WHEREAS, it has been determined by the Board of County
Commissioners, Weld County, Colorado, that a certain tract
of land, being the property of Betty J. Smith, 8512 Peak View,
Erie, Colorado 80516, and more particularly described as
follows, to-wit:
That part of Lot 10, Scott ' s Acres, in Weld County,
Colorado described as follows :
Beginning at the Southeast corner of said Lot 10,
on the South line of the Northeast Quarter of
Section 9, Township 1 North, Range 68 West of the
6th P.M. , in Weld County, Colorado, which point of
beginning lies 766.12 feet West of the East quarter
corner of said Section 9, running thence West along the
the South line of said Lot 646. 8 feet more or less to
the centerline of a ten foot easement owned by
Mountain Bell;
Thence North 00 degrees 02 minutes West along said
easement centerline 741 . 7 feet more or less to the
North line extended West of the aforesaid Lot 10,
thence Easterly along said North line and parallel with
the Lot ' s South line 647.05 feet more or less to the
Northeast corner of said lot;
Thence South 00 degrees 05 minutes West along its
East line 741. 7 feet more or less to the point of
beginning,
EXCEPT that part thereof at the Northwest corner that
lies in the public highway.
Said described parcel of land contains 10. 95 acres,
more or less, and- is subject to any rights-of-way or
other easements as recorded by instruments of record
or as now existing on said parcel of land,
does not come within the purview of the definition of the terms
"subdivision" and "subdivided lands" as set forth in Section
30-28-101 (10) , C.R.S. 1973, as amended, and
WHEREAS, the Board of County Commissioners of the County
of Weld, State of Colorado, desires to exempt this particular
division of land upon the recommendation of the Weld County
Zoning Administrator, for the reasons as stated and pursuant
to its authority under Section 30-28-101 (10) (d) , C.R.S. 1973,
as amended,
NOW, THEREFORE, BE IT RESOLVED that the hereinabove
described tract of land owned by Betty J. Smith, Erie, Colorado,

be exempt from the definition of the terms "subdivision" and
"subdivided lands" as provided for in Section 2-1A(3) of the
Weld County Subdivision Regulations .
The above and foregoing Resolution was, on motion duly

Dear Commissioners:
The attached application, plat, and related items are in reference to a re-
quest, by Betty J. Smith, for a recorded exemption. The subject property
is described as part of Lot 10, Scott's Acres, a subdivision located
in the NEa of Section 9, T1N, R68W of the 6th P.M. , Weld County, Colorado.
Said property is located 3 miles west and 1 mile south of Dacono.
The subject property contains 10.95 acres with one set of improvements.
The request is to split the property into parcels of 5.00 and 5.95 acres.
On May 19, 1976, the Board of County Commissioners approved a request
by Mrs. Smith for a lot size variance so that she could make application
for this recorded exemption. At the time the Board made a decision on that
request, the Planning Commission staff submitted a letter of recommendation
to the Board. A copy of that letter of recommendation is included in the
attached packet. Nothing has been received by our office which would
change our recommendation of approval for this request.

Enclosed you will find all of the papers so 1 can apply for a Recorded
Exemption of my laid, containing approximately 11,013 acres, located
in a part of Lot 10, Scott's Acres in Weld County, and located about
3 miles West and 1 mile south of Dacona, Colorado
I was granted a lot size variance May 17,1976, because it is necessary
to try and sell some of my land to satisfy my financial obligations.

consistin; of 11.013 acres, in Scott's Acres, in Weld County,
as p-rt of Lot 10, does have water available by a well.
There is one well, for domestic use only on the property at
this time, and if Mrs. Smith split off the north 5 acres of her
property there is still plenty of water for another well, for
domestic use only.
Most wells in this area are about 600 feet deep, and there is
plenty of water at this depth.
