PETITION FOR ANNEXATION TO THE TOWN OF SEVERANCE, COLORADO The undersigned, in accordance with Title 31, Article 12, Chapters 101 et. Seq., Colorado Revised Statutes, hereby petition the Mayor and Trustees of the Town of Severance, Colorado, for annexation to the Town of Severance the unincorporated territory described herein and described and shown on the map designated as "Tailholt East Annexation". Copies of said map are submitted herewith and by this reference are incorporated herein. The description of the territory hereby petitioned for annexation into the Town is set forth in Exhibit "A" attached hereto and incorporated herein by reference. It is being reviewed and evaluated by the Town Staff, and is scheduled for review by the Town of Severance Planning Commission on July 20, 2016 at 6:00 PM and Board of Trustees on August 1.2016 at 6:00 PM. Project Description The properties proposed for annexation consists of 173.477± acres situated on the Northwest corner of Weld County Road 72 and Weld County Road 25. The annexation meets the I /6th or 16.67% contiguity requirements set by State Statutes. Requested zoning for the property described herein is sub -urban perimeter. The land is currently zoned agricultural in Weld County. The annexation and zoning map is attached along with the Vicinity Map. The attached report. maps and tax district information address the impact report requirements as listed in C.R.S. 31-12-108.5 (1)(a) through (t). Attachments: 1. Tailholt East Impact Report 2. Timber Ridge Parkway, Severance, Co 970.686.1218 Tailholt East Annexation Development Impact Assessment Statements General Project Description The Tailholt East project is located on the northwest side of the intersections of CR 72 and CR 25. It is comprised of approximately 173.477 acres and is presently situation in unincorporated Weld County. It is adjacent to the south boundary of the Baldridge subdivision, the east boundary of the overall Tailholt Master Plan properties and across CR 72 from the Elk Ranch property, all of which are annexed into the Town of Severance. The proposed land use is planned for Suburban Perimeter style residential housing and will become part of the overall Tailholt Master Plan. The northwest corner of the property overlooks Franklin reservoir and is adjacent to the Baldridge subdivision. Care will be taken to plan larger lots in this area with increased architectural requirements to assure compatibility with the surrounding homes. Water Potable water will be provided by the Town of Severance. The potable water system layout will be based on the subdivision layout and existing system connection points. Based on a review of the existing utility system, it is assumed there will be points of connection from the west through Tailholt and from the north through Baldridge. Other connections from the east and south may become available, if needed. Generally, the subdivision's potable water system will be looped internally as needed to provide redundancy and fire flow. Future development proposals will submit more specific plans and specifications according to Town of Severance codes. It is proposed that the components of the potable water system will be public utilities, which will be turned over to the Town for ultimate ownership and maintenance. Non -potable Water The Tailholt Metropolitan District will provide non -potable water to developments. Plans and specification for each phase, or filing, of development will be submitted and reviewed for approval by the Metro District and the Town. It is anticipated that all greenbelts, open spaces and individual lots will be irrigated with non -potable water. Sanitary Sewer The sanitary sewer system layout will be based on the subdivision layout and topography. The internal system will drain the effluent via a gravity system to the west boundary where it will continue west and tie into the existing sewer main line approximately'/ mile west of the property. Utility plans showing the internal layout and the assumed connection points will be provide for review. When development occurs adjacent to Baldridge, a sewer line will be connected to the exiting sanitary sewer and the existing lift station will be removed. Standard practices for sanitary sewer design will be used to design the system. It is proposed that the components of the sanitary sewer system will be public utilities, which will be turned over to the Town for ultimate ownership and maintenance. Page 1 Natural Gas Tailholt East will work with the natural gas service provider during entitlement and development to address the impacts on the Natural Gas system. As future developments are proposed, the applicant will work in coordination with the utility providers in the area to extend service lines and capacity to meet the natural gas demands of the project. Electric Tailholt East will work with the electric service provider during entitlement and development to address the impacts on the Electrical system. The project will work in coordination with the utility providers in the area to extend service lines and capacity to meet the Electrical demands of the project. Telephone Telephone service will be provided by local available communications. The projected use is anticipated to be a typical usage similar to other residential projects of this size. The project will work with communications providers as we proceed through the approval and development process to ensure that the most recent technologies are available to the future residential land uses in Tailholt East. Streets The Tailholt East community is bordered on the south by Weld County Road 72 and on the east by CR 25. CR 72 is included in this annexation while CR 25 is not. It will remain in unincorporated Weld County. Development of the lands west of the property is anticipated to precede the development of Tailholt East and additional connections from these developments are anticipated. Baldridge Drive presently terminates at the north boundary of the property and is constructed as a cul-de-sac. If required, development of the Tailholt East property can tie into this roadway or create a pedestrian connection at this location. It is proposed that the street improvements within the public rights -of way will be public improvements, which will ultimately be turned over to the Town for ownership and maintenance. Drainage Storm water from this property drains into Franklin Reservoir that is owned, managed and maintained by the Tailholt Metropolitan District. As developments are proposed, specific storm water and drainage plans shall be submitted to the Metro District for review. The storm water design will be based on the subdivision layout and existing topography and will adhere to the plans and policies of the Metro District. Tailholt East Metropolitan District Immediately following the annexation of the property it will be included within the Tailholt Metropolitan District. The Metro District, either directly or through the site developer, will construct the public infrastructure necessary to serve the proposed residential land use. The public infrastructure will ultimately be conveyed to the Town of Severance for ownership and ongoing maintenance obligations. The Metro District will, however, be the owner of the site common areas, trails, non potable irrigation system and storm water retention areas and will provide ongoing maintenance services for those project elements. The Metro District will also provide the administration and control services for the community, such as establishing and Page 2 enforcing the architectural standards and lot landscaping requirements. The details of the Metro District organization, obligations, and financial structure will be established in an amendment to the existing Service Plan, conforming to all legal standards. Law Enforcement Law enforcement for the Tailholt East project will be provided by the Town of Severance or Weld County Sheriff through the existing agreement. It is not anticipated that there will be special security needs or a specific need for additional officers. Fire Protection Windsor -Severance First Rescue will provide fire protection for the Tailholt East project. It is not anticipated that the Tailholt East project would pose special fire hazards. Fire prevention requirements, fire detection, fire lanes, emergency access, etc. would be provided as required by code. Schools The Tailholt East project is within the Weld County RE -4 School District and Aims Junior College District. The project will work with the Districts to identify and address any impacts of this project. Parks and Recreation All park, trail and common areas will be dedicated to the project -established Metropolitan District for ultimate ownership and maintenance responsibilities. Library The Tailholt East project is within the Clearview Library District. The project will work with the District to identify and address any impacts of this project. Environmental Considerations The Tailholt East has been historically farmed. A formal Phase 1 Environmental Site Assessment has been completed, as well as an initial ecological investigation. No environmental hazards, wetlands or sensitive areas, endangered species, or significant habitats have been identified on the site. There are active oil and gas production activities ongoing within the project boundary. Future development designs will consider these elements and will allow for operational, pipeline, and access requirements and will deliver a neighborhood that provides for co -existence of the residential land use with the right of subsurface mineral production. Economic Development Potential The Tailholt East project will likely include diverse residential land uses including patio homes, family homes, and estate homes characterized by unique neighborhoods within the development. Tailholt East aims to provide a variety of affordable residential styles and choices at a low density, offering abundant open space and impressive western views.
