A public hearing was conducted on February 3 . 2016 . at 10: 00 a . m . , with the following present:

The following business was transacted :

. I hereby certify that pursuant to a notice dated December 31 . 2015, and duly published
January 5 . 2016 . in the Greeley Tribune , a public hearing was conducted to consider the request
of Daniel and Delene Davis , Jr. , for a Site Specific Development Plan and Use by Special Review
Permit. USR15-0066 , for any Use permitted as a Use by Right, Accessory Use , or Use by Special
Review in the Commercial or Industrial Zone Districts (parking , staging . storage and maintenance
of semi-trucks, trailers and a belly dump truck) , provided that the property is not a lot in an
approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any
regulations controlling subdivisions in the A (Agricultural) Zone District. Bob Choate . Assistant
County Attorney, made this a matter of record .
P Chris Gathman , Department of Planning Services , presented a brief summary of the
proposal and reviewed the proposed outbuilding . operation plan . hours of operation . and
surrounding USRs . He stated this Use would generate minimal traffic and would be partially
screened from State Highway 392 . Mr. Gathman stated the site is not located in the three (3) mile
referral area of any municipality or Cooperative Planning Area , but is in close proximity to the
unincorporated Town of Briggsdale . He explained the plan is to park the trucks behind the new
building . but until the building is constructed . the applicant is willing to screen the parked trucks
as suggested at the Planning Commission hearing . Mr. Gathman verified receiving a signed
application from Delene Davis . as there was some confusion between the Assessor records and

the deed. In response to Commissioner Conway, Mr. Gathman clarified the discussion at Planning
Commission regarding screening. He displayed images of the site and surrounding properties
and entered the favorable recommendation of the Planning Commission into the record, as
written.
▪ Wayne Howard, Planning Services Engineer representative, provided a brief overview of
the transportation plans and requirements and stated the site is accessed from State Highway 392
and the applicant has approval from the Colorado Department of Transportation (CDOT). He
stated there are no traffic counts available and the traffic narrative indicated a maximum of five (5)
semi-trucks, ten (10) trailers, one (1) belly dump truck and employee passenger vehicles on-site
daily. Mr. Howard stated no Improvements Agreement is required and he reviewed the tracking
control options and drainage exemption. He conveyed that CDOT has not requested any
additional improvements.
• Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions stating Briggsdale will provide water and the septic system will be installed when the
shop is constructed. She clarified the applicant can use a portable toilet and she stated
Development Standards (DS) #8-16 address Environmental Health items.
IR Sheri Lockman, Lockman Land Consulting, represented the applicant and stated the
screening issue came up at the Planning Commission hearing because the building was going to
be built quickly, but now there is a delay and the Planning Commission thought screening might
be appropriate. Ms. Lockman clarified the applicant is considering a chain link fence, which
questions the effectiveness of the screening.
Ci No public testimony was offered concerning this matter.
• Commissioner Conway suggested Condition of Approval (COA) #1.A.6 be deleted. The
Board agreed.
• In response to Chair Freeman, Ms. Lockman indicated no concerns or changes with the
Conditions of Approval or Development Standards.
• Commissioner Cozad corrected Development Standards (DS) #3, #4, and #5 to change the
wording from "per the applicant" to "per the application". The Board agreed. Commissioner
Conway suggested changing the maximum number of semi-trucks on DS #3 to match the
limitation per CDOT, which is six (6). The Board agreed.
la In response to Chair Freeman, Mr. Davis indicated they have reviewed, and agree to abide
by, the Conditions of Approval and Development Standards, as amended.
E Commissioner Conway moved to approve the request of Daniel Davis and Delene Davis,
Jr. for a Site Specific Development Plan and Use by Special Review Permit, USR15-0066, for any
Use permitted as a Use by Right, Accessory Use, or Use by Special Review in the Commercial
or Industrial Zone Districts (parking, staging, storage and maintenance of semi-trucks, trailers and
a belly dump truck), provided that the property is not a lot in an approved or recorded subdivision

plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in
the A (Agricultural) Zone District, based on the recommendations of Planning staff and the
Planning Commission, with the Conditions of Approval and Development Standards as amended
and entered into the record. The motion was seconded by Commissioner Moreno, and it carried
unanimously. There being no further discussion, the hearing was completed at 10:44 a.m.
This Certification was approved on the 8th day of February, 2016.
