RE: APPROVAL OF RECORDED EXEMPTION NO. 317 - MARK AND RUBY FIELDS.
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, pursuant to Colorado statute and the Weld County Home
Rule Charter, is vested with the authority of administering the
affairs of Weld County, Colorado, and
WHEREAS, it has been determined by the Board of County
Commissioners of Weld County, Colorado, at a public hearing held
on the 10th day of April, 1978 in the Chambers of the Board of
County Commissioners of Weld County, Colorado, that the division
into two parcels of a certain parcel of land, as shown on the
plat known as Recorded Exemption number 317 , being the property of
Mark and Ruby Fields, described as Part of the Ell of the NE4 of
Section 5, Township 6 North, Range 65 West of the 6th P.M. , Weld
County, Colorado, being more particularly described as follows :
A part of the East Half of the Northeast Quarter of Section
5, Township 6 North, Range 65 West of the 6th P.M. , Weld
County, Colorado, being more particularly described as fol-
lows:
Beginning at the Northeast corner of said Section 5, and
considering the North line of said Section 5 as bearing
North 88°43'44" West and all other bearings contained
herein relative thereto;thence North 88°43'44" West along the
North line of said Section 5, 759.70 feet; thence South
00°00'00" West, 286.70 feet; thence South 88°43'44" East
759.70 feet to a point on the East line of said Section 5;
thence North 00°00'00" East, along the Fast line of said
Section 5, 286.70 feet to the point of BRIINNING.
does not come within the purview of the definition of the terms ,
"subdivision" and "subdivided land" , pursuant to its authority
under Section 30-28-101 (10) (d) , CRS 1973 , as amended, and
WHEREAS, the Board of County Commissioners of Weld County,
Colorado, finds that this particular division of land is not
within the purposes of the Weld County Subdivision Regulations
and the Board desire to exempt this particular division of land
from the definition of "subdivision" and "subdivided land" pur-
suant to its authority under Section 30-28-101 (10) (d) , CRS 1973 ,
as amended, and Section 2-lA(3) of the Weld County Subdivision
Regulations.

NOW, THEREFORE, BE IT RESOLVED by the Board of County Com-
missioners of Weld County, Colorado, that the hereinabove described
parcel of land owned by Mark and Ruby Fields , be and hereby is,
exempt from the definition of the terms, "subdivision" and "sub-
divided land" pursuant to its authority under Section 30-28-101
(10) (d) , CRS 1973, as amended.
The above and foregoing Resolution was , on motion duly made
and seconded, adopted by the following vote on the 10th day of
April, A.D. , 1978.

RE : Recorded Exemption #317
Dear Commissioners :
The attached application , plat , and related items are in reference to
a request by Mark and Ruby Fields for a recorded exemption . The property
on which the recorded exemption is requested is described as Pt . of the
Ez of the NE4 of Section 5, T6N, R65W of the 6th p .m. , Weld County ,
Colorado. This property is located 1 3/4 mile east of the Town of Eaton.
The request is to split the property into parcels of 2.44 acres and 2. 56
acres .
On February 15, 1978, the Board of County Commissioners approved a request
by the Fields for a lot size variance so that they could make application
for this recorded exemption. At the time they made the decision on that
request , the Department of Planning Services staff submitted a letter of
recommendation to the Board. A copy of the letter of recommendation is
included in the attached packet . Nothing has been received by our office
which would change our recommendation of approval for this request as
outlined in a letter to the Board of County Commissioners dated February 15 ,
1978. This request complies with the provisions of Section 9-4(A) of the
Weld County Subdivision Regulations.

Subject: Permit for Recorded Exemption
Reason for Application: To better utilize east half of five acre plot
Land in this area is not fit for agriculture being seepy in some
spots and high in alkali. Residential growth has been rapid and in
the near future this area will probably be annexed by the Town of
Eaton.
Currently this land, which lies at the intersection of County
Roads 60 and 74, is vacant and no use is made of it. Because there
is no water with the land no crops or grass can be grown. reeds grow
during the summer creating an eyesore. A house, buildings and corrals
an: planned for the property which will improve the appearance of the
corner.
