comments made during this phase of the application process may not be all-inclusive, as other issues may

Project description: Amend USR-1536 (100 dog kennel - add washing of commercial vehicles, parking,

URBANIZING VS NON -URBANIZING DRAINAGE AREA:
This area IS within a Non -Urbanizing Drainage Area:
Require detention of runoff from the 1 -hour, 100 -year, storm falling on the developed site and release of
the detained water at the historic runoff rate of the 1 -hour, 10 -year storm falling on the undeveloped site for
NON -URBANIZING areas.
A drainage narrative has been submitted and accepted stating that the applicant will be using the exception
1.A.14 "A parcel greater than 5 gross acres in size is allowed a onetime exception for a new 2,000 sq ft
building or equivalent imperviousness. (4500 SQ FT GRAVEL EQUIALENT)" The applicant has stated that
they will not be adding more than 4500 sq ft of gravel.
This site is not in a defined Municipal Separate Storm Sewer System (MS4) area which is a more urbanized
area with state mandated, higher water quality requirements
Grading Permit
A Weld County Grading Permit will be required if disturbing more than 1 acre. Grading Permit applications
are accepted after the planning process is complete (plan recorded). An Early Release Request Form may
be entertained only after the applicant and Planning Department have reviewed the referral and surrounding
property owner comments. The Early Release Request may or may not be granted depending on referral
comments and surrounding property owner concerns. Contact a Engineering representative from the
Planning Department for more information.
A Construction Stormwater Permit is also required with the State for disturbing more than 1 acre. Contact:
Colorado Department of Public Health and Environment, Water Quality Control Division, Rik Gay, 303-692-
3575.
Geologic Hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This area IS NOT in a FEMA regulatory floodplain.
CONDITIONS OF APPROVAL:
A. The plan shall be amended to delineate the following:
1. The applicant shall show and label the accepted drainage features and drainage flow arrows. Water
quality features or stormwater ponds should be labeled as "Water Quality Feature/Stormwater
Detention, No -Build or Storage Area" and shall include the calculated volume. (Department of

2. Show and label the parking and traffic circulation flow arrows showing how the traffic moves around

Environmental Health Services has reviewed this proposal for a Site Specific
Development Plan and Use by Special Review Permit No. USR-1536 for a Kennel (100
dogs of two breeds) to include any use permitted as a use by right, an accessory use, or
a use by special review in the commercial or industrial zone districts, provided that the
property is not a lot in an approved or recorded subdivision plat or lots parts of a map or
plan filed prior to adoption of any regulations controlling subdivisions (washing of
commercial vehicles, parking, staging and dispatching of trucks and commercial vehicles,
trailers and parking and storage of RVs) in the A (Agricultural) Zone District.
There is one home and the kennel facility located on the site. An individual well provides
water (63373-F). Condition of approval 5 on the well permit states:
"The use of ground water from this well is limited to ordinary household purposes inside
one 1 single family dwelling, lawn and garden irrigation and a commercial dog kennel."
As the well permit does not allow any commercial use except for the dog kennel it
cannot be utilized in the other aspects of this request unless additional uses are
approved by the Division of Water Resources for well permit 63373-F.
There is an existing septic system that was assigned statement of existing permit
number SE -0400122 in 2004. No information was provided regarding the size of the
system on the SE -0400122 application. A review was conducted by Environmental
Health on October 19, 2004 which stated:
"There is not enough information available to determine if the existing
individual septic disposal system is of sufficient size and capacity to
adequately handle the proposed load. This evaluation is based on
a fin a I treatment capacity for a 3 bedroom residence. There were no
visible signs of failure at the time of inspection."

If the existing septic system will be utilized for the business an engineer review is
required and if the system is inadequate a repair permit must be submitted and the
system shall be brought up to current requirements.
A portable toilet is acceptable as long as Environmental Health policy is adhered to
which states:
Policy: Portable toilets are allowed in the following circumstances:
1. Temporary or seasonal uses that are utilized 6 months or less per year
(for example recreational facilities, firework stands, farmers markets )
2. Gravel mines
3. 10 or less customers or visitors per day
and/or one of the following:
4. 2 or less full time (40 hour week) employees located on site
5. 4 or less part time (20 hour week) employees located on site
6. employees or contractors that are on site for less than 2 consecutive
hours a day
Note: Records of maintenance and proper disposal for portable toilets shall be retained
on a quarterly basis and available for review by the Weld County Department of Public
Health and Environment. Portable toilets shall be serviced by a cleaner licensed in
Weld County and shall contain hand sanitizers.
A Pet Animal Care Facilities Act (PACFA) license is required for the kennel operation.
A complaint was received by Environmental Health Services in July 2015 for illegal truck
washing on this parcel. The property owner was contacted and he agreed to stop using
detergents and only pressure wash the trucks. The complaint was closed August 2015.
The discharge guidance document provided by the State titled: "Low Risk Discharge
Guidance: Discharges From Surface Cosmetic Power Washing Operations To Land
July 2010" shall be adhered to for the washing of vehicles.
Environmental Health Services recommends that the following requirements be
incorporated into the permit as development standards:
1. All liquid and solid wastes (as defined in the Solid Wastes Disposal
Sites and Facilities Act, 30-20-100.5, C.R.S.) shall be stored and
removed for final disposal in a manner that protects against surface and
groundwater contamination.
2. No permanent disposal of wastes shall be permitted at this site. This is
not meant to include those wastes specifically excluded from the
definition of a solid waste in the Solid Wastes Disposal Sites and
Facilities Act, 30-20-100.5, C.R.S.
3. Waste materials shall be handled, stored, and disposed in a manner
that controls fugitive dust, fugitive particulate emissions, blowing debris,
and other potential nuisance conditions. The applicant shall operate in
accordance with Chapter 14, Article 1 of the Weld County Code.
4. Fugitive dust should attempt to be confined on the property. Uses on
the property should comply with the Colorado Air Quality Commission's
air quality regulations.
5. The facility shall adhere to the maximum permissible noise levels
allowed in the Commercial Zone as delineated in 25-12-103 C.R.S.
6. Adequate drinking, hand washing and toilet facilities shall be provided
for employees and the public, at all times. For 10 or less customers or
visitors per day and 2 or less full time employees on site, portable toilets
and bottled water are acceptable. Records of maintenance and proper
disposal for portable toilets shall be retained on a quarterly basis and
available for review by the Weld County Department of Public Health
and Environment. Portable toilets shall be serviced by a cleaner
licensed in Weld County and shall contain hand sanitizers.
7. Any septic system located on the property must comply with all
provisions of the Weld County Code, pertaining to On -site Wastewater
Treatment Systems.
8. A permanent, adequate water supply shall be provided for drinking and
sanitary purposes. Well permit 63373-F shall be utilized for domestic
and kennel use only, as stated on the permit. The Well cannot be
utilized in other aspects of this request unless additional uses are
approved by the Division of Water Resources.
9. In the event the applicant intends to utilize the existing septic system at
the home (SE -0400122) for business use, the septic system shall be
reviewed by a Colorado Registered Professional Engineer. The review
shall consist of observation of the system and a technical review
describing the system's ability to handle the proposed hydraulic load.
The review shall be submitted to the Environmental Health Services
Division of the Weld County Department of Public Health and
Environment. In the event the system is found to be inadequately
sized or constructed the system shall be brought into compliance with
current Regulations.
10. Animal and feed wastes, bedding, debris and other organic wastes
shall be disposed of so that vermin infestation, odors, disease hazards,
and nuisances are minimized.
11. The applicant shall comply with the Colorado Department of
Agriculture (CDA), Division of Animal Industry regulations.
12. Any vehicle or equipment washing shall adhere to "Low Risk
Discharge Guidance: Discharges From Surface Cosmetic Power
Washing Operations To Land July 2010" as provided by the State.
13. The operation shall comply with all applicable rules and regulations of
State and Federal agencies and the Weld County Code.

Access:
An Access Permit application was submitted with the application materials. Public Works will review the
application and provide an access permit and permit number if approved. Questions concerning access
requirements can be directed to Public Works access permit division.
For shared accesses, Public Works strongly recommends that the property owner establish an access road
maintenance agreement so future owners of the properties will be aware of their requirements for shared
maintenance of the access road. This is not a requirement for the recorded exemption but is recommended
to avoid property owner conflicts in the future.
Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of shoulder to allow a
truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any
vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users.
When feasible, there shall be no net increase in the number of accesses to a public road. Contact Public
Works to discuss your access.
Roads:
County Road 18 is a paved road and is designated on the Weld County Road Classification Plan as a
collector road, which requires 80 feet of right-of-way at full buildout. The applicant shall delineate on the
site plan the future and existing right-of-way. All setbacks shall be measured from the edge of future right-
of-way. This road is maintained by Weld County.
County Road 31 is a paved road and is designated on the Weld County Road Classification Plan as a local
road, which requires 60 feet of right-of-way at full buildout. The applicant shall delineate on the site plan
the future and existing right-of-way. All setbacks shall be measured from the edge of future right-of-way.
This road is maintained by Weld County.
Traffic:
Latest ADT on CR 18 was taken on 10/9/2013 which counted 1376 vpd with 44% trucks.
A traffic information submitted with the application materials and indicated that there will be approximately
15 daily roundtrips.
TRACKING CONTROL:
Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are
listed below. Temporary Tracking Control shall be used during construction unless permanent tracking
control is installed ahead of construction activities.
More than 10 round truck trips/day (tandem or semi -trucks) or more than 50 round passenger vehicles trips:
• Access onto gravel roads requires a tracking control device and a minimum of 300ft of recycled
asphalt or road base.
• Access onto paved roads requires either a tracking control devise and 100ft of asphalt OR 300ft of
asphalt.
*Recycled concrete is not allowed in County ROW
**Tracking control devices can be double cattle guards or other specialized device
***Tracking control for unmaintained public ROW is required just prior to entering publically maintained
roadways.
A development standard will be included on the recorded site plan. "The access shall be maintained to
mitigate any impacts to the public road including damages and/or offsite tracking."
A variance request for alternatives to the above tracking control can be submitted to the Traffic Division of
Public Works for review and consideration.
Improvements and Road Maintenance Agreement:
No improvements agreement will be required as the anticipated traffic is less than 21 round truck trips/day
or 50 round passenger vehicle trips/day or if defined as a Site Plan Review (SPR). A development standard
will be applied to the recorded map indicating any impacts to the road must be mitigated by the owner. The
access on the site shall be maintained to mitigate any impacts to the public road including damages and/or
offsite tracking.

Because the property is located within the City's Comprehensive Plan area, the Planning Department met with
the applicants to discuss the potential for annexation. The applicants indicated their desire to continue their
application with the Weld County Planning Department. The applicants have met their obligation to confer
with the City.

Dear Mr. Ogle:
This referral does not appear to qualify as a "subdivision" as defined in Section 30-28-
101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005 and March 11,
2011 memorandums to county planning directors, this office will only perform a cursory
review of the referral information and provide informal comments. The comments do not
address the adequacy of the water supply plan for this project or the ability of the water
supply plan to satisfy any County regulations or requirements. In addition, the comments
provided herein cannot be used to guarantee a viable water supply plan or infrastructure, the
issuance of a well permit, or physical availability of water.
The application is for an amendment to an existing Site Specific Development Plan and Use by
Special Review Permit No. USR-1536 to include washing for trucks and storage for trailers,
vehicle and RVs, located in the SW'/4 of the SW 'A of Section 22, Township 2N, Range 66W, of
the Sixth PM, also known as Lot A of the amended recorded exemption RE -1871. The current
use on the property under USR-1536 is for a dog kennel. According to the information in the
referral material water for the domestic and commercial use on the property will be provided
by an existing well operating under permit no. 63373-F.
Permit no. 63373-F was issued on September 29, 2005 for the change/expansion of use of an
existing well constructed under permit no. 82978 (canceled) and re -permitted for expanded
uses under permit no. 227271 and claims the water in the Laramie -Fox Hills aquifer
underlying the 5 acres Lot A of RE -1871 parcel. The well is permitted for ordinary household
purposes inside one single family dwellings, lawn and garden irrigation, and a commercial dog
kennel with an annual withdrawal not to exceed 1.16 acre-feet. This office has no objections
to the continued use of well permit no. 63373-F to supply the existing kennel, as long as the
well is being used within the conditions of approval of well permit no. 63373-F. However, the
proposed truck washing operation cannot be provided with water from well permit no. 63373-
F, since this is not a permitted use on the well permit. According to the application materials,
additional water for the truck washing purposes was purchased from the City of Fort Lupton
(City). Our office has no comments regarding the purchased water from the City.
