Dear Ms. Aungst:
We have reviewed the above referenced application for a Site Specific Development Plan and
Use by Special Review Permit. The submitted material does not appear to qualify as a "subdivision"
as defined in § 30-28-101(10)(a), C.R.S. Therefore, pursuant to the State Engineer's March 4, 2005
and March 11, 2011 memorandums to county planning directors, this office will only perform a
cursory review of the referral information and provide comments. The comments will not address
the adequacy of the water supply plan for this property or the ability of the water supply plan to
satisfy any County regulations or requirements.
The site is approximately 7.15 acres and contains three existing buildings: a 61,500 square -
foot building with offices and restrooms; a residence; and a 1,600 square -foot shed. The application
is sought to allow the main building to be used for operations, administration, and storage of
equipment and goods for two businesses owned by Mr. Sandau. The businesses are identified as
Green Earth Environmental, Inc., a storm water management, landscaping, reclamation, and soil
remediation service company, and Clear Water Sediment a Erosion Control LLC, a manufacturer of
storm water erosion control devices. The businesses will have 20-30 full-time employees who will
visit the site before departing for daily tasks and approximately 5 full-time administrative personnel
that will remain on site for the duration of the workday.
The proposed water supplier is the North Weld County Water District ("NWCWD"). The
applicant provided a letter from the North Weld County Water District dated August 7, 2015 stating
that the District currently provides domestic water service to the property at 23595 Weld County
Road 62, and that the District has no conflict with the property owner applying for a Use by Special
Review permit as proposed. The NWCWD most recently provided updated supply and demand
information via the Tri-Districts on December 18, 2012. The document shows that the NWCWD's firm
yield supply of 6,392 acre-feet exceeds its dry year planning demand of 4,702 acre-feet. This office
considers the NWCWD to be a reliable water source.
This office has no objection to the subject Site Specific Development Plan and Use by Special
Review Permit with the NWCWD as the water supplier. Should you or the applicant have any
