THIS AGREEMENT is made this day of March, 2016, by and between and the County of Weld, a body corporate and politic f the State of Colorado, by and through its Board of County Commissioners, whose address is 1150 "O" Street, Greeley, Colorado 80631 hereinafter referred to as "County", and DCP MIDSTREAM, LP , a Delaware limited partnership, with Colorado offices at 370 17th Street, Suite 2500, Denver, CO 80202 , hereinafter referred to as "DCP". WITNESSETH : WHEREAS , County is constructing safety improvements on Weld County Road 49 (WCR 49), which includes the expansion of the travelled portion of the roadway and the public road right-of-way (ROW) (which project shall be referred to herein as the "WCR 49 Expansion Project" or "Project"), and WHEREAS , this Agreement is designed to supersede any rights between the parties as it relates to the placement of DCP ' s pipelines and facilities in the WCR 49 ROW, and WHEREAS , DCP owns and operates certain pipelines and facilities, some of which are located in the WCR 49 ROW, and some of which are located in permanent easements outside the ROW, and WHEREAS , DCP has agreed to relocate or abandon, at its sole expense, its energy pipelines and facilities located in the current WCR 49 ROW, into permanent easements purchased by DCP, which are to be located outside the current and future ROW, and WHEREAS , County has agreed to relocate or abandon, at its sole expense, DCP ' s energy pipelines and facilities located in permanent easements that are also in the future ROW, into permanent easements purchased by the County, which are to be located outside the current and future ROW, and WHEREAS , the Parties agree to share costs related to the relocation and abandonment of DCP ' s pipelines and facilities which are in some cases, located outside the Project corridor, for the mutual financial benefit of both Parties, as specified herein, and NOW, THEREFORE, in consideration of the covenants contained herein and the agreements of the parties to be performed hereunder, and upon the conditions herein stated, the parties agree as follows. 1 . RESPONSIBILITY FOR COSTS . DCP shall be solely responsible for all costs associated with the relocation or abandonment of DCP facilities or pipelines located in the current ROW, including the acquisition of any necessary permanent easements. County shall be solely responsible for all costs associated with the relocation or abandonment of DCP facilities or pipelines currently located in permanent easements outside of the current ROW, including the acquisition of permanent easements for DCP ' s benefit. Nothing herein shall preclude the parties from negotiating changes to this 2016- 1148 Y responsibility for costs on a case-by-case basis, as long as such changes are expressly agreed to in writing, for the benefit of both parties . If a change in responsibility for costs is not clear, the responsibility for costs as outlined in this paragraph shall apply. County shall only be responsible for DCP ' s actual costs. DCP shall invoice the County' s Design- Build Contractor, Interstate Highway Construction (IHC) for costs actually incurred after the relevant work has been completed . IHC will pay all undisputed invoices within thirty (30) days of receipt, but in no case shall IHC be required to pay an invoice prior to ten days after receipt of said funds from County' s utility relocation force account. 2 . EXHIBITS . a. Exhibit A (Summary of Cost Distribution — Mile by Mile) provides details of which Party is responsible for specified costs, as outlined on a mile-by-mile basis. b . Exhibit B (Relocation Diagram) provides details of which DCP facilities and pipelines will be relocated or abandoned, on a mile-by-mile basis . Notwithstanding what is shown in Exhibits A and B, if it is determined, by field locates or otherwise, that a facility or pipeline is actually located in the current ROW, DCP shall be responsible for associated costs under this Agreement. Likewise, if it is determined that a facility or pipeline is actually located outside the current ROW in a permanent easement, County shall be responsible for associated costs under this Agreement. In such case, the Parties will negotiate an equitable distribution of costs based on amount of lineal feet located within or outside of the ROW . 3 . RIGHT OF WAY. a. CURRENT RIGHT OF WAY. Current Right--of- Way/ROW refers to the ROW located adjacent to WCR 49 as it existed prior to the acquisition of any additional ROW by the County related to the Weld County Road 49 Corridor Expansion Project (the "Road Project") . b . FUTURE RIGHT OF WAY. Future Right-of- Way/ROW refers ROW in addition to current ROW which County has acquired as necessary or appropriate for the Road Project. 4. REMOVAL OF PIPELINE FROM CURRENT AND FUTURE RIGHT OF WAY. DCP agrees to remove or if appropriate abandon with county approval, all energy pipelines within the current and future ROW, according to a mutually agreeable schedule. Such schedule shall be mutually agreed upon by County, DCP, and IHC as described in individual work orders . Each work order relating to DCP facilities shall be signed by a representative of (a) County, (b) DCP , and (c) IHC. Except according to the express 2 terms of a work order signed by DCP, DCP shall have no less than thirty (30) days to relocate a facility as described in a work order. DCP is responsible for removal costs for all DCP facilities located within existing county ROW. 5 . ABANDONMENT OF PIPELINE. For any pipeline which is scheduled for relocation, the County shall, upon specific request of DCP, determine in writing, in its sole discretion, whether pipeline may be abandoned or shall be removed. Any portion of pipeline which is approved for abandonment shall be flash filled ( 100% of pipe diameter) with flash fill mix resin approved in advance by County, or abandoned in an alternate manner approved by the county engineer' s office. County personnel shall inspect the relevant portion of abandoned pipeline to verify compliance. DCP shall return the property to its original condition, or as otherwise agreed by the County. 6. RELOCATION / CONSTRUCTION OF NEW PIPELINE UNDER ROADWAY. DCP may relocate/construct energy pipeline(s) under the roadway within the WCR 49 ROW as described with specificity in Exhibits A and B . Any such relocation must be completed according to the mutually agreed upon schedule as described in Section 4, above. a. Prior to Project paving, all pipelines installed perpendicular to and under the road and any roadside ditch shall be installed a minimum of ten ( 10) feet deep to the top of the pipe from the lowest flow line of said roadside ditch. DCP may trench such line, but in such case DCP shall be financially responsible to remediate any grade preparation work that has already been performed at such location, if any. b. After Project paving has been installed at the relevant location, all pipelines installed perpendicular to and under the road and any roadside ditch shall be installed a minimum of twenty (20) feet deep to the top of the pipe from the lowest flow line of said roadside ditch. Once Project paving has occurred, no road cuts will be permitted for any reason. Any pipeline that must cross under the road after Project paving has occurred must be bored. c. DGP shall be required to obtain a ROW Permit for any work in the ROW. 7 . COOPERATION. DCP shall cooperate with County and/or IHC (or any subcontractor), so as to ensure that the Road Project is not delayed due to any action taken by DCP pursuant to this Agreement. 8 . LIQUIDATED DAMAGES . Both parties expressly recognize that DCP ' s failure to comply with the timelines required herein may result in substantial financial damages to County, which are impossible to determine at this time. Therefore, in an effort to compensate the County for such damages, and not to punish DCP in any way, the parties agree that : 3 a. In the event that DCP fails to relocate or abandon pipeline in place according to this Agreement and the schedule agreed upon as described in Section 4, the County shall provide DCP with at least 14 days ' notice to comply with the schedule. In the event DCP fails to comply with the schedule within such 14-day period, DCP shall be required to compensate the County for the greater of 100 percent of any costs passed through from IHC as a result of delays caused by DCP , or $ 5 ,000 per day per mile (or portion thereof) of pipeline which remains in the current or future ROW beyond the applicable relocation date, unless abandonment has been authorized by County pursuant to paragraph 3 . 9 . FORCE MAJEURE . a. Suspension of Performance. If either party is rendered unable, wholly or in part, by Force Majeure to carry out its obligations under this Agreement, other than to make payments due, the obligations of that party, so far as they are affected by Force Majeure, will be suspended during the continuance of any inability so caused, but for no longer period . b . Force Majeure Definition. "Force majeure" means fire, explosion, action of the elements, strike, interruption of transportation, rationing, shortage of labor, equipment, or materials, court action, illegality, unusually severe weather, act of God, act of war, or any other cause that is beyond the control of the party performing work on a design-build transportation or utility relocation project and that could not have been prevented by the party while exercising reasonable diligence. 10 . INDEMNIFICATION. Except for the negligence of County, DCP shall indemnify and save harmless County, its successors, assigns, employees, and agents from any damage or loss sustained by them or any of them to the extent caused by DCP ' s negligence with respect to the maintenance and/or use of the ROW. Except for the negligence of County, DCP agrees to protect County and save and hold it harmless from any and all third party claims and damages that said maintenance and/or use may directly or indirectly cause to the extent attributable to the negligence of DCP . DCP hereby releases County, its successors, assigns, employees, and agents from any and all claims and damages of whatsoever character to said ROW by DCP resulting from any act, either on the part of the County or on the part of any third party. 11 . ASSIGNMENT. Other than assignments in connection with the mortgage or sale of all or substantially all of the DCP ' s assets or equity interests in DCP, for which no consent shall be required, DCP shall not assign any or all of its rights under this Agreement without first obtaining written consent to such assignment from County, which consent shall not be unreasonably withheld. 4 12 . ENTIRE AGREEMENT. The parties hereby agree that neither has made or authorized any agreement with respect to the subject matter of this instrument other than expressly set forth herein, and no oral representation, promise, or consideration different from the terms herein contained shall be binding on either party hereto, or its agents or employees. This Agreement embodies all agreements between the parties hereto and there are no promises, terms, conditions, or obligations referring to the subject matter whereof other • than as contained herein. • 13 . SEVERABILITY. If any term or provision of this Agreement, or the application thereof y to any person or circumstances shall, to any extent, be held invalid or unenforceable, the remainder of this Agreement, or the application of such terms or provisions, to a person or circumstances other than those as to which it is held invalid or unenforceable, shall not be affected, and every other term and provision of this Agreement shall be deemed valid and enforceable to the extent permitted by law. 14 . NO WAIVER. No portion of this Agreement shall be deemed to constitute a waiver of any immunities the parties or their officers or employees may possess, nor shall any portion of this Agreement be deemed to have created a duty of care which did not previously exist with respect to any person not a party to this Agreement. 15 . NO THIRD PARTY BENEFICIARY. It is expressly understood and agreed that, except for those provisions which by their nature are intended to benefit IHC, the enforcement of the terms and conditions of this Agreement, and all rights of action relating to such enforcement, shall be strictly reserved to the undersigned parties and nothing in this Agreement shall give or allow any claim or right of action whatsoever by any other person not included in this Agreement. It is the express intention of the undersigned parties that any entity other than the undersigned parties receiving services or benefits under this Agreement shall be an incidental beneficiary only. 16 . GOVERNMENTAL IMMUNITY. No term or condition of this contract shall be construed or interpreted as a waiver, express or implied, of any of the immunities, rights, benefits, protections or other provisions, of the Colorado Governmental Immunity Act § 24- 10- 101 et seq. , as applicable now or hereafter amended. 17 . BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY APPROVAL. This Agreement shall not be valid until it has been approved by the Board of County Commissioners of Weld County, Colorado or its designee. 18 . CHOICE OF LAW/JURISDICTION. Colorado law, and rules and regulations established pursuant thereto, shall be applied in the interpretation, execution, and enforcement of this Agreement. Any provision included or incorporated herein by reference which conflicts with said laws, rules and/or regulations shall be null and void. 5 In the event of a legal dispute between the parties, DCP agrees that the Weld County District Court shall have exclusive jurisdiction to resolve said dispute. 19 . ATTORNEYS FEES/LEGAL COSTS. In the event of a dispute between County and DCP, concerning this Agreement, the parties agree that each party shall be responsible for the payment of attorney fees and/or legal costs incurred by or on its own behalf. 20 . BINDING ARBITRATION PROHIBITED. Weld County does not agree to binding arbitration by any extra-judicial body or person. Any provision to the contrary in this Agreement or incorporated herein by reference shall be null and void. 21 . NOTICE : Any notice required by this Agreement shall be delivered by: (a) personal service, as authorized by the Colorado Rules of Civil Procedure; (b) overnight delivery by a nationally recognized courier service; or (c) certified or registered mail, return receipt requested (which shall be deemed delivered three (3 ) days after deposit in the U . Between WCRs 22 and 24 : • County shall purchase from A . Dechant, for the benefit of DCP, a 25 foot wide permanent non-exclusive easement for two pipelines, located on the west side of CR49 generally in the north 280 feet of the NE 1 /4/4 of Section 12, T2N, R65W. • County shall reimburse DCP for the cost removal of DCP ' s current pipelines, and installation of two new lines of the same size in the new permanent easement. • County has acquired an Agreement from Pioneer Communities Holdings LLC , for the benefit of DCP, a 40 foot wide permanent non-exclusive easement for two pipelines, located on the east side of CR 49 generally located on the north half of Section 7 , T2N, R64W. Between WCRs 24 and 26 : • The Parties do not need any contribution of costs or work for this section. Between WCRs 26 and 28 : • County shall purchase from Dechant Farms, for the benefit of DCP, a 30 wide permanent non-exclusive easement approximately 3 , 100 lineal feet located on the west side of CR 49 generally in the north half of Section 36, T3N , R65W. • County shall reimburse DQP for the cost of removal of DCP ' s current pipelines ; one 3 " and one 4" for approximately 5 ,075 feet located on the west side of CR 49 generally located in the north half of Section 36, T3N, R65W . Additionally, County shall reimburse DCP for costs associated with relocating valve generally relocated in the SE IA of Section 36, T3N , R65W . • County shall reimburse DCP for the cost of installation of a new 6" line in the new permanent easement generally located in the north half of Section 36, T3N, R65W and for costs associated with gathering production from the east side of WCR 49 to tie into the new 6" line. • County shall reimburse DCP for the cost of removal of DCP ' s 4" pipeline for approximately 2 , 100 feet located on the A. Dechant property located on the east side of WCR 49 generally located in the SW 1/ of Section 31 , T3N, R64 W . • County shall reimburse DCP for the cost of removal of one DCP 3 " pipeline for approximately 1 ,900 ' located on the Dechant Farms property located on the west side of WCR 49 generally located in the SE 1/ of Section 36, T3N, R65W . • County shall reimburse DCP for the cost of removal of one DCP 3 " pipeline for approximately 985 ' on the A. Dechant property on the east side of WCR 49 generally 9 located in the NW % of Section 31 , T3N, R64 W. • County shall not be required to acquire any easement on behalf of DCP in Section 31 , T3N, R64W . Between WCRs 28 and 30 : • County shall purchase from Moser, for the benefit of DCP , a 30 wide permanent non- exclusive easement with a valve site approximately 5,300 lineal feet located on the west side of CR 49 in Section 25 , T3N, R65W. • County shall reimburse DCP for the cost of installation of a new 6" line and two valve relocations in the new permanent easement on the west side of CR 49 in Section 25 , T3N, R65W. • County shall reimburse DCP for the costs of removal of DCP ' s two current valve sites and two pipelines located on the west side of CR 49 ; one 3 " and one 4" for approximately 5 , 170 feet each. Between WCRs 30 and 32 : • County shall purchase from Gurtler, for the benefit of DCP, a valve site easement approximately 150' x 100 ' on behalf of DCP , as depicted in the Gurtler ROW Agreement. • County shall reimburse DCP for the relocation of valve site into the new easement and the cost to relocate approximately 350 ' of 4-inch pipe associated with said valve relocation. • County shall purchase from Ten Hand Trust, for the benefit of DCP a 30 ' wide non- exclusive easement approximately 2, 800 lineal feet located on the east side of CR 49 generally in the north half of Section 19,T3N, R64W . • County shall reimburse DCP for the relocation of those portions of the existing 4-inch pipeline along east side of WCR 49 in Sectionl 9, T3N, R64W to the extent they are located within the future right of way. DCP may coordinate co-location with United Power for those portions where the existing 4" line may not need relocation. County shall not reimburse DCP for any change to a pipeline which does not require relocation. Between WCRs 52 and 34 : • The Parties do not need any contribution of costs or work for this section. • DCP shall identify any remove at its own cost any existing or abandoned lines in current right of way. Between WCRs 34 and 36 : • The Parties do not need any contribution of costs or work for this section. • DCP shall identify and remove at its own cost any existing or abandoned lines in current right of way. 10 • Between WCRs 36 and 38 : • DCP shall remove or abandon at its own cost approximately 3 , 245 ' of 3 -inch pipeline located in the east right of way in Section 6, T3N, R64W as well as approximately 660 ' of 4-inch pipeline located in the NW '/ of Section 1 , T3N-R65W. • County shall reimburse DCP for the cost of removal of DCP ' s current 3 " pipeline located on the west side of County Road 49 ; approximately 310 feet. • DCP shall inquire to Noble Energy as to their plans regarding the Tank Batteries located on the adjacent properties owned by Shelton Land & Cattle and Houndskeeper LTD , respectively. If Noble intends to plug and abandon such Tank Batteries, County shall have no requirement to pay for the installation of a new pipeline, nor to acquire a new easement. Between WCRs 38 and 40 : • County shall reimburse DCP for the removal of the Valve Site located at the northwest corner of the intersection of WCRs 38 and 49, on the State of Colorado ' s property in the SE '/ Section 36, T4N, R65W. County shall not be required to acquire any permanent easement in this location. Between WCRs 40 and 42 : • DCP shall identify and remove or abandon, at its own cost, pipeline(s) located within the current right of way, including but not limited to approximately 5 ,280 ' of 4-inch pipe located in the west right-of-way in Section 25 , T4N, R65W. • County shall purchase from Heartland Biogas, for the benefit of DCP , a valve site easement approximately 100 ' x160 ' located on the west side of CR 49 generally in the southeast corner of Section 25 , T4N, R65W . • County shall reimburse DCP for the cost of removal and the re-installation of valve site into the new permanent easement. • County shall reimburse DCP for the removal of the Valve Site located on the southeast • corner of the intersection of WCRs 42 and 49, located on the Perez property. Between WCRs 42 and 44 : • DCP shall identify and remove or abandon, at its own cost, any existing or abandoned lines in current right of way including but not limited to a 4-inch pipeline in the west right of way. • The Parties do not need any contribution of costs or work for this section. Between WCRs 44 and 46 : As provided by DCP in the email dated October 5 , 2015 , Weld County agrees to DCP ' s option 2 cost estimate as depicted in Exhibit B and described below 11 • DCP shall identify and remove or abandon, at its own cost, any existing or abandoned lines in current right of way. • County shall purchase from Noble Energy, for the benefit of DCP, a 20 wide permanent non-exclusive easement approximately 1 ,318 feet lineal feet located east and adjacent to CR 49 as depicted in Exhibit B generally in the NW 1 /4/4 of Section 18, T4N, R64W; said easement shall include verbiage allowing DCP to install one additional pipeline within the permanent easement. • County shall reimburse DCP for the cost of removal of DCP ' s current pipelines ; two 3 " and one 6". • County shall reimburse DCP for costs associated with installing one 6" pipeline in new permanent easement on the Noble Energy property. • The County shall also be responsible for reimbursing DCP for costs associated with tying existing production east and west of CR 49 to new 6" line on the Noble Energy property. • On the Ensign property, and that portion of the Noble Energy property which abuts the south side of WCR 46, County shall reimburse DCP for ( 1 ) the installation of approximately 400 feet of 6-inch pipeline, (2) a Receiver Site connected to such 6-inch pipeline, (3 ) approximately 100 feet of 3 -inch pipeline, (4) a Receiver Site connected to such 3 -inch pipeline, and (5) connection of the 3 -inch and the 6-inch pipelines to the currently existing 8-inch pipeline; all of which are detailed with particularity in Exhibit B . County shall not be required to acquire any permanent easements for the benefit of DCP in this section but will be responsible for reimbursing DCP for costs associated with right-of-way acquisition, damage compensation, and any permit and or license acquisition. County shall reimburse DCP for the cost of removal of approximately 1 , 800 ' of 3 " pipeline located in the SW ' 4 Section 18, T4N-R64W (located north of Farr # 1 & 18- 14 tank battery. Between WCRs 46 and 48 : As provided by DCP in the email dated October 9, 2015 , Weld County agrees to DCP ' s option 2 cost estimate as depicted in Exhibit B and described below : • DCP shall identify and remove or abandon, at its own cost, pipeline(s) located within the current right of way, including but not limited to approximately 2,950 ' of 4-inch pipe located in the west right of way in Section 12, T4N, R65W . • To the extent that DCP ' s pipelines located on the east side of WCR 49 between WCRs 46 and 48 are outside of the current ROW, County shall reimburse DCP for the removal of approximately 5 ,280 feet of 3 -inch pipeline and 5 ,280 feet of 6-inch pipeline. DCP shall field locate its pipelines in this section for the benefit of County. County shall not be required to acquire any permanent easements for the benefit of DCP in this section. • County shall reimburse DCP for the removal of the Valve Sites located at the southeast corner of the intersection of WCRs 48 and 49, located on the Wright-Goin property. • County shall reimburse DCP for the removal of the Valve Site located at the northwest corner of the intersection of WCRs 46 and 49, located on the Johnson property. 12 Between WCRs 48 and 50 : As provided by DCP in the email dated October 15 , 2015 , Weld County agrees to DCP ' s option 2 cost estimate as depicted in Exhibit B and described below : • DCP shall identify and remove or abandon, at its own cost, pipeline(s) located within the current right of way, including but not limited to approximately 5 ,280 feet of 6-inch pipeline located in the current ROW on the west side of WCR 49 between WCRs 48 and 50. • County shall reimburse DCP for the removal of the 4-inch pipeline and associated valve site located outside the current ROW on the west side of WCR 49 between WCRs 48 and 50 . • County shall reimburse DCP for the installation of approximately 1 ,300 feet of new 3 - inch pipeline from the "Dinner 6- 1 & 6-3 Tank Battery" to the "Dinner 6-2 Tank Battery" located on the Dinner Coalview property east of WCR 49, and connected to the 4-inch "Todd" pipeline located at the "Dinner 6-2 Tank Battery". • County shall reimburse DCP for the installation of a Block Valve where the 4-inch "Todd" pipeline intersects with WCR 48 , on the east side of WCR 49 . • County shall reimburse DCP for the installation of approximately 100 feet of 3 -inch pipeline between the "Muirhead Tank Battery" on Dinner Coalview property on the west side of WCR 49 in Section 1 , T4N-R65W, and the connection of said line to the 4-inch pipeline north of and adjacent to WCR 48 . • County shall reimburse DCP for the installation of a 3 -inch Pig Launching Station at the "Cobb 6-23 Tank Battery" located on the Cobb property east of WCR 49 . • County shall reimburse DCP for the installation (boring) of approximately 2261 ' feet of 3 - inch line under the Neres Canal, thereby connecting the "Ard 11 -6 & 6-314" and "Ard C6-3JI" tank batteries. • County shall reimburse DCP for the removal of approximately 950 feet of 3 -inch pipeline that runs west from the "Ard 11 -6 & 6-314" tank battery and ties to the 4" pipeline located in a private easement on the west side of WCR 49 (in the NE 'A Section 1 , T4N, R65W. . • County shall reimburse DCP for costs associated with removing the Valve Site located at the southwest corner of the intersection of WCRs 50 and 49, on the Smith property in the NE 'A Section 1 , T4N, R65W. • County shall not be required to acquire any permanent easement for the benefit of DCP in this section but will be responsible for reimbursing DCP for costs associated with right- of-way acquisition, damage compensation, and any permit and or license acquisition. Between WCRs 50 and 52 : As provided by DCP in the cost estimate dated November 10, 2015 , Weld County agrees to option 1 as depicted in Exhibit B and described below : • DCP shall identify and remove or abandon, at its own cost, pipeline(s) located within the 13 current right of way, including but not limited to approximately 5 ,280 feet of 6-inch pipeline located in the current ROW on the west side of WCR 49 between WCRs 50 and 52 . • County shall reimburse DCP for removal of approximately 5 ,280 feet of 4-inch pipeline located in private easement along west side of WCR 49 (estimated cost $ 117 ,716) . • County shall reimburse DCP for installation of approximately 1 , 700 feet of 6-inch pipe with Launcher/Receiver to connect State Schmidt wells-station numbers 221288 , 227485 , 227486, 30898 (estimated cost $ 117 , 305). • County shall reimburse DCP for installation of approximately 1 ,600 feet of 6-inch pipe with Launcher/Receiver to connect Thistle Down wells-station numbers 307894, 221298 , 22894 (estimated cost $ 111 ,398) • County shall reimburse DCP for installation of approximately 1 , 100 feet of 6-inch pipe to tie State Schmidt and Thistle Down production to 20" pipeline on Schmidt property (estimated cost $ 64,977) . • County shall not be required to acquire any permanent easement for the benefit of DCP in this section but will be responsible for reimbursing DCP for costs associated with permanent easement acquisition, damage compensation, and any permit and or license acquisition. DCP will provide any alignments or legal descriptions of proposed permanent easements in advance of acquisition. • County shall reimburse DCP for costs associated with meter and or pipeline relocation deemed necessary per Weld County Building Department setback requirements, on the Noble tank battery location in the NW Section 31 , T5N, R64W . County will be responsible for reimbursing DCP for costs associated with permanent easement acquisition, construction, damage compensation, and any permit and or license acquisition related to extending the 4" pipeline located in the SW '/ of Section 30, 5N- 64W, south, to tie to the 8" pipeline (private easement recorded at reception #2328125 ) located in the NW 'A of Section 31 , 5N-64W. Between WCR 52 and WCR 54 • DCP shall identify and remove or abandon, at its own cost, pipeline(s) located within the current right of way, including but not limited to approximately 5 ,280 ' of 6-inch pipe located in the west right-of-way in Section 25 , T5N, R65W. • County has acquired an easement for DCP in accordance with Exhibit B . • County shall reimburse DCP for the removal and installation of approximately 1 , 150 feet of existing 4-inch pipeline on the east side of WCR 49 .
