HomeMy WebLinkAbout20161755.tiffRESOLUTION RE: APPROVE QUIT CLAIM DEED AND AUTHORIZE CHAIR TO SIGN - BENJAMIN AND JOANNE KNAUB WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with a Quit Claim Deed from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, to Benjamin and Joanne Knaub, and WHEREAS, the Board has determined that it no longer needs the property interests conveyed to Weld County in the document recorded in Book 1369, Page 125, at reception number 1164069 in the records of the Weld County Clerk and Recorder, and WHEREAS, in order to clean up the title to the surface estate, the Board has agreed to quit claim said property interests to the surface estate owners, and WHEREAS, after review, the Board deems it advisable to approve said Quit Claim Deed, a copy of which is attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld County, Colorado, that the Quit Claim Deed from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, to Benjamin and Joanne Knaub be, and hereby is, approved. BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized to sign said Quit Claim Deed. Conway, Pro-Tem Julie A. ozad EXCUSED Barbara Kirkmeyer Steve Moreno 2016-1755 PR0035 TO: Board of County Commissioners FROM: Bob Choate, Assistant County Attorney DATE: May 23, 2016 SUBJECT: Quit Claim of Gravel Surface Easement The Department of Planning Services has received an application for a recorded exemption for property located at the southwest corner of WCRs 38 and 39, owned by Benjamin and Joanne Knaub. The surveyor creating the RE plat found a surface use easement from 1953, in which the prior owners granted to the County the "right to removal all gravel, sand and road -making and building material which it shall be able to remove" from the northeast 5 acres of the property. The County never extracted any materials from this five acres, and a house was built at this exact location many years ago. In order to clean up the title and the RE plat, I recommend you quit claim this gravel surface easement to the current owners of the property. The Department of Public Works has no objection to this recommendation. If you agree, I will place this on your business agenda for review and approval. A copy of the gravel surface easement and the draft RE plat are attached for your reference.
