RE: A PLANNED UNIT DEVELOPMENT CHANGE OF ZONE, PUDZ15-0001, REQUEST TO
REZONE LOT 1 ALTHEN BOYER PUD FROM THE C-3 (BUSINESS COMMERCIAL)
AND A (AGRICULTURAL) ZONE DISTRICT TO THE C-3 (BUSINESS COMMERCIAL)
AND 1-3 (INDUSTRIAL) ZONE DISTRICT USES - PKE INVESTMENTS LIMITED
PARTNERSHIP
A public hearing was conducted on February 3, 2016, at 10:00 a.m., with the following present:

The following business was transacted:
ta I hereby certify that pursuant to a notice dated December 16, 2015, and duly published
December 22, 2015, in the Greeley Tribune, a public hearing was conducted to consider the
request of PKE Investments Limited Partnership, for a Planned Unit Development Change of
Zone, PUDZ15-0001, request to rezone Lot 1 Althen Boyer PUD from the C-3 (Business
Commercial) and A (Agricultural) Zone District to the C-3 (Business Commercial) and
1-3 (Industrial) Zone District Uses. Bob Choate, Assistant County Attorney, made this a matter of
record.
El Chris Gathman, Department of Planning Services, presented a brief summary of the
proposal and the location and history of the property. He reviewed the existing structures,
landscaping and outside storage associated with businesses currently on-site. Mr. Gathman
explained the intent is to allow existing businesses to remain and allow new commercial and
industrial businesses to relocate to the site. He pointed out the changes to the parcel map and
stated that if this is approved the applicant will be applying for a PUD final plat application to
combine the parcels. He reviewed the surrounding USRs and stated the site is located within the
three (3) mile referral area of the Towns of Dacono and Erie, and the Counties of Adams and
Broomfield. Mr. Gathman stated the Town of Erie indicated no conflicts on the referral response
and responses were not received from the other municipalities. He mentioned one request for
condition from the Bull Canal. He displayed images and entered the favorable recommendation
of the Planning Commission into the record, as written. In response to Commissioner Cozad,
Mr. Gathman stated the small triangular property is under separate ownership.

Wayne Howard, Planning Services Engineer representative, provided a brief overview of
the transportation plans and requirements stating the access is under the jurisdiction of the
Colorado Department of Transportation (CDOT). He reviewed the stormwater exemption, grading
permit requirement, and stated the site is located in a Geologic Hazard area. In response to
Commissioner Cozad, Mr. Howard verified if there were changes to imperviousness it would
require a site plan review.
▪ Lauren Light, Department of Public Health and Environment, reviewed the water and sewer
provisions and stated the existing steel building is served by Central Weld County Water District
and a septic sized for 19 people. She explained a site plan review would be required if further
buildings are constructed. Ms. Light stated there are no outstanding issues with the application.
E Mark Taylor, Alles Taylor & Duke, LLC, Engineering Consultant, represented the applicant
and stated staff did a very good job presenting the application and he does not have anything to
add.
• No public testimony was offered concerning this matter.
• In response to Commissioner Kirkmeyer, Mr. Taylor verified water is currently provided by
Central Weld County Water District and he did not know if in the future water might be provided
from a different water district.
--- In response to Chair Freeman, Mr. Taylor, on behalf of PKE Investments Limited
Partnership, indicated no concerns with the Conditions of Approval or Development Standards.
• Commissioner Kirkmeyer suggested the deletion of Condition of Approval (COA) #1.B. The
Board agreed. She further recommended deleting COA#1.C. The Board agreed. Commissioner
Kirkmeyer also recommended adding "or suitable water source" to the end of COA #1.E.3, to
allow the applicant to receive water from other entities if they so choose. The Board agreed.
Lastly, she corrected COA#1.E.6 to read, "The access to the site..."and the Board concurred.
• Chair Freeman reviewed the changes for the applicant
• In response to Chair Freeman, Mr. Taylor, on behalf of PKE Investments Limited Partnership
indicated they have reviewed, and agree to abide by, the Conditions of Approval and
Development Standards, as amended.
• Commissioner Kirkmeyer moved to approve the request of PKE Investments Limited
Partnership, for a Planned Unit Development Change of Zone, PUDZ15-0001, request to rezone
Lot 1 Althen Boyer PUD from the C-3 (Business Commercial) and A (Agricultural) Zone District to
the C-3 (Business Commercial) and 1-3 (Industrial) Zone District Uses, based on the
recommendations of Planning staff and the Planning Commission, with the Conditions of Approval
and Development Standards as entered into the record. The motion was seconded by
Commissioner Conway, and it carried unanimously. There being no further discussion, the
hearing was completed at 10:29 a.m.
