our inventory records. This information will be used by Weld County's Contractor to obtain Railroad Protective Liability Insurance. This agreement is intended to address Preliminary Engineering. It is understood by both parties that the Railroad may withhold its approval for any reason directly or indirectly related to safety or its operations, property issues, or effect to its facilities. If the Project is approved, Union Pacific will continue to work with Weld County to develop Final Plans, Specifications and prepare Material and Cost Estimates for Railroad Construction Work associated with the project. It is also understood that if the project is constructed, it will be at no cost to the railroad. Weld County and the Railroad will enter into separate License, Right of Entry, Construction and Maintenance Agreements associated with the actual construction of the project, if the project is accepted and approved by the Railroad.
