JANUARY 25, 2016
The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity
with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration
Building, Greeley, Colorado, January 25, 2016, at the hour of 9:00 a.m.
ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were
present, constituting a quorum of the members thereof:

MINUTES: Commissioner Kirkmeyer moved to approve the minutes of the Board of County
Commissioners meeting of January 20, 2016, as printed. Commissioner Conway seconded the motion,
and it carried unanimously.
El CERTIFICATION OF HEARINGS: Commissioner Cozad moved to approve the Certification of
Hearings conducted on January 25, 2016, as follows: 1) USR15-0054 - Nevin Byler, Karen Byler, and
Jalynn Byler, 2) USR15-0059 - Tallgrass Terminals, LLC, 3) USR15-0062 - 70 Ranch, LLC, c/o Blue
Grama Land, and 4) USR15-0068 - Platte River Midstream, Inc. Commissioner Conway seconded the
motion, which carried unanimously.
AMENDMENTS TO AGENDA: There were no amendments to the agenda.

PRESENTATIONS:
• 1) EATON REDS DAY RECOGNIZING STATE 3A VOLLEYBALL CHAMPS -JANUARY 25, 2016:
Chair Freeman read the certificate for the record. Steve Longwell, Athletic Director thanked the
Commissioners and introduced Gwen Forster, Lori Willadsen, and Chelsea Cowan as Eaton Red's
coaches. Coach Cowan thanked the Commissioners for recognizing the team's accomplishments. She
stated that she gets to work with a great group of girls. Eaton's team Captain thanked the Board for the
recognition. Chair Freeman stated he appreciates the leadership from the team, both in the sport and
their grade point average. Commissioner Cozad congratulated the team for all the work, and the
accomplishments they have made. Commissioner Conway relayed the fact that they are role models,
and how important it is because society needs more women role models. He requested the team give
the coaches and parents a standing ovation. Commissioner Moreno expressed his pride at their
accomplishments. Commissioner Kirkmeyer offered her congratulations and thanked them for
representing Weld County and reminded them to thank their parents, coaches and teachers for
committing to help them achieve their goals. (Clerk's Note: Meeting was paused for a photo opportunity.)
PUBLIC INPUT: No public input was given.
BIDS:
El 1) PRESENT BID #B1500202, ON-SITE MEDICAL SERVICES - DEPARTMENT OF HUMAN
RESOURCES: Trevor Jiricek, Director of General Services, stated staff received ten (10) bids and will
bring back a recommendation on February 17, 2016.
• 2) APPROVE BID #61500193, HR402 -WELLNESS PROGRAM PORTAL - DEPARTMENT OF
HUMAN RESOURCES / DEPARTMENT OF INFORMATION TECHNOLOGY: Staci Datteri-Frey,
Department of Human Resources, stated staff recommends awarding the low bid to Brittingham Software
Design, Inc. Commissioner Conway moved to approve said low bid. The motion was seconded by
Commissioner Kirkmeyer, and it carried unanimously.
• 3) APPROVE BID #61500196, PERMANENT FLOOD REPAIR - TWO RIVERS PARKWAY
(EM-BR 27.5-48A) - DEPARTMENT OF PUBLIC WORKS (CON'T FROM 1/18/2016): Mr. Jiricek
requested this matter be continued for another week. Commissioner Conway moved to continue this
matter to February 1, 2016. Seconded by Commissioner Moreno, the motion carried unanimously.
(Clerk's Note: Bid #81500196, Permanent Flood Repair and item #2 under the Consent Agenda were
subsequently rescheduled to 2/8/2016.)
• 4)APPROVE BID#61500203, PARKING LOT LIGHTING UPGRADES, VARIOUS LOCATIONS -
DEPARTMENT OF BUILDINGS AND GROUNDS (CON'T FROM 12/30/2015): Mr. Jiricek stated staff
recommends awarding the second low bid to Mac Electric. Commissioner Cozad moved to approve the
second low bid that meets specifications. The motion, which was seconded by Commissioner Conway,
carried unanimously.
• 5)APPROVE BID#B1600001, PATROL VEHICLES, FULL SIZED (QTY. 8)-SHERIFF'S OFFICE:
Mr. Jiricek stated staff would like to request this matter be continued. Commissioner Kirkmeyer moved to
continue this matter to February 1, 2016, to allow the Department more time to review their bids.
Commissioner Conway seconded the motion, and it carried unanimously.
6) APPROVE BID #B1600002, CIVILIAN VEHICLES (QTY. 7) - SHERIFF AND DISTRICT
ATTORNEY'S OFFICES: Mr. Jiricek requested this matter be continued for one week. Commissioner

Cozad moved to continue this matter to February 1, 2016. The motion was seconded by Commissioner
Moreno, and it carried unanimously.
• 7) APPROVE BID#61600003, 3/4-TON 4X4 EXTENDED CAB LONG BED PICKUP-SHERIFF'S
OFFICE: Mr. Jiricek recommended continuing this matter. Commissioner Conway moved to continue this
matter to February 1, 2016. Seconded by Commissioner Cozad, the motion carried unanimously.
8) APPROVE BID #61600004, 3/4-TON 4X4 WITH UTILITY BOX - DEPARTMENT OF
BUILDINGS AND GROUNDS: Mr. Jiricek stated staff recommends awarding this to Weld County Garage.
Commissioner Moreno moved to approve said low bid. Commissioner Cozad seconded the motion, and
it carried unanimously.
El 9) APPROVE BID #B1600006, SUV (SMALL) — DEPARTMENT OF PUBLIC HEALTH AND
ENVIRONMENT: Mr. Jiricek recommended awarding the low bidder; Johnson Auto Plaza. Commissioner
Conway moved to approve said low bid. The motion was seconded by Commissioner Moreno, and it
carried unanimously.
• 10)APPROVE BID#81600007, ARTICULATING WHEEL LOADER- DEPARTMENT OF PUBLIC
WORKS, TRUCKING DIVISION: Commissioner Conway moved to continue this matter to February 1,
2016. The motion, which was seconded by Commissioner Kirkmeyer, carried unanimously.
• 11) APPROVE BID#B1600008, ARTICULATING WHEEL LOADER- DEPARTMENT OF PUBLIC
WORKS, BRIDGE DIVISION: Mr. Jiricek stated staff recommends awarding the bid to 4 Rivers
Equipment, because the low bidder did not meet specifications. Commissioner Moreno moved to approve
said low bid as recommended by staff. Seconded by Commissioner Kirkmeyer, the motion carried
unanimously.
El 12) APPROVE BID #B1600009, MOTORGRADERS (QTY. 3) - DEPARTMENT OF PUBLIC
WORKS, GRADER DIVISION: Mr. Jiricek stated staff recommends awarding the low bid to Wagner
Equipment Company. Commissioner Conway moved to approve said low bid. The motion was seconded
by Commissioner Cozad, and it carried unanimously.
• 13) APPROVE BID #61600010, LEASED MOTORGRADER - DEPARTMENT OF PUBLIC
WORKS, GRADER DIVISION: Mr. Jiricek stated staff recommends awarding the low bid to 4 Rivers
Equipment for a lease. Commissioner Conway moved to approve low bid. The motion, which was
seconded by Commissioner Moreno, carried unanimously.
• 14) APPROVE BID #B1600011, LOADED MOUNTED ROTARY SNOW BLOWER -
DEPARTMENT OF PUBLIC WORKS, GRADER DIVISION: Mr. Jiricek stated staff recommends
awarding the bid to Power Equipment Company. He noted the low bidder didn't meet specifications.
Commissioner Cozad moved to approve said bid as recommended by staff. The motion was seconded
by Commissioner Moreno, and it carried unanimously.
• 15) APPROVE BID #B1600012, 3 AXLE TRUCK TRACTORS (QTY. 2) - DEPARTMENT OF
PUBLIC WORKS, GRADER DIVISION: Mr. Jiricek stated staff would like to recommend awarding the
low bid to MHC Kenworth. Commissioner Conway moved to approve said low bid. Commissioner
Kirkmeyer seconded the motion, and it carried unanimously.

• 16) APPROVE BID #B1600013, TANDEM AXLE COMBO JET AND VACUUM - DEPARTMENT
OF PUBLIC WORKS, BRIDGE DIVISION: Mr. Jiricek stated staff would like to recommend the matter be
continued. Commissioner Cozad moved to continue this matter to February 1, 2016. The motion was
seconded by Commissioner Conway, and it carried unanimously.
• 17) APPROVE BID #B1600014, MINI TRACK MOUNTED HYDRAULIC EXCAVATOR -
DEPARTMENT OF PUBLIC WORKS, BRIDGE DIVISION: Mr. Jiricek stated staff recommends awarding
the low bid to Power Equipment. Commissioner Cozad moved to approve said low bid. The motion, which
was seconded by Commissioner Moreno, carried unanimously.
• 18) APPROVE BID #B1600015, 29-TON PNEUMATIC TIRE ROLLER COMPACTOR -
DEPARTMENT OF PUBLIC WORKS, BRIDGE DIVISION: Mr. Jiricek stated staff recommends awarding
the low bid to 4 Rivers Equipment for the amount of $160,300.00. Commissioner Moreno moved to
approve said low bid. The motion, which was seconded by Commissioner Kirkmeyer, carried
unanimously.
• 19) APPROVE BID #61600016, 4X4 CAB AND CHASSIS/FLATBED UTILITY BOX (QTY. 2) -
DEPARTMENT OF PUBLIC WORKS, MAINTENANCE SUPPORT DIVISION: Mr. Jiricek stated staff
recommends awarding to the low bidder, Johnson Auto Plaza. Commissioner Conway moved to approve
said low bid. Seconded by Commissioner Cozad, the motion carried unanimously.
• 20) APPROVE BID #61600017, SKID STEER LOADER - DEPARTMENT OF PUBLIC WORKS,
MINING DIVISION: Mr. Jiricek stated staff recommends awarding the low bid to Power Equipment, for
the amount of $34,865.00. Commissioner Cozad moved to approve said low bid. The motion was
seconded by Commissioner Conway, and it carried unanimously.
• 21) APPROVE BID #B1600018, TOWABLE PORTABLE AIR COMPRESSOR - DEPARTMENT
OF PUBLIC WORKS, PAVEMENT MANAGEMENT DIVISION: Mr. Jiricek stated staff recommends
awarding the bid to Faris Machinery because they meet the specifications. Commissioner Conway moved
to approve the second low bid to Faris Machinery. The motion, which was seconded by Commissioner
Cozad, carried unanimously.
• 22)APPROVE BID#B1600019, CRACK SEAL MACHINE WITH HEATED HOSE-DEPARTMENT
OF PUBLIC WORKS, PAVEMENT MANAGEMENT DIVISION: Mr. Jiricek stated staff recommends
awarding the bid to Denver Industrial Sales and Service, the third lowest bidder. Commissioner Moreno
moved to approve said third low bid. Commissioner Cozad seconded the motion, and it carried
unanimously.
• 23) APPROVE BID #B1600021, SUV (FULL SIZE) BI FUEL (QTY. 2) - PUBLIC SAFETY AND
COMMUNICATIONS: Mr. Jiricek recommended continuing this matter. Commissioner Conway moved to
continue the matter to February 1, 2016. The motion was seconded by Commissioner Kirkmeyer, and it
carried unanimously.
• CONSENT AGENDA: Commissioner Kirkmeyer moved to remove item number 2 off the Consent
Agenda and move to a future consent agenda. Commissioner Cozad seconded the motion and it carried
unanimously. Commissioner Kirkmeyer moved to approve the Consent Agenda as amended.

NEW BUSINESS:
• 1) CONSIDER VETERAN'S SERVICE OFFICER'S MONTHLY REPORT AND CERTIFICATION
OF PAY FOR DECEMBER, 2015, AND AUTHORIZE CHAIR TO SIGN: Toby Taylor, Veteran's Office,
presented the report for December, 2015, and stated the office received 380 telephone calls and 411
visits. Commissioner Kirkmeyer moved to approve said report, and authorize the Chair to sign. The
motion was seconded by Commissioner Moreno, and it carried unanimously.
• 2) CONSIDER ANNUAL REPORT FOR 2015 HERBICIDE APPLICATIONS AND AUTHORIZE
CHAIR TO SIGN: Tina Booton, Pest and Weed Division, presented the annual report for herbicide
applications for 2015. Commissioner Conway moved to approve said annual report and authorize the
Chair to sign. Seconded by Commissioner Cozad, the motion carried unanimously.
• 3) CONSIDER AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY,
PERMANENT EASEMENT, AND TEMPORARY CONSTRUCTION EASEMENT FOR CERTAIN
IMPROVEMENTS TO CR 49 AND AUTHORIZE CHAIR TO SIGN ALL NECESSARY DOCUMENTS -
DORTHY K. GURTLER TRUST: Bob Choate, Assistant County Attorney, presented the details of the
agreement for an impasse parcel and reported the total amount of the acquisition is $1,690.00.
Commissioner Conway moved to approve said agreement and authorize the Chair to sign all necessary
documents. Seconded by Commissioner Cozad, the motion carried unanimously.
• 4) CONSIDER AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY,
PERMANENT EASEMENT, AND TEMPORARY CONSTRUCTION EASEMENT FOR CERTAIN
IMPROVEMENTS TO CR 49 AND AUTHORIZE CHAIR TO SIGN ALL NECESSARY DOCUMENTS -
RUSSELL L. GURTLER JR. FAMILY TRUST AND DORTHY K. GURTLER TRUST: Mr. Choate reviewed
the details of the agreement for the total amount of$13,000.00. Commissioner Conway moved to approve
said agreement and authorize the Chair to sign all necessary documents. The motion was seconded by
Commissioner Moreno, and it carried unanimously.
• 5) CONSIDER REAPPOINTMENTS TO AREA AGENCY ON AGING: Commissioner Cozad
moved to approve said reappointments to the Area Agency on Aging Board. Seconded by Commissioner
Conway, the motion carried unanimously.
• 6) CONSIDER APPOINTMENT AND REAPPOINTMENTS TO REGIONAL COMMUNICATIONS
ADVISORY BOARD: Commissioner Conway moved to approve said appointment and reappointments
to Regional Communications Advisory Board. The motion was seconded by Commissioner Kirkmeyer,
and it carried unanimously.
• 7) SECOND READING OF CODE ORDINANCE #2016-01, IN THE MATTER OF REPEALING
AND REENACTING, WITH AMENDMENTS, CHAPTER 5 REVENUE AND FINANCE, OF THE WELD
COUNTY CODE: Commissioner Kirkmeyer moved to read Code Ordinance #2016-01 by title only. The
motion, which was seconded by Commissioner Conway, carried unanimously. Bruce Barker, County
Attorney, read the title for the record. Mr. Jiricek explained the code changes and stated there have
been no new changes since First Reading. No public testimony was offered concerning this matter.
Commissioner Conway moved to approve on Second Reading. The motion was seconded by
Commissioner Moreno, and it carried unanimously.
PLANNING OLD BUSINESS:
• 1) SECOND READING OF CODE ORDINANCE#2015-26, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING, OF THE WELD COUNTY CODE:

Commissioner Conway moved to approve Code Ordinance #2015-26 by title only. Seconded by
Commissioner Cozad, the motion carried unanimously. Mr. Barker read the title for the record. Tom
Parko, Director of the Department of Planning Services, requested this matter be continued to February
29, 2016, based on direction from the Commissioners. eHollis Berendt, resident of Greeley, stated
the County needs to look for alternative energy sources for future ways to promote alternative energy.
She expressed the County needs to use the same energy and commitment to the Solar Industry that they
give to the Oil and Gas Industry. (Clerk's Note: the testimony from Hollis Berendt, resident of Greeley, is
relevant to the discussion under item #2.) Commissioner Moreno moved to continue Second Reading to
February 29, 2016. Seconded by Commissioner Conway, the motion carried unanimously. Commissioner
Conway explained the reason for this continuance is in relation to the Colorado Oil and Gas Conservation
Commission. Commissioner Moreno thanked everyone involved for working with the stakeholders.
2) SECOND READING OF CODE ORDINANCE#2015-27, IN THE MATTER OF REPEALING AND
REENACTING, WITH AMENDMENTS, CHAPTER 23 ZONING, OF THE WELD COUNTY CODE:
Commissioner Kirkmeyer moved to read Code Ordinance#2015-27 by title only, and it was seconded by
Commissioner Cozad, which carried unanimously. Mr. Barker read the title for the record. = Michelle
Martin, Department of Planning Services, presented the proposed code changes that consist of changing
the definition of solar energy system and it has been divided into two (2) types: small and large. 0 The
Board discussed the issue of having a large facility in the Agricultural zone and there needs to be further
meetings. Commissioner Kirkmeyer expressed that it is confusing to refer to them to solar energy
systems. = Mr. Parko reported there are three (3) criteria to meet the requirements for an electric
transmission site. 0John Sullivan, representative of Sunshare displayed a map and read comments
from citizens that were unable to make the first and second reading. He would like to see the three (3)
megawatts reflect 24 acres because that is the space required to house a facility of that size. Mr. Sullivan
stated he has worked with staff concerning the size regulations. In response to Commissioner
Kirkmeyer's question, Mr. Sullivan responded that the State regulations are two (2) megawatts. El
Sharon Collins, resident of Johnstown, explained she is opposed to the code change, and stated it seems
counterintuitive to limit its potential expansion by dictating locations in the Agricultural zone.
Commissioner Cozad explained she didn't feel the audience understands that the County is trying to look
for other ways to support larger facilities on agricultural land, and the Board is trying to fit them into the
current USR process. She further stated staff and the Commissioners are trying to see how this can fit
into the agricultural zone. el Boyd Bivens, resident of Keensberg, stated he is in support of the code
change, because he is looking at this as an aid to oil production, as it will furnish electricity to 2 or 3 wells
and help reduce the size of the flares from the wells. David White, representative with Poudre Valley
REA, expressed he is opposed to how the code is written, and stated he has concerns with how it is
being defined as large and small. He stated he doesn't feel the Code is in the best interest of Weld
County. Mr. White stated solar can only compete with the other energy sources on a larger scale. El
Commissioner Kirkmeyer clarified the Right to Farm statement that is located on all plats. She explained
the Board is trying to accommodate the smaller facilities so they don't have to use a 1041 process for a
permit. = Mr. White stated he disagrees with the language use of small and large facilities.
Commissioner Kirkmeyer explained they look at the compatibility of the facility when voting on a USR
permit when considering locations in the Agricultural zone. eRon Asche, representative of United
Power, he admitted that he is not familiar with all of Weld County's rules and regulations of an application
for a solar facility. He doesn't support or oppose the code change because he doesn't understand the
code well enough. Mr. Asche expressed the importance of finding and developing rules that are
compatible with the Weld County code. —�' Dave Kisker, resident of Greeley, stated he is opposed to
the code because he doesn't want agricultural land rezoned to industrial because an industrial company

could come in and build something that could create a large impact on farm land. a Anita Comer,
resident of Johnstown, explained she understands the code ordinance better after attending the meeting
and is worried that solar is being discouraged as an alternative energy source for Weld County. a Sue
Thomas, resident of Johnstown, stated she is opposed to the way the code is written. eNadine Whirly,
resident of Greeley, expressed the County is over regulating solar, there are many residents who don't
have a roof conducive to house solar panels but there is a lot of a ricultural land to put solar facilities on.
She feels like there is a bias towards the oil and gas industry. PI Beverly Turner, resident of Kersey,
stated as a land owner she has a concern about the solar facilities, possibly being built next to her
residence. She understands that there are hazardous materials produced by the solar units. la Ken
Hall, resident of Windsor, reported he just installed a small ground mount system and would like the small
ground mount system added to the code. Commissioner Kirkmeyer explained that if the panels are being
used on site, and generating power on your site then there shouldn't be an issue. El Gary Guthman,
resident of Greeley, stated he has concerns about the language in the code with small and large facilities.
Richard Miller, representative for Clean Energ Collective, stated he would like to see staff use the
megawatt instead of the acerage requirement. = John Marcarelli, representative of Silicon Ranch
Corporation, stated he would like to have an arbitrary cap for three megawatts. a Commissioner
Kirkmeyer stated she would like to have the matter continued for March 7, 2016, because she feels staff
and the Board need to have more discussions concerning this code. = Commissioner Moreno agreed
with Commissioner Kirkmeyer because it is important to take more time to discuss this code.
Commissioner Cozad stated she appreciates everyone that presented their comments. Commissioner
Conway thanked everyone who took time out of their busy day to discuss this matter with the Board and
he feels there are too many unanswered questions. He would like to see more discussion concerning
this matter. El Chair Freeman stated there needs to be more dialogue with staff for the clarification of
the code. --' Commissioner Kirkmeyer moved to continue this matter to March 7, 2016, and
Commissioner Cozad seconded the motion. Upon a roll call vote the motion passed on a four to one vote
with Commissioner Conway opposed.
RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the
Consent Agenda. Code Ordinance #2016-01 and #2015-26 were approved on Second Reading.
Let the minutes reflect that the above and foregoing actions were attested to and respectfully submitted
by the Clerk to the Board.
