RE: APPROVAL OF RECORDED EXEMPTION NO. 411 - GEORGE KILKER AND
JAMES KILKER.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County Com-
missioners of Weld County, Colorado, at a public hearing held on
the 29th day of August, 1979 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of land, as shown on the plat known as Recorded
Exemption No. 411, being the property of George Kilker and James
Kilker, described as Part of Section 29 , Township 1 North, Range
65 West of the 6th P.M. , Weld County, Colorado, being more parti-
cularly described as follows:

under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desires to exempt this particular division of
land from the definitions of "subdivision" and "subdivided land"
pursuant to its authority under Section 30-28-101 (10) (d) , CRS
1973, as amended, and Section 2-lA(3) of the Weld County Subdi-
vision Regulations .
NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County , Colorado that the hereinabove described
parcels of land owned by George Kilker and James Kilker be, and
hereby are, exempt from the definition of the terms "subdivision"
and "subdivided land" pursuant to its authority under Section
30-28-101 (10) (d) , CRS 1973, as amended, subject to access to Lot B
being restricted to Weld County Road 4 as requested by the
Colorado Department of Highways.
The above and foregoing Resolution was, on motion duly made
and seconded, adopted by the following vote on the 29th day of
August, A.D. , 1979 .

RE: Recorded Exemption #411
Dear Commissioners:
The attached application, plat and related items are in reference to a request
by George Kilker and James Kilker for a recorded exemption. The parcel of land
is described as Pt. Section 29, T1N, R65W of the 6th P.M. , Weld County, Colorado.
This property is located 1 mile northeast of the Town of Lochbuie. The property
contains approximately 104.5 acres of Class II , III and VI irrigated soils in the
Agricultural Zone District. The request is to split the property into parcels of
approximately 90.6+ acres and 14+ acres.
The Kilkers wish to sell the 90.6+ acres as an agricultural unit. The remaining
14 acres and residence will remain in the family.
Based upon the information submitted and the adopted policies in the County, the
Deaprtment of Planning Services Staff recommends the request be approved for the
following reasons:
1 . The proposed split conforms with Section 9-2 of the Weld County Subdivision
Regulations (intent clause of the recorded exemption procedure) , Section 3.3 A.
of the Weld County Zoning Resolution (intent clause of the Agricultural Zone
District), and the Weld County Comprehensive Plan in that the use will be
compatible with surrounding agricultural uses. The request will allow agri-
cultural and related uses to be the predominant land use. There will be no
reduction in the amount of land currently being used for agricultural
production.

2. The request is in compliance with the policies of the Weld County Comprehensive
Plan in that to minimize conflicting land uses, residential development will be
encouraged to locate adjacent to existing towns and in accordance with the
comprehensive plans and stated wishes of each community. The parcel of land is
located 1 mile northeast of the Town of Lochbuie. The Town of Lochbuie has
reviewed this request and has no objections to the approval of this recorded
exemption.
3. The request complies with Section 9-4 A. of the Weld County Subdivision
Regulations.
The Colorado Department of Highways is currently negotiating for 5 acres of the
proposed Lot B (14+ acres) for Interstate 76 right-of-way. The Department of
Highways has requested that access to Lot B be restricted to County Road 4. The
Department of Planning Services Staff recommendation for approval is, therefore,
conditional upon the applicant obtaining access to Lot B from County Road 4.

This request for a recorded exemption is made because the James M.
Kilker and Sons Farming Operation can no longer be farmed by the owners
because of retirement and illness of the owners .
This particular acreage ( 14 acres ) and three bedroom home has been
the home of the petitioner for over 37 years . This will not be sold .
This parcel was chosen because the house is located near the proposed
East property line of "Parcel B" . The parcel is not good agricultural
land because it is steep and seepy and is now used as pasture and garden
area .
The rest of the farm (90 .5 acres) will be sold as a farm . Presently
it is mainly in pasture grass ; none of it is cultivated . About half of
the area could be irrigated . There is adequate water for sugar beets,
corn, alfalfa, etc .
There are no plans for developing this area as a subdivision .
Hopefully, it will be sold for farming as agricultural land . There are
no subdivisions within 3 miles of this farm .
The Colorado Highway Department is also negotiating for approximately
4 acres of the 14 acre parcel for upgrading of Interstate 76 , including
a ramp .
The existing house on the proposed 14 Acre parcel is served by a
private well (well registration # 32925 ) and an individual septic system
( see letter from the Weld County Health Department ) .

Our comments concerning the Kilker Recorded Exemption Case
Number RE-411 are:
1. The existing individual sewage disposal system appears
adequate and functional.
2. The water supply for this residence appears to be
supplied by wells located off the property. Is some
provision made whereby water will be supplied continuously
with no threat of supply interruption? We are concerned
that water may not be supplied, thus creating unsanitary
conditions.

Dear Ms. Traxler:
We have reviewed the James Kilker, et al . , Recorded Exemptions, case numbers
RE-411 and RE-412, and we have the following comments.
1 . (RE-411 ) The Colorado Department of Highways is negotiating for a little
over five acres of the 14-acre Parcel "B" rather than four acres as stated
in the application. We do ask that any potential access to this parcel be
obtained from County Road 4, rather than the proposed private access road
to the Kilker house on Parcel "B". This would avoid the location of an
access on the elevated portion of the private road leading to County Road 4.
2. (RE-412) The Department's negotiations on Parcel "B" include a Temporary
Easement for the construction of a driveway to the existing house. This
easement is described as "Temporary Easement 19-A Revised" on our right-
of-way plans.
