RE: APPROVE REQUEST FOR EXTENSION OF TIME FOR RECORDING THE PLAT FOR
USE BY SPECIAL REVIEW PERMIT, USR15-0028 - CHERYL FRIEDE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on June 17, 2015, the Board approved the application of Cheryl Friede, 6943
County Road 56, Johnstown, CO 80534, for a Site Specific Development Plan and Use by Special
Review Permit, USR15-0028, for any Use permitted as a Use by Right, Accessory Use or Use by
Special Review in the Commercial or Industrial Zone Districts (conference center, executive
retreat, wedding venue, wedding or other celebratory receptions, seminars, life celebrations,
reunions, bridal showers, baby showers, bar mitzvahs, music recitals, wakes and community
gatherings; for example: guest farms, hunting lodges, and commercial roping arenas), provided
that the property is not a lot in an approved or recorded subdivision map or part of a map or plan
filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone
District, on the following described real estate, being more particularly described as follows:
Lot B of Recorded Exemption, RE -5090; being part
of the SE1/4 of Section 18, Township 5 North, Range
67 West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board has been presented with a request from Ms. Friede for an
extension of the requirement to record the plat for USR15-0028, to allow for a final determination
on the adjacent property proposed for development by Martin Marietta under USR15-0027, prior
to proceeding with her business plans, and
WHEREAS, the Board heard all of the testimony and statements of those present and
reviewed the request of the applicant and, having been fully informed, finds that this request be
approved.
NOW, THEREFORE, BE RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of Cheryl Friede for a Site Specific Development Plan and Use
by Special Review Permit, USR15-0028, for any Use permitted as a Use by Right, Accessory Use
or Use by Special Review in the Commercial or Industrial Zone Districts (conference center,
executive retreat, wedding venue, wedding or other celebratory receptions, seminars, life
celebrations, reunions, bridal showers, baby showers, bar mitzvahs, music recitals, wakes and
community gatherings; for example: guest farms, hunting lodges, and commercial roping arenas),
provided that the property is not a lot in an approved or recorded subdivision map or part of a map
or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural)
Zone District, on the parcel of land described above be, and hereby is, approved, with said plat
to be recorded on, or before, June 17, 2017.

Subject: Request for Extension, USR15-0028 c/o Chris Friede

The Board of County Commissioners approved USR15-0028 on June 17, 2015 for Chris Friede,
6943 County Road 56, Johnstown, CO 80534 for a Site Specific Development Plan and Use by
Special Use Permit for any use permitted as a use by right, an accessory use, or a use by
special review in the Commercial or Industrial zone districts, provided that the property is not a
lot in an approved or recorded subdivision plat or lots parts of a map or plan filed prior to
adoption of any regulations controlling subdivisions (conference center, executive retreat,
wedding venue, wedding or other celebratory receptions, seminars, life celebrations, reunions,
bridal showers, baby shower, bar mitzvahs, music recitals, wakes, and community gatherings;
guest farms and hunting lodges; and commercial roping arenas) in the A (Agricultural) zone
district.
The following statement is included on all Special Use Permits (USRs) under the heading of
Prior to Construction:
2. "Upon completion of Condition of Approval #1 above, the applicant shall submit one (1)
paper copy or one (1) electronic copy (.pdf) of the map for preliminary approval to the Weld
County Department of Planning Services. Upon approval of the map the applicant shall
submit a Mylar map along with all other documentation required as Conditions of Approval.
The Mylar map shall be recorded in the office of the Weld County Clerk and Recorder by the
Department of Planning Services. The map shall be prepared in accordance with the
requirements of Section 23-2-260.D of the Weld County Code. The Mylar map and
additional requirements shall be submitted within one hundred twenty (120) days from the
date of the Board of County Commissioners Resolution. The applicant shall be responsible
for paying the recording fee."
Ms. Friede in her electronic mail to staff states "My USR was approved in June 2015, prior to
the approval of USR15-0027 for Martin Marietta's massive asphalt, concrete, and aggregate plant
which borders my property. Based on the subsequent approval of the Martin Marietta USR, I am
sending this letter to ask for an extension on my approval requirements for up to 3 years. My plan
was approved to have a wedding venue, however, with this massive industrial facility that will be
bordering my property I am not able to move ahead with the plans for my business to start a
wedding venue until I can assess what the impact will be having the MMM plant border my
property to the west."
The Department of Planning Services is in support of this request given the current uncertainty of
the impacts of the Martin Marietta facility on the approved wedding venue and recommends that the
Board of County Commissioners approve Ms. Friede's request. Ms. Friede is present and is able to
address the Board.

Hi Kim,
I'm sending this letter in reference to USR15-0028. My USR was approved in June 2015, prior
to the approval of USR15-0027 for Martin Marietta's massive asphalt, concrete, and aggregate
plant which borders my property. Based on the subsequent approval of the Martin
Marietta USR, I am sending this letter to ask for an extension on my approval requirements for
up to 3 years. My plan to was approved to have a wedding venue, however, with this massive
industrial facility that will be bordering my property I am not able to move ahead with my the
plans for my business to start a wedding venue until I can assess what the impact will be
having the MMM plant border my property to the west.
My clients book their weddings up to a year in advance and until the MMM developments are
completed I run a risk of client cancellations based on the noise, dust, visual impact and traffic
the plant will generate. I am a small business owner and until I understand the impact of the
MMM plant on my business, I cannot invest any additional money into further development of
my business given the significant impact it will likely have.
As a result, I need to put all my business plans on hold in order to determine the viability of
salvaging any kind of a business given MMM's industrial facility currently under development
adjacent to my property.
