The Weld County Department of Planning Services -Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues may
arise during the remaining application process.

The project proposes to Change the current zoning from commercial to industrial 1-3

Geologic Hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This site is in a FEMA regulatory floodplain. A flood hazard development permit is required for any
development in the floodplain. Contact the floodplain planner Diana Aungst at 970-353-6100.
CONDITIONS OF APPROVAL:
A. The plat shall be amended to delineate the following:

Environmental Health Services has reviewed this proposal for a change of zone from
the C-1 (Neighborhood Commercial) Zone District to the 1-3 (Industrial) Zone District.
As specified by the Weld County Assistant Attorney, water and sewer are not required
for the proposed use indicated by the property owner. If these become required due to
development then annexation into the City of Greeley may be required. The City of
Greeley Water and Sewer Department indicated they had an 8 inch main directly
adjacent to the site with no obvious impediments for the parcel to connect.
Once a site plan review is submitted, this Division may require specific items such as;
dust and waste handling procedures and an air emission permit depending on the land
use.
If approval is granted, the Division recommends the following conditions:
The following should appear as notes on the change of zone plat:
1. Water service may be obtained from The City of Greeley which may require
annexation.
2. The parcel is currently not served by a municipal sanitary sewer system or On -
site Waste Water Treatment System. Sewage disposal may be by septic
systems designed in accordance with the regulations of the Colorado
Department of Public Health and Environment, Water Quality Control Division
and the Weld County Code in effect at the time of construction, repair,
replacement, or modification of the system or by a municipal system. If sewer
is to be served by a municipal source the site may require annexation.
3. Language for the preservation and/or protection of the absorption field shall be
placed on the plat. The note shall state; Activity or use on the surface of the
ground over any part of the OWTS must be restricted to that which shall allow

the system to function as designed and which shall not contribute to compaction
of the soil or to structural loading detrimental to the structural integrity or
capability of the component to function as designed.
4. During development of the site, all land disturbances shall be conducted so that
nuisance conditions are not created. If dust emissions create nuisance
conditions, at the request of the Weld County Health Department, a fugitive dust
control plan must be submitted.
5. If land development creates more than a 25 -acre contiguous disturbance, or
exceeds 6 months in duration, the responsible party shall prepare a fugitive dust
control plan, submit an air pollution emissions notice, and apply for a permit from
the Colorado Department of Public Health and Environment.
6. A stormwater discharge permit may be required for a
development/redevelopment /construction site where a contiguous or non-
contiguous land disturbance is greater than or equal to one acre in area.

7. Weld County's "Right to Farm" as provided in Appendix 22-E of the Weld County
Code shall be placed on any recorded plat.

Kim,
I spoke with the City of Greeley Water and Sewer Department about this parcel. They indicate that the
City has an 8 inch main directly adjacent to this site, and there are no obvious impediments for the
parcel to connect to the City's water infrastructure. However, they would have to annex in the future to
do so. Because the use intended by the property owner will not actually require water, I don't see any
reason to require them to connect and annex. It should be sufficient that they can do so in the future
should they change to a use which does require water. To summarize, I'm satisfied that the application
move forward, so long as they understand they will have to actually show water on the property (e.g.
City water tap) if required by development.

Hello Bob,
The application request if for a Change of Zone from C-1 Neighborhood Commercial to 1-3 Industrial
Environmental Health Services has concerns with the lack of a water commitment for the site. With the
property currently zoned C-1 Neighborhood Commercial through actions of the Board of County
Commissioners in 1962, Staff held that the water issue had been addressed. Planning has reached out
to NWCWD and the City of Greeley to determine who provides water service in this general area and
specifically for this property. Representatives for NWCWD indicate that a water tap agreement
application is required to so make this determination. Timing is 4-6 weeks upon receipt of the
application and the payment of a non-refundable 50.00 dollars for processing. The City of Greeley has
not responded to the inquiry.
In the pre -application meeting, staff had previously indicated that bottled water was acceptable for the
facility as the adjacent property, also owned by the applicant, and within the Geisert Industrial PUD
would provide potable water and sanitation.
For the Change of Zone application, the citation from Chapter 23 states:
23-2-30.A.3. - That adequate water and sewer service can be made available to the site to serve the uses
permitted within the proposed zone district.
So my question, does the applicant need to provide a letter of intent to serve or given the application
request to utilize an adjacent property for water and sanitation, is this statement sufficient. Or,
alternatively, would Legal consider allowing the application to move forward stating that if the property
develops further evidence of a potable water supply is required?
There will NOT be habitable space located on the property (Parcel No. 0961-04-2-01-010) is a tank farm
with containment for large upright tanks for storage of commodities and an off-load facility is to be
constructed.

General Comments
E Please provide spillway flows for the detention pond, as this overflow might impact a
property within the City of Greeley limits and staff needs to be reassured that no potential
flooding could occur.
C Lot 6 is served by a 3/4" domestic water tap and a 4" sanitary sewer tap. Lot 2 does not
have a water or sanitary sewer service/tap.
C The new access road location seems to be on top of the water meter pit. If there's not a
traffic rated meter pit, it is requested (strongly recommended) that one is installed. If not,
any damages to the pit and or meter will be the owner's responsibility to correct.
E An A.S.S.E. approved backflow prevention assembly shall be installed on the domestic
water service line immediately after it enters the building. Installation of a backflow
prevention assembly is required by Federal and State Health regulations. The backflow
prevention assembly shall be a reduced pressure zone device (RPZ) and shall be located
near a floor drain. This assembly must be tested by a certified tester upon installation and
thereafter on an annual basis to comply with City Code and State Health Department
regulations. An approved backflow prevention assembly is also required on any
landscape irrigation system and fire line. [Chapter 14.08.195]
o Please add a note on the Utility Plan stating that appropriate backflow prevention
assemblies will need to be installed on the applicable uses including the domestic

water service, fire sprinkler system, and landscape irrigation system and all
backflow test reports will need to be provided to the Water and Sewer Department
upon installation and thereafter on an annual basis.

C The subject properties arc located within the City of Greeley Long Range Expected

requested for the lots, then annexation into the City of Greeley will be required prior to
the City of Greeley providing utility service. The City of Greeley does not currently
provide utility services to the property south of Lot 6, known as Lot 2.

Fire Department
❑ Fire apparatus access needs to be provided to within 150' of all structures on the site; and
complete 360 degree access around flammable liquids tank farm. City of Greeley maps
indicate that there is a fire hydrant on the proposed site; fire apparatus access shall be
provided for this hydrant as well.
