WELD COUNTY COUNCIL
July 18, 2016
The Weld County Council met in full conformity with the Weld County Home Rule
Charter, Monday, July 18, 2016 at the Weld County Administration Building, Greeley,
CO.
ROLL CALL: The meeting was called to order by Councilman Jemiola at 6:30pm
and on roll call the following members were present, constituting a quorum of members
thereof:
Councilwoman Marge Klein
Councilman Brett Abernathy
Councilman Don Mueller
Councilman Jordan Jemiola
Councilman Charles Tucker
Also present: County Attorney, Bruce Barker, and Sarah Mundt, Council Secretary,
APPROVAL OF AGENDA: Councilman Jemiola motioned to add the discussion of
the all -in -one copier/printer/fax machine to the Agenda. The motion carried. Councilman
Abernathy made a motion to move Public Comment ahead of New Business, the motion
carried.
• APPROVAL OF MINUTES AND REPORT TO THE PEOPLE: June 20, 2016
Minutes: The motion was made to approve the minutes by Councilman Tucker and the
motion was seconded by Councilman Mueller and the motion carried. July 11, 2016
Minutes: The motion was made to approve the minutes by Councilman Mueller and the
motion was seconded by Councilman Tucker and the motion carried. Second Quarter
Report To The People: The motion was made to approve the report by Councilwoman
Klein and the motion was seconded by Councilman Tucker and the motion carried.
PUBLIC COMMENT: None
NEW BUSINESS:
o Discuss/Vote on performance audit of Clerk and Recorder's Office
o Recusal from audit vote: Councilwoman Klein recused herself from the
vote on the audit of the Clerk and Recorder's Office
o Councilman Mueller motioned to move forward on a performance or
operational review, asking Don Warden to assist in securing a party to
execute said functions. Councilman Tucker seconded the motion.
■ Councilman Abernathy read a statement and stated that he does
not support an audit on one department (statement attached).

■ Councilman Tucker stated that the Council received complaints
about the Clerk and Recorder's Office and performing an audit
county wide is frivolous. He believes only the Clerk and Recorder's
office is the only office to be voted upon.
• Councilman Mueller stated the Council could consider further audits
after the Clerk and Recorder's Office audit is dealt with.
• Councilman Jemiola stated he would like to audit the
Commissioners. Councilman Mueller and Councilman Tucker
stated that that could be considered later on.
o Councilman Mueller states that he motioned to vote on the audit based
on newspaper articles, reports, and personal complaints.
o A roll call vote was taken: The motion failed
o Councilman Abernathy- No
o Councilman Mueller- Yes
o Councilman Jemiola- No
o Councilman Tucker- Yes
o Councilman Abernathy made a motion to prepare a RFQ, find the lowest audit
firm bidder, request any supplemental funding, and conduct a County wide
audit, starting with the Clerk and Recorder's Office, followed by the
Commissioners, Assessor's Office, ending with the Sheriff's Office, to be
conducted within a one year timeframe. Councilman Jemiola seconded the
motion.
o Councilman Mueller stated that he feels Councilman Jemiola should recuse
himself
o Councilman Jemiola stated that he sought legal consult and it was
determined that he has no conflict of interest and is able to make a just and
fair decision.
o Councilman Mueller stated that he has never seen a need for a specific
operational audit of this magnitude in all of his time serving on the Council
and the history of the Council doing audits began with a specific reported
instance.
o Councilman Tucker has concerns on the costs for a County wide audit and
who an audit firm would report to. Councilman Tucker stated he believes this
motion was put on the table to end the discussion and movement on an audit
of the Clerk and Recorder's Office.
o Councilman Abernathy asked if the Council may have caught the issues with
the Treasurer's Office while it was still an elected position.
o Councilman Mueller states that he believes that there is suspected problems
at the Clerk and Recorder's Office.
o Councilman Mueller stated that the Council has the funds to immediately seek
an audit on the Clerk and Recorder's Office. He believes the Council should
start here and look into further audits at a later time.
o Councilman Tucker stated he would like to modify the motion to go forward
with the Clerk and Recorder's audit with the existing $23,000 and at a later

date discuss and seek funding for other audits. Councilman Mueller
seconded the motion to amend Councilman Abernathy's motion on the table.
o Councilman Abernathy stated he would not accept an amendment to his
motion.

o Councilman Abernathy amended his previous motion to conduct an audit on the
Clerk and Recorder's office and the Board of County Commissioners only this
year. Councilman Tucker stated he would like to bring the original motion back
on the table. Mr. Barker advised upon Robert's Rules and the motion will not be
heard. Councilman Abernathy motioned to prepare a RFQ, find the lowest bidder,
seek supplementary funding to audit the Clerk and Recorder and Board of
County Commissioners and the following year, seek audits on the remaining
elected departments. Councilman Jemiola asked if an amendment could be to
the motion to drop the following year's audits and just focus on the Clerk and
Recorder's Office and the Board of County Commissioners. Councilman
Abernathy accepted the suggested amendment and Councilman Jemiola
seconded the motion with changes.

o Discuss Legal Representation at WCC Official Meetings
o Councilman Jemiola asked if the County would be willing to allow legal
counsel to be at all official meetings. Mr. Barker is willing to be present or
have a legal representative available at all official meetings.
o Discuss Coordinator Reports
o Councilman Jemiola feels that all official meetings should be held at
County seat. He suggests using coordinator reports as a means to allow
the District Representative and the At Large Representative to meet with
constituents. Councilman Tucker stated that he supports having regular
meetings in outlying areas to meet directly with constituents.
o Discuss purchase of portable recording devise

o Councilman Mueller asked what the cost of a devise would be. It is
$5,000. A motion was made to table the discussion until ail options are
looked into. The motion carried.
o Discuss purchase of all -in -one printer/copier/scanner
o Councilman Mueller motioned to approve the purchase of the all -in -one
printer. Councilman Tucker seconded the motion and the motion carried
unanimously.
Councilman Jemiola asked if the Council would like to bring the motion back at a later
time. Mr. Barker informed of procedure based on Robert's Rules.

• Pay Bills: Councilman Abernathy made a motion to pay the bills and the motion
was seconded by Councilman Tucker and the motion carried.

ADJOURNMENT: By acclamation, the meeting was adjourned at 7:44 p.m.
The next Regular Meeting of the Weld County Council will be on August 15, 2016 at the
Weld County Administration Building, Greeley, CO. Councilman Tucker will contact
County Attorney, Bruce Barker, to present.
