SUBJECT: USR16-0004, Wilson
The Weld County Department of Planning Services-Engineering has reviewed this proposal. Staff
comments made during this phase of the application process may not be all-inclusive, as other issues may
arise during the remaining application process.
COMMENTS:
General Project Information/Location:
Second home in Ag Zone
This project is west of and adjacent to CR 18 (Godding Hollow Parkway) Parcel number 131325000023.
Access is from Godding Hollow
Access:
This project accesses onto the Municipality of Firestone. The Town's referral has no objections to the site.
Roads:
Godding Hollow owned and maintained by the Town/City (Municipality) of Firestone. The Municipality has
jurisdiction over all accesses within their jurisdiction.
Traffic:
No traffic counts are available in the area.
TRACKING CONTROL:
Tracking control is required to prevent tracking from the site onto public roadways. Minimal standards are
listed below. Temporary Tracking Control shall be used during construction unless permanent tracking
control is installed ahead of construction activities.
Less than 20 passenger vehicle round trips/day, no upfront tracking control requirements.
A development standard will be included on the recorded site plan. "The access shall be maintained to
mitigate any impacts to the public road including damages and/or offsite tracking."
Improvements and Road Maintenance Agreement:
No improvements agreement will be required.
Drainage Requirements:
Please contact Department of Planning Services/Engineering Development Review for questions or
assistance for drainage requirements at 970-353-6100.
Detention pond waived and a simple drainage narrative:
A drainage narrative is required and full drainage report and detention pond waived if the site qualifies for
an exception to detention requirements listed below. (See highlighted exception)
The drainage narrative must include at the minimum:
1. Description which exception is being applied for and include supporting documentation.
2. Where the water originates if it flows onto the property from an offsite source
3. Where it flows to as it leaves the property
4. The direction of flow across the property
5. If there have been previous drainage problems with the property
Exceptions.
1. Exceptions to stormwater detention shall not jeopardize the public health, safety, and
welfare of public and private property and shall be limited to the following:
a. No stormwater detention will be required for sites that meet any of the following
conditions. Requirements of the Municipal Separate Storm Sewer System (MS4)
areas remain applicable.
1) Use by Right or Accessory Use in the A(Agricultural) Zone District.
2) Zoning Permits in the A (Agricultural)Zone District.
3) A second dwelling permit in the A (Agricultural)Zone District.
4) Towers including, but not limited to, cell,wind, and telecommunication towers.
5) Pipelines or transmission lines.
6) Gravel pits if the stormwater drains into the gravel pit.
7) Residential developments where all the following conditions exist:
a) Nine (9) lots or fewer.
b) The average lot size is equal to, or greater than, three (3) acres per lot.
c) Downstream roadway criteria are not exceeded.
d) The total post-development imperviousness for the rural residential
development does not exceed ten percent (10%), assuming that all
internal roads and driveways are paved, or will eventually be paved.
8) Development of sites where the change of use does not increase the
imperviousness of the site.
9) URBANIZING areas where the total project stormwater runoff of less than, or
equal to, 5 cubic feet per second (cfs)for the 1-hour, 100-year, storm event.
10) NON-URBANIZING areas where the total project stormwater runoff of less
than, or equal to, 10 cfs for the 1-hour, 100-year, storm event.
11) Parcels with total area less than, or equal to, a 1.0 gross acre.
12) Individual parcel with an unobstructed flow path and no other parcel(s)
between the Federal Emergency Management Administration (FEMA)
regulatory floodplain channel and the project.
13) A parcel greater than 1 gross acre and less than, or equal to, 5 gross acres in
size is allowed a onetime exception for a new 1,000 sq ft building or equivalent
imperviousness.
14) A parcel greater than 5 gross acres in size is allowed a onetime exception for
a new 2,000 sq ft building or equivalent imperviousness.
15) Approved by a variance.
This site is not in a defined Municipal Separate Storm Sewer System (MS4)area which is a more urbanized
area with state mandated, higher water quality requirements
Geologic Hazard Area:
This area IS NOT in a Geologic Hazard Area.
Floodplain:
This area IS NOT in a FEMA regulatory floodplain.
CONDITIONS OF APPROVAL:
A. The plan shall be amended to delineate the following:
1. The applicant shall show the existing drainage flow arrows. (Department of Planning Services-
Engineer)
DEVELOPMENT STANDARDS (NOTES ON THE SITE PLAN)
1. Should noxious weeds exist on the property or become established as a result of the proposed
development, the applicant/landowner shall be responsible for controlling the noxious weeds, pursuant
to Chapter 15, Articles I and II, of the Weld County Code. (Department of Planning Services-Engineer)
2. The access on the site shall be maintained to mitigate any impacts to the public road including
damages and/or offsite tracking. (Planning and Engineering)
3. There shall be no parking or staging of vehicles on public roads. On-site parking shall be utilized.

4. The historical flow patterns and runoff amounts on the site will be maintained. (Department of Planning
Services-Engineer)

Environmental Health Services has reviewed this proposal for a Site Specific Development Plan and
Use by Special Review Permit for one (1) Single-Family Dwelling Unit per Lot other than those
permitted under Section 23-3-20.A (second dwelling on the property) in the A (Agricultural) Zone
District.
Water for both residences will be provided by Central Weld County Water District.
Sewer for the existing home may be provided by an existing unpermitted septic system.
A statement of existing and a review of the septic system is required. In the event the system is found
to be inadequately sized or constructed, the system shall be brought into compliance with current
regulations which may require connection to Saint Vrain Sanitation. Section 30-4-30.K states:
"No OWTS permit shall be issued to any person when the subject property is located within a
municipality or special district that provides public sewer service, except where such sewer service to
the property is not feasible in the determination of the municipality or special district, or the permit is
otherwise authorized by the municipality or special district."
The proposed second home will served by Saint Vrain Sanitation District.
We have no objections to the proposal; however, we do recommend that the following conditions be
part of any approval:
Prior to recording the plat:
A. The Environmental Health Services Division was unable to locate a septic permit for the
septic system serving the existing structure. A Statement of Existing and a review of the
system shall be completed. The review shall be submitted to the Environmental Health
Services Division of the Weld County Department of Public Health and Environment. In the
event the system is found to be inadequately sized or constructed the system shall be brought
into compliance with current Regulations which may require connection to Saint Vrain
Sanitation.
We recommend that the following requirements be incorporated into the permit as development
standards:
1. Waste materials shall be handled, stored, and disposed in a manner that controls fugitive dust,
fugitive particulate emissions, blowing debris, and other potential nuisance conditions. The
facility shall operate in accordance with Chapter 14, Article 1 of the Weld County Code.
2. Fugitive dust should attempt to be confined on the property. Uses on the property should
comply with the Colorado Air Quality Commission's air quality regulations.
3. A permanent, adequate water supply shall be provided for drinking and sanitary purposes.
4. Any septic system located on the property must comply with all provisions of the Weld County
Code, pertaining to Onsite Waste Water Treatment Systems.
5. The operation shall comply with all applicable rules and regulations of State and Federal
agencies and the Weld County Code.
