HomeMy WebLinkAbout20160113.tiff RECORD OF PROCEEDINGS MINUTES BOARD OF COUNTY COMMISSIONERS WELD COUNTY, COLORADO JANUARY 11, 2016 The Board of County Commissioners of Weld County, Colorado, met in regular session in full conformity with the laws of the State of Colorado at the regular place of meeting in the Weld County Administration Building, Greeley, Colorado, January 11, 2016, at the hour of 9:00 a.m. • ROLL CALL: The meeting was called to order by the Chair and on roll call the following members were present, constituting a quorum of the members thereof: Commissioner Mike Freeman, Chair Commissioner Sean P. Conway, Pro-Tem Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer- EXCUSED Commissioner Steve Moreno - EXCUSED Also present: County Attorney, Bruce Barker Acting Clerk to the Board, Stephanie Frederick Controller, Barbara Connolly • MINUTES: Commissioner Conway moved to approve the minutes of the Board of County Commissioners meeting of January 6, 2016, as printed. Commissioner Cozad seconded the motion, and it carried unanimously. • CERTIFICATION OF HEARINGS: Commissioner Cozad moved to approve the Certification of Hearings conducted on January 6, 2016, as follows: 1) USR15-0054 — Nevin Byler, Karen Byler, and Jalynn Byler; 2) USR15-0024 — Legacy Farm, LLC; 3) USR15-0060 — Gerardo Cervantes and Nancy Garcia, do Leonel Ornelas. Commissioner Conway seconded the motion, which carried unanimously. • AMENDMENTS TO AGENDA: There were no amendments to the agenda. • CONSENT AGENDA: Commissioner Cozad moved to approve the Consent Agenda as printed. Commissioner Conway seconded the motion, and it carried unanimously. PRESENTATIONS: • 1) RECOGNITION OF SERVICES, WELD COUNTY FAIR BOARD - BILL RAINS AND TERI SEGELKE: Chair Freeman read the certificate recognizing Bill Rains and Teri Segelke for their service with the Fair Board. Chair Freeman stated this is a huge time commitment. Commissioner Conway accepted his certificate, and thanked Mr. Houtchens for his time and service to the Board and commitment to fulfill his responsibilities. • 3) RECOGNITION OF SERVICES, FAITH PARTNERSHIP COUNCIL -TREVOR COLLINS AND TODD WELCH: Chair Freeman read the certificate recognizing Trevor Collins and Todd Welch for their years of service with the Faith Partnership Council. Commissioner Cozad expressed her appreciation for their hard work and commitment to the Council and thanked them for their time. • 4) RECOGNITION OF SERVICES, FAMILIES, YOUTH AND CHILDREN COMMISSION - JOSEPH BODINE: Chair Freeman read the certificate recognizing Joseph Bodine for his years of service with the Families, Youth and Children Commission. Commissioner Conway expressed his appreciation for his many years of service working with the Families, Youth and Children Commission. Commissioner Cozad extended her thanks for his dedication to the children. • 5) GOVERNMENT FINANCE OFFICERS ASSOCIATION (GFOA), CERTIFICATE OF ACHIEVEMENT FOR EXCELLENCE IN FINANCIAL REPORTING - BARBARA CONNOLLY, CONTROLLER, AND WELD COUNTY ACCOUNTING STAFF: Chair Freeman read the certificate recognizing Barb Connolly and the accounting staff for their outstanding service. Ms. Connolly stated this is the 34th year of receiving this award and introduced her staff. Commissioner Cozad extended her congratulations, and stated what an important role Accounting plays. Commissioner Conway stated this is a very high recognition to receive. Chair Freeman extended his congratulations to the team. (Clerk's Note: Meeting was paused for a photo opportunity.) • PUBLIC INPUT: No public input was given. BIDS: 1) RESCISSION OF AWARD AND NEW BID APPROVAL #B1500189, DIESEL DUAL FUEL CONVERSIONS (CNG QTY. 2) - DEPARTMENT OF PUBLIC WORKS: Trevor Jiricek, Director of General Services, requested the Board rescind the bid from Stewart and Stevenson Power Products, LLC, and award the bid to Rush Truck Center. Jay McDonald, Director of Department of Public Works, explained he reviewed the new vendor and feels they meet the standards. Commissioner Conway moved to rescind the bid from Stewart and Stevenson Power Products, LLC, and award the bid to Rush Truck Center. The motion was seconded by Commissioner Cozad, and it carried unanimously. ki 2) PRESENT BID#B1500203, PARKING LOT LIGHTING UPGRADES, VARIOUS LOCATIONS- DEPARTMENT OF BUILDINGS AND GROUNDS: Mr. Jiricek reported five (5) bids were received and staff will make a recommendation on January 25, 2016. El 3) PRESENT BID #B1500193, HR402 -WELLNESS PROGRAM PORTAL - DEPARTMENT OF HUMAN RESOURCES / DEPARTMENT OF INFORMATION TECHNOLOGY: Staci Datteri-Frey, Department of Human Resources, presented the four (4) bids and stated staff will make a recommendation on January 25, 2016. OLD BUSINESS: • 1) CONSIDER PETITION AND AUTHORIZE VACATION OF A PORTION OF CR 61 - ROBERT AND RODNEY WILSON (CON'T FROM 11/23/2015): Frank Haug, Assistant County Attorney, stated this has been continued several times in order to sort out ownership of the land and make sure the rights to the road were properly recorded. He displayed slides showing the parcel and the right-of-way. Mr. Haug explained that the owner is going to deed the right-of-way to Weld County and Public Works doesn't have any issues with the vacation. Commissioner Conway expressed this is necessary to clear up a surveying mistake. No public testimony was offered concerning this matter. Commissioner Conway moved to approve said vacation of County Road 61. Seconded by Commissioner Cozad, the motion carried unanimously. Minutes, January 11, 2016 2016-0113 Page 4 BC0016 NEW BUSINESS: el 1) CONSIDER ACCEPTANCE OF QUIT CLAIM DEED FOR PUBLIC RIGHT-OF-WAY AT PRESENT PHYSICAL LOCATION OF CR 61, SOUTH OF CR 78, AND AUTHORIZE CHAIR TO SIGN ANY NECESSARY DOCUMENTS - ROBERT AND RODNEY WILSON: Mr. Haug explained this is the authorization to sign the Quit Claim Deed for the right-of-way exchange discussed in the previous matter. Commissioner Conway moved to accept Quit Claim Deed and authorize the Chair to sign. The motion was seconded by Commissioner Cozad, and it carried unanimously. • 2) CONSIDER ACCEPTANCE OF QUIT CLAIM DEED FOR PUBLIC RIGHT-OF-WAY AT PRESENT PHYSICAL LOCATION OF CR 61, SOUTH OF CR 78, AND AUTHORIZE CHAIR TO SIGN ANY NECESSARY DOCUMENTS - LITTLE CALF RANCH, LLC: Mr. Haug stated this is the Quit Claim Deed for Little Calf Ranch, LLC, related to Old Business item #1 above. Commissioner Cozad moved to accept Quit Claim Deed and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. el 3) CONSIDER APPLICATION FOR CHILD WELFARE RECRUITMENT AND RETENTION GRANT AND AUTHORIZE CHAIR TO SIGN: Judy Griego, Director of Human Services, stated the application is for funds to provide for efforts or activities that recruit new foster or adoptive parents or support the retention of foster parents. Commissioner Cozad moved to approve said application and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. • 4) CONSIDER EXPENDITURE AUTHORIZATION FOR VARIOUS EMPLOYMENT SERVICES PROGRAMS AND AUTHORIZE CHAIR TO SIGN: Ms. Griego requested a deadline extension for the performance incentive funds to use the amount of $16,971.00 and extend the period of performance. Commissioner Cozad moved to approve said Expenditure Authorization and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. • 5) CONSIDER SOFTWARE SUBSCRIPTION CONTRACT AGREEMENT AMENDMENT AND CHANGE ORDER ADDENDUM NO. 2 AND AUTHORIZE CHAIR TO SIGN - CLIENTTRACK, INC.: Mary Truswell, Department of Information Technology, stated this request is to extend the software maintenance for Clienttrack, Inc. Commissioner Conway moved to approve said amendment and change order and authorize the Chair to sign. Seconded by Commissioner Cozad, the motion carried unanimously. • 6) CONSIDER INTERGOVERNMENTAL AGREEMENT FOR USE OF VICTIM ASSISTANCE SOFTWARE AND AUTHORIZE CHAIR TO SIGN — CITY OF GREELEY: Deb Calvin, Sheriffs Office, stated this agreement is to work collaboratively with the Greeley Police Department and is part of the VOCA grant which was recently applied for. Commissioner Cozad expressed her appreciation to the Sheriffs Office for their continued support to victims. Commissioner Cozad moved to approve said agreement and authorize the Chair to sign. The motion was seconded by Commissioner Conway, and it carried unanimously. 7) CONSIDER POSSESSION AND USE AGREEMENT CONCERNING CERTAIN IMPROVEMENTS TO CR 49 AND AUTHORIZE CHAIR TO SIGN - BOX ELDER KIDS, LLC: Leon Sievers, Department of Public Works, reviewed the detail of the agreement for the amount of Minutes, January 11, 2016 2016-0113 Page 5 BC0016 $156,065.00. Commissioner Conway moved to approve said possession and use agreement and authorize the Chair to sign. Seconded by Commissioner Cozad, the motion carried unanimously. • 8) CONSIDER AGREEMENT CONCERNING PURCHASE OF PUBLIC ROAD RIGHT-OF-WAY AND TEMPORARY CONSTRUCTION EASEMENT FOR CERTAIN IMPROVEMENTS TO CR 49 AND AUTHORIZE CHAIR TO SIGN - HOUNDSKEEPER, LTD.: Mr. Sievers presented the detail of the agreement for the total amount of$10,680.00. Commissioner Cozad moved to approve said agreement and authorize the Chair to sign. Seconded by Commissioner Conway, the motion carried unanimously. • 9) CONSIDER CHANGE ORDER NO. 1 FOR PARKWAY MASTER DRAINAGE STUDY AND AUTHORIZE CHAIR TO SIGN - FARNSWORTH GROUP: Elizabeth Relford, Department of Public Works, presented the change order which is necessary to increase the amount to $124,741.00. In response to Commissioner Cozad, Ms. Relford stated the contract has been awarded so they have just begun the project. Commissioner Cozad moved to approve said change order#1 and authorize the Chair to sign. Commissioner Conway seconded the motion, and it carried unanimously. • 10) CONSIDER REAPPOINTMENT TO FEDERAL MINERAL LEASE DISTRICT BOARD OF DIRECTORS: Commissioner Conway moved to reappoint Mike Freeman to the Federal Mineral Lease District Board. The motion was seconded by Commissioner Cozad, and it carried unanimously. ki 11) CONSIDER APPOINTMENT AND REAPPOINTMENT TO THE BOARD OF TRUSTEES FOR NCMC: Commissioner Conway moved to appoint Larry Cozad and reappoint Jason Yeater to the Board of Trustees for NCMC. Seconded by Commissioner Cozad, the motion carried unanimously. El 12) CONSIDER APPOINTMENT AND REAPPOINTMENTS TO WELD FAITH PARTNERSHIP COUNCIL: Commissioner Cozad moved to appoint Kim Parker and reappoint Joe Soto and Robert Thomas to the Weld Faith Partnership Council. The motion was seconded by Commissioner Conway, and it carried unanimously. • 13) CONSIDER REAPPOINTMENTS TO FAMILIES, YOUTH, AND CHILDREN COMMISSION: Commissioner Cozad moved to reappoint Matt Jarosz and Enita Kearns-Hout to the Families, Youth and Children Commission. Seconded by Commissioner Conway, the motion carried unanimously. • 14) CONSIDER REAPPOINTMENTS TO EXTENSION ADVISORY COUNCIL: Commissioner Conway moved to reappointment Ron Marshall, Eric Aakko, and Jeff Hasbrouck to the Extension Advisory Board. Commissioner Cozad seconded the motion, and it carried unanimously. RESOLUTIONS AND ORDINANCES: The resolutions were presented and signed as listed on the Consent Agenda. No Ordinances were approved.
