RE: APPROVE APPLICATION FOR INSTALLATION OF 48 LINEAL FEET OF CONCRETE
CROSSING PANELS AT COUNTY ROAD 33 UNION PACIFIC RAILROAD CROSSING
AND AUTHORIZE CHAIR TO SIGN - COLORADO PUBLIC UTILITIES COMMISSION
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with an Application for Installation of 48 Lineal
Feet of Concrete Crossing Panels at County Road 33 Union Pacific Railroad Crossing from the
County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld
County, on behalf of the Department of Public Works, to the Colorado Public Utilities Commission,
commencing August, 2016, and with further terms and conditions being as stated in said
application, and
WHEREAS, after review, the Board deems it advisable to approve said application, a copy
of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Application for Installation of 48 Lineal Feet of Concrete Crossing
Panels at County Road 33 Union Pacific Railroad Crossing from the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Department of Public Works, to the Colorado Public Utilities Commission be and hereby is,
approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said application.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 27th day of June, A.D., 2016.

Crossing Improvements WCR 33
Commissioners,
Attached is an application to the Public Utilities Commission (PUC) for approval to make specified safety
changes to a railroad crossing on Weld County Road 33. Any modification to such crossings must be approved
by the PUC, after application submitted by the County's attorney representative.
The PUC application relates to a Union Pacific Railroad (UPRR) crossing located on WCR 33 just to the east of
Highway 85. The application is for an order for work that includes removal of 32 lineal feet of precast concrete
crossing panels, installation of 48 lineal feet of precast concrete crossing panels, traffic control and patching
into the existing asphalt. The estimated cost of the proposed work by UPRR is $121,839. This repair has been
triggered by the Weld County Industrial Park. We previously approached the BOCC and were instructed to
wait to move forward until we received funding from the Weld County Industrial Park. Mark Goldstein
has since provided us a check for the full amount of the repair. After approval by the PUC, the Board will
be presented with an intergovernmental agreement reflecting the construction agreement.
Public Works Department is coordinating the work. This application was submitted to the PUC for initial
review, to ensure that no major changes are necessary.

The Board of County Commissioners, Weld County, Colorado on behalf of the Weld County Department
of Public Works, (hereinafter referred to as "County"), hereby applies to the Colorado Public Utilities
Commission of the State of Colorado (hereinafter referred to as "PUC"), for an order authorizing the
installation of 48 lineal feet of concrete crossing panels at tracks owned by the Union Pacific Railroad
Company (hereinafter referred to as "UPRR"), and crossing Weld County Road 33. This crossing being
further described as DOT #804351W-1, and UPRR milepost 42.09 of the Greeley Subdivision.
The County presents the following in support of its application:

maintain and operate public roadways in Weld County, Colorado. Offices are located at:

(V) The U. S. Department of Transportation designation of the crossing is #804351W-1. The
crossing location is further described as UPRR Mile Post 42.09 of the Greeley Subdivision. Weld
County does not use mile posts referencing, all references are by other County Roads or State
Highways, and in this case the crossing is located on WCR 33 east of State Highway 85. A
recent adjacent development project necessitated asphalt paving of WCR 33 at the crossing. The
existing concrete crossing panels are 32 feet in width. This width is insufficient and needs to be
increased to 48 feet.
(VI) WCR 33 currently crosses the mainline tracks of the UPRR at a skewed angle. The crossing is
located outside of any city or town, in the unincorporated area of the County. The nearest town is
Gilcrest approximately one mile southwest. A vicinity map showing the immediate surrounding
area is attached to this application as "Exhibit A". Also attached to this application are
photographs documenting the existing conditions at this railroad crossing.
(A) WCR 33 is a two-lane, 28 foot wide asphalt -paved roadway and will remain the same.
Standard railroad crossbucks now protect the crossing. Additionally, WCR 33 intersects
with State Highway US 85 approximately 290 feet west of the railroad crossing. The
ADT at this location was measured at 306 vehicles per day on 6/6/14, with approximately
26% trucks. This current ADT is anticipated to grow at an annual rate of about 5% in the
future.
(B) Current total daily train movements along the UPRR track is estimated at 15 total trains.
This train volume is anticipated to remain relatively constant in the future.
(VII) Statement of Work:
(A) The scope of work includes removal of 32 lineal feet of precast concrete crossing panels,
installation of 48 lineal feet of precast concrete crossing panels, traffic control and
patching into the existing asphalt.
(B) The estimated cost of the proposed work by UPRR is $121,839 — See Exhibit B.
(C) The construction of this project is currently planned for August, 2016.
(D) Funding for the UPRR work shall be provided by Weld County. Weld County has
received a check for these costs from an agreement with an adjacent developer, who
triggered the required modifications.
(E) No profile drawing of the WCR 33 roadway across the UPRR tracks is provided with this
application. The existing track crossing panels will be replaced with new ones in the
same location, but 16 lineal feet wider.
(VIII) Installation of concrete crossing panels, roadway signing, and striping will be in accordance to the
latest editions of the American Railway Engineering and Maintenance -of -way Association's
Recommended Practices and the Manual of Uniform Traffic Control Devices for Streets and
Highway.
(IX) Names and mailing addresses of all persons, adjacent property owners, public utilities,
municipalities, counties, and state that may be interested in or affected by this application
is shown in Exhibit C.
(X) A grade separation at WCR 33 location is not practicable or economically feasible, as this
is a rural crossing with limited train and vehicle traffic, and only limited funds are
available, and the crossing is located too close to State Highway 85.
(XI) The applicant agrees to respond to all questions propounded by the Public Utilities Commission
or its Staff concerning this application. The applicant prefers any hearings be held in the office of
the PUC in Denver, Colorado.
WHEREFORE, the County requests that the Public Utilities Commission of the State of Colorado
authorize the upgrading of the above described crossing.
