HomeMy WebLinkAbout780763.tiff RESOLUTION RE: APPROVAL OF AMENDMENT TO RECORDED EXEMPTION NO. 340 - MR. AND MRS. GEORGE ROSENOFF. WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to Colorado statute and the Weld County Home Rule Charter, is vested with the authority of administering the affairs of Weld County, Colorado, and WHEREAS, it has been determined by the Board of County Com- missioners of Weld County, Colorado, at a public meeting held on the 2nd day of October, 1978 in the Chambers of the Board of County Commissioners of Weld County, Colorado, that a certain parcel of land, being the property of Mr. and Mrs. George Rosenoff, does not come within the purview of the definition of the terms, "subdivision" and "subdivided land, " pursuant to its authority under Section 30-28-101 (10) (d) , CRS 1973, as amended, and WHEREAS, said Board of County Commissioners did approve Recorded Exemption No. 340, by Resolution, on October 2 , 1978 , and WHEREAS, the Board of County Commissioners of Weld County, Colorado has been informed by the Weld County Department of Plan- ning Services that the aforementioned Recorded Exemption now needs to be amended by correcting two bearings on the recorded exemption plat. The amended legal description is as follows : The Southwest Quarter of the Northeast Quarter of Section 29. Excepting therefrom that portion con- veyed to the Great Western Sugar Coany by Warranty Deed recorded in Book 388, page 13, Weld County Records. That part of the West Half of the Southeast Quarter of section 29, described as follows: Beginning at a point 69 feet West of the northwest corner of the East Half of the Southeast Quarter of said Section 29, thence running West 1,211.51 feet; thence South 2,637 feet; thence East 1,230 feet; thence North 2,637 feet on a line parallel to the County road to the place of beginning. All that part of the Southeast Quarter Northwest Quarter and of the Southwest Quarter of the North- west Quarter and of the Southwest Quarter of Sec- tion 29 described as follows: Beginning at a point whence the Southeast corner of the Southwest Quarter of said Section 29 bears South 0°05' East 717.5 feet, said point being on the North and South center line of said Section; thence North 45°30' West 307.5 feet; North 55°12' West 144 feet; North 45°03' West 148.5 feet; ' 780763 North 37°40' West 273 feet; North 16°56' West 262 feet; North 59°46' West 179 feet; North 20°17' West 128.5 feet; South 85°46' West 557 feet; North 39°53' West 303.5 feet; North 87°20' West 482 feet; North 23°41' West 262.5 feet; North 41°30' East 158 feet; North 88°33' East 222.5 feet; North 13°35' East 125 feet; North 36°53' West 86 feet; North 13°24' Fast 332.5 feet; North 61°19' West 69.3 feet; North 33°30' East 69 feet; North 74°00' East 254 feet; North 15°00' East 845 feet; North 89°15' Fast 109 feet to the Northeast corner of the Southwest Quarter of the Northwest Quarter of said Section 29; thence easterly along the North line of the Southeast Quarter Northwest Quarter to the Northeast corner of said Southeast Quarter Northwest Quarter; thence South 0°05' East along the North and South centerline of said Section to the point of beginning. Excepting from the Soutwest Quarter of the North- west Quarter of said Section 29, parcel conveyed to Union Pacific Railroad Company by deed recorded in Book 300, page 152 and except reservation as contained in Book 406, page 321, Weld County records. WHEREAS, the Board of County Commissioners of Weld County, Colorado deems it advisable and in the best interests of Weld County to approve said amendment. NOW, THEREFORE, BE IT RESOLVED by the Board of County Com- missioners of Weld County, Colorado that the hereinabove amend- ment to Recorded Exemption No. 340 for Mr. and Mrs. George Rosenoff be, and hereby is, approved. COLORADO December 18, 1978 Board of County Commissioners Weld County, Colorado 915 10th Street Greeley, CO 80631 RE : Amendment to Recorded Exemption #340 Dear Commissioners: The attached materials are in reference to a request from Mr. and Mrs. George Rosenoff for an amendment to Recorded Exemption #340. The pro- perty is described as Pt . Wz and WIEI Section 29, T6N, R67W of the 6th P. M. , Weld County, Colorado. This property is located approxi- mately 1 mile southwest of the Town of Windsor. The request is to amend Recorded Exemption #340 by correcting two bearings as shown outlined in yellow on the attached amended recorded exemption plat . On the original recorded exemption plat the angle of degree of the bearings were incorrectly drawn on the survey plat . The request , if approved, would show the correct angle of degree and bear- ings on the plat .
