RE: APPROVAL OF RECORDED EXEMPTION, RECX16-0020 - LOVELAND READY MIX
CONCRETE, INC. C/O DON FRIESS
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the request for Recorded Exemption, RECX16-0020, was submitted by
Loveland Ready Mix Concrete, Inc., P.O. Box 299, Loveland, CO 80539, do Don Friess, 7863 S.
Kittredge Circle, Englewood, CO 80112, for property which is located on the following described
real estate, to -wit:
Lot A of Recorded Exemption, RE -134; being part of
the NW1/4 of Section 30, Township 5 North,
Range 67 West of the 6th P.M., Weld County,
Colorado
being more particularly described in the plat which shall be provided by the applicant and known
as Exhibit "A," said plat to be recorded, and
WHEREAS, the Board of County Commissioners, pursuant to its authority under
Section 30-28-101(10)(d), C.R.S., did determine at a public meeting held in the Chambers of the
Board, that a certain parcel of land, to be divided into two parcels, as shown on the plat known as
Recorded Exemption, RECX16-0020, does not come within the purview of the definition of the
terms "subdivision" and "subdivided land," and
WHEREAS, this request is to divide the property into parcels estimated to be
approximately 153.26 acres and .21 acres.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the hereinabove described parcel of land be, and hereby is, exempt from
the definition of the terms "subdivision" and "subdivided land."
BE IT FURTHER RESOLVED by the Board that the application of Loveland Ready Mix
Concrete, Inc., do Don Friess, for Recorded Exemption, RECX16-0020, be, and hereby is,
approved subject to the following conditions:
1. A Weld County septic permit is required for any proposed home. The septic system shall
be installed according to the Weld County Onsite Wastewater Treatment System
regulations.
2. Prior to recording the plat:
The applicant shall provide the Weld County Department of Planning Services with
a Statement of Taxes from the Weld County Treasurer showing no delinquent
taxes exist for the original parcel.

B Items to be included on the plat:
1) The plat shall be titled: Recorded Exemption No. 0957-30-2 RECX16-0020.
2) County Road 13 is a paved road and is designated on the Weld County
Road Classification Plan as an arterial road, which requires 140 feet of
right-of-way at full buildout. The applicant shall verify and delineate on the
plat the future and existing right-of-way and the documents creating the
existing right-of-way. If the existing right-of-way cannot be verified it shall
be dedicated. All setbacks shall be measured from the edge of future
right-of-way. This road is maintained by Weld County.

County Road 54 is a paved road and is designated on the Weld County
Road Classification Plan as an arterial road, which requires 140 feet of
right-of-way at full buildout. The applicant shall verify and delineate on the
plat the future and existing right-of-way and the documents creating the
existing right-of-way. If the existing right of way cannot be verified it shall
be dedicated. All setbacks shall be measured from the edge of future
right-of-way. This road is maintained by Weld County.
4) Show and label the approved access point(s) and access permit number(s)
on the plat (API6-00196).
5) Show the floodplain and floodway boundaries on the plat. Label the
floodplain boundaries with the FEMA Flood Zone and FEMA Map Panel
Number.
6) Setback radiuses for existing oil and gas tank batteries and wellheads shall
be indicated on the plat per the setback requirements of Section 23-3-50.E
of the Weld County Code.
7) All recorded easements and rights -of -way shall be delineated on the plat
by book and page number or reception number.
8) The following notes shall be placed on the plat:
a) All proposed or existing structures will meet the minimum setback
and offset requirements for the zone district in which the property is
located. Pursuant to the definition of setback in the Weld County
Code, the required setback is measured from the future right-of-way
line. No building or structure, as defined and limited to those
occupancies listed as Groups A, B, E, F, H, I, M and R in Section
302.1 of the 2012 International Building Code, shall be constructed
within a 200 -foot radius of any tank battery or within a 150 -foot
radius of any wellhead or within a 25 -foot radius of any plugged or
abandoned oil and gas well. Any construction within a 200 -foot
radius of any tank battery or 150 -foot radius of any wellhead shall

require a variance from the terms of this Chapter in accordance with
Subsection 23-6-10.C of this Code.
b) Any future structures or uses on the site must obtain the appropriate
zoning and building permits.
c) Lot A is not eligible for a future land exemption in accordance with
Section 24-8-20.C.1 of the Weld County Code.
d) A Flood Hazard Development Permit is required for all construction
or development occurring in the floodplain or floodway as
delineated on Federal Emergency Management Agency (FEMA)
FIRM Community Panel Map #08123C -1490E and 1495E, effective
date January 20, 2016 (Big Thompson River Floodplain). Any
development shall comply with all applicable Weld County
requirements, Colorado Water Conservation Board requirements
as described in Rules and Regulations for Regulatory Floodplains
in Colorado, and FEMA regulations and requirements as described
in 44 CFR parts 59, 60, and 65. The FEMA definition of
development is any man-made change to improved or unimproved
real estate, including, but not limited to, buildings or other
structures, mining, dredging, filling, grading, paving, excavation,
drilling operations, or storage of equipment and materials.

The installation of any septic system within the 100 -year floodplain
shall comply with the Weld County O.W.T.S. floodplain policy. In
accordance with the State of Colorado O.W.T.S. Regulations, no
septic system shall be installed within the floodway.
f) Prior to the release of building permits, the applicant shall submit a
recorded deed describing the Lot upon which the building permit is
requested with the building permit applications. The legal
description on such deed shall include the Lot designation and
Recorded Exemption number.
g) The property owner shall control noxious weeds on the site.
h) The historical flow patterns and runoff amounts will be maintained
on the site.
i) Building permits shall be obtained prior to the construction of any
building. Buildings that meet the definition of an Agricultural Exempt
Building per the requirements of Section 29-1-20 and Section 29-3-
20.B.13 of the Weld County Code do not need building permits,
however, a Certificate of Compliance must be filed with the
Department of Planning Services and an electrical and/or plumbing
permit is required for any electrical service to the building or water
for watering or washing of livestock or poultry.

j) Any disturbance of wetlands shall require the applicant to contact
the Army Corps of Engineers for permits pursuant to Section 404 of
the Clean Water Act.
k) Building Permits issued on the proposed lots will be required to
adhere to the fee structure of the County -Wide Road Impact Fee
Program.

m) RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT:
Weld County has some of the most abundant mineral resources,
including, but not limited to, sand and gravel, oil, natural gas, and
coal. Under title 34 of the Colorado Revised Statutes, minerals are
vital resources because (a) the state's commercial mineral deposits
are essential to the state's economy; (b) the populous counties of
the state face a critical shortage of such deposits; and (c) such
deposits should be extracted according to a rational plan, calculated
to avoid waste of such deposits and cause the least practicable
disruption of the ecology and quality of life of the citizens of the
populous counties of the state. Mineral resource locations are
widespread throughout the County and person moving into these
areas must recognize the various impacts associated with this
development. Often times, mineral resource sites are fixed to their
geographical and geophysical locations. Moreover, these
resources are protected property rights and mineral owners should
be afforded the opportunity to extract the mineral resource.

The Weld County Right to Farm Statement, as it appears in Section
22-2-20.J.2 of the Weld County Code, shall be placed on the map
and recognized at all times.
3. This Recorded Exemption was approved to bring an illegal parcel into compliance with the
State of Colorado and Weld County's minimum lot size requirements.
4 The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the
Weld County Code. The applicant shall submit one (1) electronic copy or one (1) paper
copy of the plat for preliminary approval to the Department of Planning Services. Upon
approval of the plat, the applicant shall submit a Mylar plat along with all other
documentation required as conditions of approval. The Mylar plat shall be recorded in the
office of the County Clerk and Recorder by the Department of Planning Services. The
Mylar plat and additional requirements shall be recorded within sixty (60) days from the
date of the Board of County Commissioners Resolution. The applicant shall be responsible
for paying the recording fee.

5. In accordance with Weld County Code Ordinance #2012-3, approved April 30, 2012,
should the plat not be recorded within the required one hundred twenty (120) days from
the date of the Board of County Commissioners Resolution, a $50.00 recording
continuance charge shall added for each additional three (3) month period.
6. The Department of Planning Services respectfully requests the surveyor provide a digital
copy of this Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn
(Microstation); acceptable GIS formats are ArcView shapefiles, Arclnfo Coverages and
Arclnfo Export files format type is .e00. The preferred format for Images is .tif (Group 4).
(Group 6 is not acceptable). This digital file may be sent to maps@co.weld.co.us.
The above and foregoing Resolution was, on motion duly made and seconded, adopted

The applicants are proposing a two -lot recorded exemption on this parcel. Lot
A is proposed to be 0.21 acres in size and Lot B is proposed to be 153.26
acres in size. An unmanned pump facility owned by Public Service is located
on Lot A. Amended Use by Special Review Permit AMUSR-1329 (Open Pit
Mining and Materials Processing, a Concrete Batch Plant, and the Importation
of Sand and Gravel Aggregates).
This proposed recorded exemption is to address an illegal land split in which
Lot A of Recorded Exemption was divided without utilizing the recorded
exemption process. The original parcel was created through a recorded
exemption (RE -134). RE -134 was recorded on May 8, 1974. On September
26, 1979, 0.21 acres (part of Lot A of RE -134) was sold from Dan and
Elizabeth Klein to Western Slope Gas Company by deed. Western Slope Gas
Company (Western Slope Gas Supply) merged with Public Service Company
of Colorado on January 1, 1993. Per the recorded exemption regulations, Lot
A of RECX16-0020 will not be eligible for a future recorded exemption.
The Department of Planning Services' staff has reviewed this request and could not approve this request
since the Department of Planning Services does not have the authority to grant an exception to Section
24-8-40.L of the Weld County Code. Section 24-8-40.L states:
The minimum size of any lot proposed with a public water supply is not less than one (1) acre net.
The minimum size of any lot proposed with a well as the water supply is not less than two and one-
half (2X) acres net. Minimum lot sizes do not apply in zone districts which allow smaller lots or

where exempted by the Board of County Commissioners.
Should the Board of County Commissioners approve this request, the Department recommends
the following conditions be attached:
The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is
approved with the following conditions in accordance with information submitted in the application and the
policies of Weld County.

14) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, typically ranking in the top ten counties in the
country in total market value of agricultural products sold. The rural areas of Weld
County may be open and spacious, but they are intensively used for agriculture.
Persons moving into a rural area must recognize and accept there are drawbacks,
including conflicts with long-standing agricultural practices and a lower level of services
than in town. Along with the drawbacks come the incentives which attract urban
dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise
and congestion, and the rural atmosphere and way of life. Without neighboring farms,
those features which attract urban dwellers to rural Weld County would quickly be gone
forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well -run agricultural activities will generate off -site impacts, including noise from
tractors and equipment; slow -moving farm vehicles on rural roads; dust from animal
pens, field work, harvest and gravel roads; odor from animal confinement, silage and
manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping
activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides
and fertilizers in the fields, including the use of aerial spraying. It is common practice
for agricultural producers to utilize an accumulation of agricultural machinery and
supplies to assist in their agricultural operations. A concentration of miscellaneous
agricultural materials often produces a visual disparity between rural and urban areas
of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation shall
not be found to be a public or private nuisance if the agricultural operation alleged to
be a nuisance employs methods or practices that are commonly or reasonably
associated with agricultural production.
Water has been, and continues to be, the lifeline for the agricultural community. It is
unrealistic to assume that ditches and reservoirs may simply be moved "out of the way"
of residential development. When moving to the County, property owners and
residents must realize they cannot take water from irrigation ditches, lakes, or other
structures, unless they have an adjudicated right to the water.
Weld County covers a land area of approximately four thousand (4,000) square miles
in size (twice the size of the State of Delaware) with more than three thousand seven
hundred (3,700) miles of state and County roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement is
based on responses to complaints more than on patrols of the County, and the

distances which must be traveled may delay all emergency responses, including law
enforcement, ambulance, and fire. Fire protection is usually provided by volunteers
who must leave their jobs and families to respond to emergencies. County gravel
roads, no matter how often they are bladed, will not provide the same kind of surface
expected from a paved road. Snow removal priorities mean that roads from
subdivisions to arterials may not be cleared for several days after a major snowstorm.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
People are exposed to different hazards in the County than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs and livestock, and open burning present real threats.
Controlling children's activities is important, not only for their safety, but also for the
protection of the farmer's livelihood.
5. This Recorded Exemption was approved to bring an illegal parcel into compliance with the State of
Colorado and Weld County's minimum lot size requirements.

9. If the exemption plat has not been recorded within sixty (60) days from the date the administrative
review was signed, or Board of County Commissioners resolution, or if an applicant is unwilling or
unable to meet any of the conditions within sixty (60) days of approval, the application will be
forwarded to the Board of County Commissioners with a staff recommendation for denial. The
Director of Planning Services may grant an extension of time, for good cause shown, upon a written
request by the applicant.

The applicants are proposing a two -lot recorded exemption on this parcel. Lot
A is proposed to be 0.21 acres in size and Lot B is proposed to be 153.26
acres in size. An unmanned pump facility owned by Public Service is located
on Lot A. Amended Use by Special Review Permit AMUSR-1329 (Open Pit
Mining and Materials Processing, a Concrete Batch Plant, and the Importation
of Sand and Gravel Aggregates).
This proposed recorded exemption is to address an illegal land split in which
Lot A of Recorded Exemption was divided without utilizing the recorded
exemption process. The original parcel was created through a recorded
exemption (RE -134). RE -134 was recorded on May 8, 1974. On September
26, 1979, 0.21 acres (part of Lot A of RE -134) was sold from Dan and
Elizabeth Klein to Western Slope Gas Company by deed. Western Slope Gas
Company (Western Slope Gas Supply) merged with Public Service Company
of Colorado on January 1, 1993. Per the recorded exemption regulations, Lot
A of RECX16-0020 will not be eligible for a future recorded exemption.
The Department of Planning Services' staff has reviewed this request and could not approve this request
since the Department of Planning Services does not have the authority to grant an exception to Section
24-8-40.L of the Weld County Code. Section 24-8-40.L states:
The minimum size of any lot proposed with a public water supply is not less than one (1) acre net.
The minimum size of any lot proposed with a well as the water supply is not less than two and one-
half (2X) acres net. Minimum lot sizes do not apply in zone districts which allow smaller lots or

where exempted by the Board of County Commissioners.
Should the Board of County Commissioners approve this request, the Department recommends
the following conditions be attached:
The Weld County Department of Planning Services has determined through an administrative review that
the standards of Section 24-8-40 of the Weld County Code have been met. This Recorded Exemption is
approved with the following conditions in accordance with information submitted in the application and the
policies of Weld County.
1. A Weld County septic permit is required for any proposed home. The septic system shall be installed
according to the Weld County Onsite Wastewater Treatment System regulations.
2. Prior to recording the plat:
A. The applicant shall provide the Weld County Department of Planning Services with a Statement
of Taxes from the Weld County Treasurer showing no delinquent taxes exist for the original
parcel.
3. Items to be included on the plat:
The plat shall be titled: Recorded Exemption No. 0957-30-2 RECX16-0020.
County Road 13 is a paved road and is designated on the Weld County Road Classification
Plan as an arterial road, which requires 140 feet of right-of-way at full buildout. The applicant
shall verify and delineate on the plat the future and existing right-of-way and the documents
creating the existing right-of-way. If the existing right of way cannot be verified it shall be
dedicated. All setbacks shall be measured from the edge of future right-of-way. This road is
maintained by Weld County. (Department of Public Works)
C. County Road 54 is a paved road and is designated on the Weld County Road Classification
Plan as an arterial road, which requires 140 feet of right-of-way at full buildout. The applicant
shall verify and delineate on the plat the future and existing right-of-way and the documents
creating the existing right-of-way. If the existing right of way cannot be verified it shall be
dedicated. All setbacks shall be measured from the edge of future right-of-way. This road is

Show and label the approved access point(s) and access permit number(s) on the plat (AP16-
00196). (Department of Public Works)
Show the floodplain and floodway boundaries on the plat. Label the floodplain boundaries
with the FEMA Flood Zone and FEMA Map Panel Number.
F. Setback radiuses for existing oil and gas tank batteries and wellheads shall be indicated on
the plat per the setback requirements of 23-3-50.E of the Weld County Code.
G. All recorded easements and rights -of -way shall be delineated on the plat by book and page
number or reception number.
4. The following notes shall be placed on the plat:
1) All proposed or existing structures will or do meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured from
the future right-of-way line.

No building or structure as defined and limited to those occupancies listed as Groups
A, B, E, F, H, I, M and R in Section 302.1 of the 2012 International Building Code, shall
be constructed within a 200 -foot radius of any tank battery or within a 150 -foot radius
of any wellhead or within a twenty -five-foot radius of any plugged or abandoned oil and
gas well. Any construction within a two -hundred -foot radius of any tank battery or one -
hundred -fifty -foot radius of any wellhead shall require a variance from the terms of this
Chapter in accordance with Subsection 23-6-10.C of this Code.
2) Any future structures or uses on site must obtain the appropriate zoning and building
permits.
3) Lot A is not eligible for a future land exemption in accordance with Section 24-8-20.C.1
of the Weld County Code.
4) A Flood Hazard Development Permit is required for all construction or development
occurring in the floodplain or floodway as delineated on Federal Emergency
Management Agency (FEMA) FIRM Community Panel Map #08123C -1490E and
1495E effective date January 20, 2016 (Big Thompson River Floodplain). Any
development shall comply with all applicable Weld County requirements, Colorado
Water Conservation Board requirements as described in Rules and Regulations for
Regulatory Floodplains in Colorado, and FEMA regulations and requirements as
described in 44 CFR parts 59, 60, and 65. The FEMA definition of development is any
man-made change to improved or unimproved real estate, including but not limited to
buildings or other structures, mining, dredging, filling, grading, paving, excavation,
drilling operations, or storage of equipment and materials.
5) The installation of any septic system within the 100 -year flood plain shall comply with
the Weld County O.W.T.S. flood plain policy. In accordance with the State of Colorado
O.W.T.S. Regulations, no septic system shall be installed within the floodway.
6) Prior to the release of building permits, the applicant shall submit a recorded deed
describing the Lot upon which the building permit is requested with the building permit
applications. The legal description on such deed shall include the Lot designation and
Recorded Exemption number.
7) The property owner shall control noxious weeds on the site.
8) The historical flow patterns and runoff amounts will be maintained on the site.
9) Building permits shall be obtained prior to the construction of any building. Buildings
that meet the definition of an Ag Exempt Building per the requirements of Section 29-
1-20 and Section 29-3-20.B.13 of the Weld County Code do not need building permits,
however, a Certificate of Compliance must be filed with the Planning Department and
an electrical and/or plumbing permit is required for any electrical service to the building
or water for watering or washing of livestock or poultry.
10) Any disturbance of wetlands shall require the applicant to contact the Army Corps of
Engineers for permits pursuant to Section 404 of the Clean Water Act.
11) Building Permits issued on the proposed lots will be required to adhere to the fee
structure of the County -Wide Road Impact Fee Program.
12) Building Permits issued on the proposed lots, will be required to adhere to the fee
structure of the County Facility Fee and Drainage Impact Fee Programs.

13) RIGHT TO EXTRACT MINERAL RESOURCES STATEMENT: Weld County has some
of the most abundant mineral resources, including, but not limited to, sand and gravel,
oil, natural gas, and coal. Under title 34 of the Colorado Revised Statutes, minerals are
vital resources because (a) the state's commercial mineral deposits are essential to
the state's economy; (b) the populous counties of the state face a critical shortage of
such deposits; and (c) such deposits should be extracted according to a rational plan,
calculated to avoid waste of such deposits and cause the least practicable disruption
of the ecology and quality of life of the citizens of the populous counties of the state.
Mineral resource locations are widespread throughout the County and person moving
into these areas must recognize the various impacts associated with this
development. Often times, mineral resource sites are fixed to their geographical and
geophysical locations. Moreover, these resources are protected property rights and
mineral owners should be afforded the opportunity to extract the mineral resource.
14) WELD COUNTY'S RIGHT TO FARM: Weld County is one of the most productive
agricultural counties in the United States, typically ranking in the top ten counties in the
country in total market value of agricultural products sold. The rural areas of Weld
County may be open and spacious, but they are intensively used for agriculture.
Persons moving into a rural area must recognize and accept there are drawbacks,
including conflicts with long-standing agricultural practices and a lower level of services
than in town. Along with the drawbacks come the incentives which attract urban
dwellers to relocate to rural areas: open views, spaciousness, wildlife, lack of city noise
and congestion, and the rural atmosphere and way of life. Without neighboring farms,
those features which attract urban dwellers to rural Weld County would quickly be gone
forever.
Agricultural users of the land should not be expected to change their long-established
agricultural practices to accommodate the intrusions of urban users into a rural area.
Well -run agricultural activities will generate off -site impacts, including noise from
tractors and equipment; slow -moving farm vehicles on rural roads; dust from animal
pens, field work, harvest and gravel roads; odor from animal confinement, silage and
manure; smoke from ditch burning; flies and mosquitoes; hunting and trapping
activities; shooting sports, legal hazing of nuisance wildlife; and the use of pesticides
and fertilizers in the fields, including the use of aerial spraying. It is common practice
for agricultural producers to utilize an accumulation of agricultural machinery and
supplies to assist in their agricultural operations. A concentration of miscellaneous
agricultural materials often produces a visual disparity between rural and urban areas
of the County. Section 35-3.5-102, C.R.S., provides that an agricultural operation shall
not be found to be a public or private nuisance if the agricultural operation alleged to
be a nuisance employs methods or practices that are commonly or reasonably
associated with agricultural production.
Water has been, and continues to be, the lifeline for the agricultural community. It is
unrealistic to assume that ditches and reservoirs may simply be moved "out of the way"
of residential development. When moving to the County, property owners and
residents must realize they cannot take water from irrigation ditches, lakes, or other
structures, unless they have an adjudicated right to the water.
Weld County covers a land area of approximately four thousand (4,000) square miles
in size (twice the size of the State of Delaware) with more than three thousand seven
hundred (3,700) miles of state and County roads outside of municipalities. The sheer
magnitude of the area to be served stretches available resources. Law enforcement is
based on responses to complaints more than on patrols of the County, and the

distances which must be traveled may delay all emergency responses, including law
enforcement, ambulance, and fire. Fire protection is usually provided by volunteers
who must leave their jobs and families to respond to emergencies. County gravel
roads, no matter how often they are bladed, will not provide the same kind of surface
expected from a paved road. Snow removal priorities mean that roads from
subdivisions to arterials may not be cleared for several days after a major snowstorm.
Services in rural areas, in many cases, will not be equivalent to municipal services.
Rural dwellers must, by necessity, be more self-sufficient than urban dwellers.
People are exposed to different hazards in the County than in an urban or suburban
setting. Farm equipment and oil field equipment, ponds and irrigation ditches, electrical
power for pumps and center pivot operations, high speed traffic, sand burs, puncture
vines, territorial farm dogs and livestock, and open burning present real threats.
Controlling children's activities is important, not only for their safety, but also for the
protection of the farmer's livelihood.
5. This Recorded Exemption was approved to bring an illegal parcel into compliance with the State of
Colorado and Weld County's minimum lot size requirements.
6. The plat shall be prepared in accordance with the requirements of Section 24-8-60 of the Weld County
Code. The applicant shall submit one (1) electronic copy or one (1) paper copy of the plat for
preliminary approval to the Department of Planning Services. Upon approval of the plat, the applicant
shall submit a Mylar plat along with all other documentation required as conditions of approval. The
Mylar plat shall be recorded in the office of the County Clerk and Recorder by the Department of
Planning Services. The Mylar plat and additional requirements shall be recorded within sixty (60)
days from the date of the Board of County Commissioners Resolution. The applicant shall be
responsible for paying the recording fee.
7. In accordance with Weld County Code Ordinance 2005-7 approved June 1, 2005, should the plat not
be recorded within the required sixty (60) days from the date the Administrative Review was signed
a $50.00 recording continuance charge shall added for each additional 3 month period.
8. The Department of Planning Services respectfully requests the surveyor provide a digital copy of this
Recorded Exemption. Acceptable CAD formats are .dwg, .dxf, and .dgn (Microstation); acceptable
GIS formats are ArcView shapefiles, Arclnfo Coverages and Arclnfo Export files format type is .e00.
The preferred format for Images is .tif (Group 4). (Group 6 is not acceptable). This digital file may be
sent to mapsco.weld.co.us.
9. If the exemption plat has not been recorded within sixty (60) days from the date the administrative
review was signed, or Board of County Commissioners resolution, or if an applicant is unwilling or
unable to meet any of the conditions within sixty (60) days of approval, the application will be
forwarded to the Board of County Commissioners with a staff recommendation for denial. The
Director of Planning Services may grant an extension of time, for good cause shown, upon a written
request by the applicant.

Weld County A Recorded Exemption was not submitted, as required by the Weld County Planning
regulations. The current owner of the portion of the northwest 1/4 of Section 30 remaining after the sale is
Loveland Ready Mix Concrete, Inc. (Loveland Ready Mix). Weld County AmUSR-1329 authorizes their
current use of the property. The facilities on the Loveland Ready Mix property do not impact the Public
Service Company property or facility.
Loveland Ready Mix is currently processing a Minor Amendment to AmUSR-1329. The Minor
Amendment will also have no impact on the Public Service Company of Colorado property or
facilities. As part of the Minor Amendment, the Weld County Department of Planning Services requires
a Recorded Exemption to cover the 1979 sale. Loveland Ready Mix has submitted the Recorded
Exemption, however, the Weld County Department of Planning Services requires that Public Service
Company of Colorado also requests the Recorded Exemption. Public Service Company of Colorado
therefore submits the attached Recorded Exemption Application.
This letter authorizes Mr. Don Friess of D2CAD Consulting, LLC, to submit the attached Recorded
Exemption Application to the Weld County Department of Planning Services on behalf of Public Service

Introduction
Loveland Ready Mix Concrete, Inc., dba Johnstown Ready Mix (LRM) operates the
Green / Croissant Sand and Gravel Mine and associated Portland Cement Batch Plant on
the southeast corner of Weld County Roads 13 and 54, serving Weld and Larimer County
projects. The batch plant has been in operation for about 15 years. The 144.7 +/- acre
Agriculture -zoned property is part of the northeast 'A of Section 30, Township 5 North,
Range 67 West of the 611' Prime Meridian. LRM operates on the northerly portion of the
property under an Amended Use by Special Review by Weld County (AmUSR-1329),
authorized in 2005, and DRMS 112 Permit No. M-2001-022. The southerly portion of
the property remains in agricultural use.
This Recorded Exemption submittal concerns a 0.230 acre parcel located on the
northwest corner of the NW 'A of Section 30. In 1974, the original owners of the NW 'A
of Section 30 (Dan and Elizabeth Klein) recorded an exemption splitting off a portion on
the southwest side of the Hillsboro Ditch (Lot B) from the 1/4 Section (Lot A) (RE -
134). In 1979, they then deeded the 0.230 acre parcel on the southeast corner of Weld
County Roads 13 and 54 from Lot A to Western Slope Gas Company, now owned by
Public Service Company of Colorado (PSCo). The deed was recorded with Weld County
and the parcel is identified in the County records and on the County's mapping.
Apparently, no recorded exemption was filed with the County by either the original
owners or Western Slope Gas Company for this transaction. The location of these
parcels is shown on the attached map.
LRM purchased the property (Lot A less the Western Slope Gas Company deeded parcel)
in 1997, 18 years after the Western Slope Gas Company deed was recorded. LRM later
obtained USR-1329 and later AmUSR-1329 through the County, and has conducted
concrete batch plant and mining operations for about 15 years. It is now about 37 years
since the previous owners deeded this parcel to who is now PSCo.
PSCo has sole control over the parcel they own, as they and their predecessor have for 37
years. There is a small, apparently unattended, pump station on the southeast corner of
the parcel, and an access from Weld County Road 13 to the PSCo site. LRM is unaware
of what arrangements PSCo has for water supply and sewage; however; it is unlikely that
a small unattended pump station would require an on -site potable water supply or sewage
disposal.

1. Domestic/Potable Water
The LRM batch plant parcel has a 3/4 -inch tap from the Little Thompson Water District.
A copy of the correspondence with the district that obtained this tap is attached as Exhibit
F. It is unlikely that the PSCo small unattended pump station would require an on -site
potable water supply or sewage disposal.
2. Irrigation Water
No irrigation water is required for the PSCo parcel. Current irrigation water rights are
with parcel A for use on the agricultural land, South of the LRM batch plant.
3. Adequate means for the Disposal of Sewage
The LRM batch plant has an existing septic system permitted under Weld County Permit
No. SP -100489. A copy of this permit is attached as Exhibit G. It is unlikely that the
PSCo small unattended pump station would require an on -site potable water supply or
sewage disposal.
4. Describe How the Property is Being Used
LRM operates a Portland cement concrete batch plant and sand and gravel mine on the
southeast corner of Weld County Roads 13 and 54 serving Weld and Larimer County
projects. The batch plant has been in operation for about 15 years. The 144.7 +1- acre

This letter is in response to your request for a water service commitment for one commercial
lot, in the location described as follows:
PORTIONS OF the NW '/4, SEC.30, T5N, R67W -- WELD COUNTY, CO
+/- 400' South of WCR 54 along the East side of WCR 13.
The District provides water service within its service area as defined by the District. The
provision of water service by extension of existing water lines of the District to the above property
and the installation of taps for lots is done under the terms of the Rules and Regulations of the District
established by the Board of the District from time to time. You may obtain a copy of the Rules and
Regulations from the District. This letter outlines the provisions of the Rules and Regulations,
however this letter does not change any provisions of the Rules and Regulations. The Board of the
District may alter and amend the Rules and Regulations at any time, and the provisions of this letter
are subject to alteration and amendment based on changes in the Rules and Regulations of the District.
We currently have a 6" diameter water line located along Weld County Road 13 with
additional capacity available Therefore, we can commit to provide service to the above property,
subject to the limitations in this letter, for one standard 5/8" X 3/4" water tap; and the following
additional limitations on the provision of water service are:
1. In August of 1993 the Little Thompson Board implemented a "system impact" fee of
$1050 per tap for all taps to be added to the system. This is due upon application for
the tap.
2. All improvements to District facilities required to provide service will be the financial
responsibility of the developer in accordance with the District Rules and Regulations.
All improvements must conform to District Specifications.
3 There is a $2,000 fire hydrant fee that needs to be paid prior to installation of the fire
hydrant. You will be responsible for any improvements needed to meet the required
fire flows at your fire hydrant.
4. The Town of Johnstown has asked Little Thompson Water District to provide the
service for this location.
This commitment letter will expire two years from the date of this letter if the tap has not been
purchased, paid for and installed by that date of expiration. The current fee for the domestic 5/8" X
3/4" tap is $14,000.00. As of January 1, 2002 the impact fee will be eliminated and the tap fee will be
$18,500.00. YOU ARE HEREBY ADVISED THAT THE RILES, REGULATIONS AND
TARIFFS OF THE DISTRICT ARE SUBJECT TO CHANGE WITHOUT NOTICE; AND
THIS LETTER IS ISSUED WITH THE SPECIFIC LIMITATION THAT THE DISTRICT
MAY CHANGE THE RULES, REGULATIONS AND TARIFFS APPLICABLE TO THE

include the property served within the District, if this has not been previously accomplished. User further agrees that he will
not permit other persons to use water furnished to him under this agreement.
5. District agrees to furnish water to User PROVIDED, that the District shall not be liable for loss to User for failure to deliver
water because of war, riot, insurrection, breaks in the water system or Acts of God. The District shall endeavor to repair all
breaks promptly on District lines.
6. User agrees to abide by such other rules and regulations of the District regarding the use of water as may be established from

Approximate Access Location: on CR13 south of CR 54 approx. 407 feet.
Roads:
County Road 13 is a paved road and is designated on the Weld County Road Classification Plan as a
arterial road, which requires 140 feet of right-of-way at full buildout. The applicant shall verify and delineate
on the site map the future and existing right-of-way and the documents creating the existing right of way. If
the existing right of way cannot be verified it shall be dedicated. All setbacks shall be measured from the
edge of future right-of-way. This road is maintained by Weld County.

Access:
An Access Permit application was submitted with the application materials. Public Works will review the
application and provide an access permit and permit number if approved. Questions concerning access
requirements can be directed to Public Works access permit division.
For shared accesses, Public Works strongly recommends that the property owner establish an access road
maintenance agreement so future owners of the properties will be aware of their requirements for shared
maintenance of the access road. This is not a requirement for the recorded exemption but is recommended
to avoid property owner conflicts in the future.
Entrance gates (if applicable) must be set back a minimum of 100 feet from edge of road shoulder to allow
a truck with trailer or RV to pull completely off of the roadway and open the gate. In no case shall any
vehicle(s) stopped to open a gate be allowed to create a safety issue for roadway users.
When feasible, there shall be no net increase in the number of accesses to a public road. Contact Public
Works to discuss your access.

The above entitled matter coming on to be heard on the
verified Petition of the Administrator of the above entitled estate
and the Court being fully advised in the premises, FINDS:
That prior to the death of the decedent, William E. Bowen,
and on February 9, 1948, the said decedent contracted in writing to
sell and convey to Dan Klein and Elizabeth Klein as joint tenants
with the right of survivorship and not as tenants in common, the
property hereinafter described.
That the said ,William E. Bowen died without having
performed 'said agreement, and that the Administrator Herbert J. Bowen
should be authorized to specifically carry out and perform the terms
of said agreement, which agreement is attached to the Petition of the
Administratorand filed in this Court.
IT IS THEREFORE ORDERED, ADJUDGED AND DECREED that upon
payment by Dan Klein of the balance due under the terms of said
agreement, that Herbert J. Dowen as Administrator of the estate of
William E. Bowen, Deceased, perform specifically the terms of that
certain written agreement dated February 9, 1948, by and between
Herbert J. Bowen and. William E. Bowen as parties of the first part,
and Dan Klein as party of the second part by executing, acknowledging
and delivering to Dan Klein and Elizabeth Klein.as joint tenants
with the right of survivorship and not as tenants in common,

THIS INDENTURE, made this 25th day of March, in the
year of our Lord, one thousand nine hundred forty-eight, between
HERBERT J. BOWEN as ADMINISTRATOR of the Estate of William E. Bowen,
Deceased, as party of the first part, and DAN KLEIN and ELIZABETH KLEIN
as joint. tenants with the right of survivorship and not as tenants in
common, as parties of the second part, WITNESSETH:
WHEREAS,. Willis E. Bowen as first party and Dan Klein as
second party entered into a written agreement on the 9th day of February,
1948, providing for the purchase by Dan Klein and Elizabeth Klein as
Joint tenants from William E. Bowen of the premises more particularly
described below for the sum of Eight Thousand Seven Hundred Fifty Dollars
($8,760.000.
AND WHEREAS, William E. Bowen departed this life at Greeley,
Colorado, on February 23,'1946, and at that time there remained un$aid
on said Contract to purchase the interest of the said William E. Bowen
in the property hereinafter described, the Sum of Seven Thousand Two.
Hundred Fifty Dollars ($7,260.00).
AND WHEREAS, by Order of the County Court of Weld County at
Greeley, Colorado, in the estate of William E. Bowen, Deceased, No. 6238
in said County Court, there has been entered an Order under date of
March 19, 1948, directing first party to perform said agreement
specifically and to execute this Deed upon payment of the balance of
said purchase price and first party now has received payment of the
balance of said purchase price.
NOW THEREFORE, first party in consideration of the foregoing
has sold and conveyed and by these presents does sell and convey unto
the said parties of the second part, not in tenancy in common but
in joint tenancy, the survivor of them, their assigns and the heirs and
assigns of such survivor forever, all the right, title and interest
which the said William E. Bowen had in his lifetime and at the time
of his death in and to the following described lot or parcel of land
situate in the County of Weld, State of Colorado, to -wit:
