HomeMy WebLinkAbout760306.tiff 1 RESOLUTION WHEREAS, a hearing was held on February 18, 1976, in the chambers of the Board of County Commissioners, Weld County, Colorado, for the pur- pose of hearing the petition of Arvada Colorado Stake, Church of Jesus Christ of Latter Day Saints, c/o John W. Creer, 3184 Routt Street, Lakewood, Colorado, requesting permission for expansion of an existing dairy farm operation on the following described property, to-wit: A parcel of land in the North Half (N 2) of the Southeast Quarter (SEQ) of Section 16, Township 1 North, Range 66 West, 6th Principal Meridian, Weld County, Colorado, and being more particularly described as follows: Beginning at the East One Quarter Corner (E4Cor) of Section 16, which is the measured mid-point of the East line of Section 16; Thence South along the East line of Section 16 a distance of 1320 feet, more or less; Thence West along established section and fence line, 2640 feet, more or less; Thence North along center of section line and established fence line, 1320 feet, more or less; Thence East along center of section line and established fence line 2640 feet, more or less to point of beginning; Containing 80 acres, more or less, and WHEREAS, the petitioner was present, and WHEREAS, there was no opposition to the request of petitioner to expand said dairy farm operation on the above described premises, and WHEREAS, the said requested expansion of an existing dairy farm operation is located in an Agricultural Zone as set forth by the Weld County Zoning Resolution, and WHEREAS, according to Section 3. 3 E (3) of the Zoning Resolution of Weld County, said dairy operation or any expansion thereof may be authorized upon the approval of the Board of County Commissioners of Weld County, and WHEREAS, the Board of County Commissioners heard all the testimony and statements of those present; has studied the request of the petitioner and studied the recommendations of the Weld County Planning Commission, and having been fully informed; NOW, THEREFORE, BE IT RESOLVED, by the Board of County com- missioners, that the application of Arvada Colorado Stake, Church of Jesus Christ of Latter Day Saints, c/o John W. Creer, 3184 Routt Street, Lakewood, Colorado, for expansion of an existing dairy farm operation on the premises indicated above be, and it hereby is granted under the conditions following: 1. That any water and sanitation facilities to be installed shall be approved by the State Health Department. 2. That petitioner shall proceed with due diligence to effect expansion of said dairy operation and shall have up to one year from date hereof to begin expansion of same; otherwise, the Board may, for good cause shown, on its own motion, revoke the permit herein granted. 0(--2 .,-:•'-' ✓!£ '' 3. THE WELD COUNTY PLANNING COMMISSION STAFF RECOMMENDS THAT THIS REQUEST BE tabled FOR THE FOLLOWING REASONS : until such time as the applicant provides written proof of an adequate water supply for the dairy operation; the domestic well permit referred to in the application is not intended for use by a 300-head dairy operation. When proof of an adequate water supply for a 300-head dairy has been sub- mitted to the Planning Commission and approved by the Ground Water section of the State Division of Water Resources, this application will be recommended for approval for the following reasons: 1 . Complies with the Comprehensive Plan in that "the expansion and develop- ment of agri-business and agriculturally oriented industry will be encouraged, provided these enterprises do not adversely affect the total economy or environment." 2. Weld County Environmental Health Services indicate that the existing facility can be expanded to 300 head and meet all applicable County and State health regulations. 3. The proposed use is compatible with surrounding agricultural uses. Creer DISCUSSION: Church originally purchased farm of 80 acres to develop a heard of dairy cows. Dairy farm would provide commodities as well as work to those people who are inable to obtain commodities otherwise. Now wishes to increase herd to 200, and later to • 300. Would be no addition to barn; only to the corral , bunkspace, and windbreak. Weld County Planning staff recommended that request be tabled until such time as the applicant provides written proof of an adequate water supply for the dairy operation; the domestic well Permit referred to in the application is not intended for use by a 300-head dairy operation. When proof of an adequate water supply for a 300-head dairy has been submitted to the Planning Commission and approved by the Ground Water section of the State • Division of Water Resources, this application will be recommended for approval for the following reasons: 1 ) Complies with the Compre- hensive Plan in that "the expansion and development of agri-business and agriculturally oriented industry will be encouraged, provided these enterprises do not adversely affect the total economy or environment. " ; 2) Weld County Environmental Health Services inaicate that the exist- • ing facility can be expanded to 300 head and meet all applicable County and State health regulations; and 3) the proposed use is compatible with surrounding agricultural uses. CONDITIONS: 1 ) that the dairy operation be limited to the plans and development standards submitted; and 2) that the operation comply with State health and water quality standards. Proof of adequate water supply, was provided prior to meeting . Letter of objection from John J , Stamm was read into record. However, was pointed out that he had signed petition in support of request, Heitman Pointed out that this would be classified as a feedlot and that wastes would be considerably more with the addition of 200 or 300 cows . Glenn Paul stated that he had-no problems with lagoon requirements , Heitman 1239 was advised by Chairman of Ft. Lupton Planning Commission that Ft. Lupton Planning Commission was in favor of this recuest. RESOLUTION: Be it therefore resolved to recommend to the Weld County Board of County Commissioners approval of SUP 2.95, expansion of a dairy operation, subject to staff recommendations.
