RE: APPROVE VACATION OF SECOND AMENDED MINOR SUBDIVISION, MS-17 -
PHILIP AND SARAH PFANNEBECKER
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, on November 22, 1972, the Board approved a two-lot Minor Subdivision,
MS-17, creating Lot 1, equaling 15 acres, and Lot 2, equaling 55.96 acres, more or less, which
was recorded on November 28, 1972, at Reception No. 1602542, and
WHEREAS, by Resolution dated December 27, 1972, the Board amended said two-lot
Minor Subdivision, MS-17, correcting the plat to reflect the net acreage of Lot 1 equaling 14.61
acres and Lot 2 equaling 55.40 acres, more or less, which was recorded on December 28, 1972,
at Reception No. 1604374, and
WHEREAS, on August 6, 1990, the Department of Planning Services approved Second
Amended MS-17, to include an additional 51.5-acre parcel of land to be incorporated into Lot 2
for a total acreage of 107.23 acres, more or less, with said plat being recorded on August 6, 1990,
at Reception No. 02222303, and
WHEREAS, the Board has been presented with a request from the current property
owners, Philip and Sarah Pfannebecker, 24331 County Road 32, LaSalle, Colorado 80645, to
vacate Lots 1 and 2 created through Minor Subdivision MS-17, Amended MS-17, and Second
Amended MS-17, said property being described as part of the N1/2 of Section 3, Township 5
North, Range 64 West of the 6th P.M., Weld County, Colorado, and
WHEREAS, Philip and Sarah Pfannebecker are the sole owners of said property, and
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendations of the
Department of Planning Services staff and all of the exhibits and evidence presented in this matter
and, having been fully informed, deems it advisable to approve said vacation.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that Second Amended Minor Subdivision MS-17, be, and hereby is, vacated.

The Department of Planning Services received the attached letter on January 7th, 2016 from Philip and
Sarah Pfannebecker requesting the complete vacation of both, Amended Minor Subdivision No.0963-3-2-
MS-17 and Second Amended Minor Subdivision No.0963-3-2-MS-17. They have also provided a draft
plat of the proposed area to be vacated along with a draft copy of a quit claim deed that includes a
surveyed meets and bounds description that encompasses the entire area of both of the above
subdivision lots.
The original 2 lot subdivision plat(Minor Subdivision No.0963-3-2-MS-17)was approved by the Board of
County Commissioners and recorded on November 28th, 1972. The Plat was then amended on
December 28th, 1972 to update corrections on the original plat. The additions to the plat included adding
both the net and gross acreage totals and adding adjacent county road labels to the vicinity map on the
plat. The revision was recorded as (Amended Minor Subdivision No.0963-3-2-MS17).
The subdivision remained the same until August 6th 1990 when a second amendment was approved
conditionally by the Weld County Planning Department known as (Second Amended Minor Subdivision
No.0963-3-2-MS-17). This second amendment included the addition of approximately a 51.5 acre piece
of land situated directly east of and adjacent to the original Lot 2. With this addition Lot 2 increased in size
from approximately 55.5 acres to roughly 107 acres, Lot 1 was unchanged and therefore not a part of this
second amendment.
The Department of Planning Services is recommending approval of this vacation.
Background Information:
Legal Description: Lots 1 and 2 of Second Amended Minor Subdivision No.0963-3-2-MS-17
being a part of the N2 of Section 3,Township 5 North Range 64 West of
the 6th P.M.,Weld County CO.
Location: South of and adjacent to County Road 62 and North of and adjacent to
the intersection of County Road 601/2 and County Road 55Y2.

November 28th, 1972: A two lot minor subdivision plat map titled Minor Subdivision No.0963-
3-2-MS-17 was signed by the Weld County Board of County
Commissioners and was recorded with the Weld County Recorder's
Office.The original 2 lot subdivision included Lot 1 being labeled as 15
acres in size, and Lot 2 being labeled as 55.96 acres in size.
December 28th, 1972: A Correction to the plat of Minor Subdivision No.0963-3-2-MS-17 was
approved and recorded.The plat map was corrected and the recorded
document was called out as Amended Minor Subdivision No.0963-3-2-
MS-17.The corrections were done to include the net acreage shown as
the acreage size for each individual lot instead of the gross acreage.The
acreage label for Lot 1 was corrected to show 14.61 acres net and Lot 2
was corrected to show its size as 55.40 acres net.The amendment or
more specifically corrected plat also included the addition of a label on
the plat that showed acres gross and net for the full subdivision as a
whole,and labels of the adjacent county roads to the subject property
on the vicinity map.This included County Road 62 and County Road 55.5
which were missing on the original plat.
August 6th, 1990: A second amendment to the subdivision plat was recorded. (Second
Amended Minor Subdivision No.0963-3-2-MS-17)was approved by staff
and included adding an additional 51.5+/-acres parcel of land to Lot 2
leaving the Lot with a total land area of 107.23+/-Acres.The additional
piece of land was located directly east of and adjacent to the original
Lot 2. Lot 1 was not included in the second amended plat and was
unchanged. Nether gross or net acreages were called out specifically on
the recorded plat.

We are requesting to vacate the&flowing Minor Subdivision:
Seconded Amended Minor Subdivision NO.0963.3-2-1+15=17 Being Part of the North Half of Section 3,
Township 5N,Range 64 West of the 6'h Principal Meridian,Weld County,Colorado
This original daloor subdivision lots were=alai in 1972 to accommodate a miry operation Ibis was
then expanded in the early 1990s though a second amendment to the minor
subdivision MS-i7. There are only 2 tots that were created through this minor
subdivision process and most likely should have from the start gone through a
recorded exemption process for the creation of the second lot. The property Is ,no
longer being used as a dairy operation and consists of approximately 14.61 acres all together
with all improvements located thereon. Our desire is to vacate the minor subdivision to allow for the
hard to be put back into one parcel as it was prior to the minor subdivision being created, ibis vacation
would then make the property eligible to apply for a two Lot Recorded Exemption simultaneously with a
Subdivision Ex e m ptiori to split the two residences that are on the property while also allowing us to
split off the associated improvements that we no longer need,
