Dear Board:
Bestway Concrete & Aggregate is applying for a MLRB permit to mine sand at the project site. The site is
located adjacent and west of the South Platte River. The site is within the northeast 1/4, Section 13,
Township 2 North, Range 67 West of the 6th Principal Meridian; and also within the northwest 1/4, Section
18, Township 2 North, Range 66 West of the 6th Principal Meridian. The site is generally bounded on the
west by an abandoned railroad grade, the north by WCR 22, on the east by the South Platte River, and on
the south by the City of Broomfield's Heit Pit. The project is located in Weld County, Colorado. As required
by the DRMS regulations, we have enclosed the following information for your review:

NOTICE TO THE BOARD OF COUNTY COMMISSIONERS
Weld County COUNTY
Destway (the "Applicant/Operator") has applied for a Regular (112) reclamation
permit from the Colorado Mined Land Reclamation Board (the "Board") to conduct the extraction of construction materials
operations in Weld County _ County. The attached information is being provided to notify you of the
location and nature of the proposed operation. The entire application is on file with the Division of Reclamation, Mining, and
Safety (the "Division") and the local county clerk and recorder.
The applicant/operator proposes to reclaim the affected land to Water Storage use. Pursuant to
Section 34-32.5-116(4)(m), C.R.S., the Board may confer with the local Board of County Commissioners before approving of
the post -mining land use. Accordingly, the Board would appreciate your comments on the proposed operation. Please note
that, in order to preserve your right to a hearing before the Board on this application, you must submit written comments on the
application within twenty (20) days of the date of last publication of notice pursuant to Section 34-32.5-112(10), C.R.S.

the application fee described under Section (4) below. Exhibits should NOT be bound or in a 3 -ring binder; maps should be folded to

1. To the best of my knowledge, all significant, valuable and permanent man-made structure(s) in existence at the time
this application is filed, and located within 200 feet ofthe proposed affected area have been identified in this application
(Section 34-32.5-115(4)(e), C.R.S.).
2. No mining operation will be located on lands where such operations are prohibited by law
(Section 34-32.5-115(4)(f), C.R.S.;
3, As the applicant/operator, [ do not have any extraction/exploration operations in the State of Colorado currently in
violation of the provisions of the Colorado Land Reclamation Act for the Extraction of Construction Materials
(Section 34-32.5-120, C.R.S,) as determined through a Board finding.
4. 1 understand that statements in the application are being made under penalty of perjury and that false statements
made herein are punishable as a Class 1 misdemeanor pursuant to Section 18-8-503, C,R.S.
This form has been approved by the Mined Land Reclamation Board pursuant to section 34-32.5-112,CR.S., of the Colorado Land
Reclamation Act for the Extraction of Construction Materials. Any alteration or modification of this form shall result in voiding any
permit issued en the altered or modified form and subject the operator to cease and desist orders and civil penalties for operating
without a permit pursuant to section 34-32.5-123, C.R.S.
