RESOLUTION RE: APPROVE APPLICATION FOR TRANSPORTATION ALTERNATIVES PROGRAM FOR COUNTY ROAD 49 WATER QUALITY POND AND AUTHORIZE CHAIR TO SIGN WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, the Board has been presented with an Application for the Transportation Alternatives Program for County Road 49 Water Quality Pond from the County of Weld, State of Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the Department of Public Works, to the Colorado Department of Transportation, commencing upon full execution of signatures and ending with further terms and conditions being as stated in said application, and WHEREAS, after review, the Board deems it advisable to approve said application, a copy of which is attached hereto and incorporated herein by reference. As you know, this program was previously known as Transportation Enhancement and was modified with MAP -21 to TAP. The FAST Act re -authorized the program. Region 4 anticipates $2,019.1 14 in funding each fiscal year. With the recent completion of the Parkway/WCR 49 Master Drainage Plan it seems like a good opportunity to apply for a TAP grant in the category of mitigation of water pollution due to highway runoff. The TAP grants cover 80% of the project cost with agencies providing the 20% local match. Staff recommends submitting two applications, The first application would be for construction of a 9.79 acre - toot detention pond located in the railroad basin (STOR-0600) which is an existing low spot south of the Latham Ditch on the east side of WCR 49 (near the old WCR 54). The contracted project cost estimate is $1,319,560; however, Public Works plans on acquiring a drainage easement prior to commencing the project, so the total estimate would he $1,265,110. This project could be phased over two years, such as 2019 and 2020. This tinteframc would ensure the WCR 49 project is completed so the use of federal funds wouldn't federalize the widening of WCR 49. The second application would he a smaller project: the recommended near -term culvert installation projects identified in the Master Plan. This project would occur within existing ROW in FY 18 and are all low -impact and will alleviate existing issues. The projects include replacing a culvert (C-25) on WCR 52 just west of WCR 47, another culvert (C-4) at the intersection of WCR 49 and WCR 60.5 one mile east of the Parkway, and installing new driveway culverts on the south side of WCR 60.5 east of WCR 49. C-4 is an existing metal culvert that is almost completely buried, which can cause stormwater to pond and overflow WCR 49. C-25 is an existing metal culvert under WCR 52. Both culverts would he replaced with concrete culverts. New driveway culverts would be installed along the south side of WCR 60.5 east of WCR 49 to prevent localized ponding by facilitating the flow of stormwater towards Lone Tree Creek. The Master Plan estimates the culvert installations to cost approximately $106,000 to contract for the completion. For application #1 the county's local match would be $$253,022 over two years. For application #2 the county's local match would he $21,200. Public Works recommends using the drainage impact fee funds for the county's local match costs. There are three main categories of TAP grants: 1. Bicycle/pedestrian/non-motorized travel improvements 2. Environmental mitigation, which includes addressing "stormwater management, control, and water pollution prevention or abatement related to highway construction or due to highway runoff," which this application would fall under 3. Historic/scenic transportation activities such as overlooks and viewing areas. Detention storage facilities are used to manage stormwater quantity by attenuating peak flows during flood events. In addition, they can enhance stormwater quality by incorporating design components to promote sedimentation, filtration, and biological uptake. This project is located in the Railroad Drainage Basin: which is depicted in the graphic. This project could be the first of many regional detention facilities identified as part of the Master Drainage Plan. The description in the Master Drainage Plan is to: "Expand the existing depression to 9.79 acre-feet. Utilize the existing 1.6' x 2.2' reinforced concrete pipe (rcp) culvert to drain this pond unrestricted. Currently, stormwater runoff from WCR 49 and 54 drain to the subject area, but it does not have enough capacity and the water over -tops the old WCR 54 to the north of the subject area onto private property and into the Latham Ditch, carrying sediment and other pollution into the ditch. Ile agsposen PO= • o I WELD COUNTY TAP GRANT APPLICATION FOR FY18-20 WCR 49 WATER QUALITY POND Attachment D Benefits of proposed project The proposed project will protect people and property by reducing runoff onto private property and minimize transportation system impacts by addressing sediment control. It addresses public health and environmental safety by improving water quality in the Latham Ditch and addressing water pollution related to WCR 49 and WCR 54, which are an arterial and a collector, respectively. Farnsworth Group, the consultant who prepared the Master Drainage Plan, identified this project as having a positive cost -benefit ratio, which is indicative that overall these improvements are beneficial. Some of the soft benefits would include increased public safety, maximization of sustainable economic development, avoidance of unwise use of floodplain and flood prone areas, protection and restoration of the function of natural systems, and mitigation of unavoidable damage to natural systems. This project is located in an existing low depression adjacent to the Latham Ditch. Felsburg Holt & Ullevig (FHU) prepared an environmental report dated January 27, 2016, for the WCR 49 Corridor project that included the subject area for this property. No environment issues were delineated for this area. The full report is available upon request. This cost estimate was adjusted to come up with an estimate for this application. The County will acquire a drainage easement on the property from the property owner in 2017, which is not included in this project. A breakdown of the cost estimate for both years follows: Capital: $816,200 Engineering: $122,430 Administrative: $40,810 Contract Admin.: $81,620 Contingency: $2041050 Total: $1,265,110 The local match (20%) would be $253,022 and would be a cash match from Weld County, The County may use a portion of its drainage impact fees that are collected on new development and/or Public Works' general fund budget. The timing for this project is flexible. Weld County ancticipates completing the expansion of WCR 49 in December of 2017. Therefore, Weld County is flexible on what year this project could be funded. In addition, this project could be phased over two years: FY 2019 and 2020 for example. The first year would include initial grading and construction of the outlet structure to the Latham Ditch. The second year would include excavation to deepen the pond area, construction of the spillway, revegetation, and completion of the project. WELD COUNTY TAP GRANT APPLICATION FOR FY18-20 WCR 49 WATER QUALITY POND Attachment H Resolution of community financial support On July 27, 2016, the Weld County Board of County Commissioners passed a resolution to support applying for the grant and committing to the local match requirement, WELD COUNTY TAP GRANT APPLICATION FOR FY18-20 WCR 49 WATER QUALITY POND Attachment I Right-of-way or legal property description This project comprises approximately six acres located in part of the northwest quarter of Section 30, Township 5 North, Range 64 West of the 6th PM, more particularly, that portion of said Section 30 lying north and west of the right-of-way of Weld County Road 54 (re-route), as conveyed by Pluss Leasing, LLC, in the document recorded in the Weld County Clerk & Recorder's Office June 23, 2011 under reception number 3775811. In order to construct these improvements, Weld County intends to acquire a drainage easement from the current land owner. Weld County's contractor, IHC, has sub -contracted with HC Peck, who is on CDOT's approved ROW acquisition list. HC Peck will acquire the easement on behalf of Weld County and will follow the Uniform Act accordingly.
