The 19th Judicial District Attorney's Office is a government agency statutorily mandated to prosecute those charged with committing crimes against the State of Colorado. The Victim Witness Assistance Unit, established in 1980, is a department in the District Attorney's Office. Twelve staff work in the unit providing assistance to victims of defendants charged with felonies, misdemeanors, and traffic cases. The number of criminal cases filed in 2015 were 14,879: 2321 felony, 755 juvenile, 3618 misdemeanor, and 8090 traffic. The VW Unit supports all victims of crime. VRA victims represent 35% of adult felony crimes, 28% of juvenile crimes, 40% of adult misdemeanor crimes. The 19th Judicial District Crime Victim Compensation program is housed in the Weld County District Attorney's Office. One full time and one part time position make up the staff of the program. In the past year, the program has seen a 46% increase in applications, and a 25% increase in emergency awards. The present VW Director of the 19th Judicial District has written federal grants (VAWA and VOCA) since 1997. Weld County Government oversees the financial aspect of grants which includes the separation of duties and a multiple review process. With the dramatic increase in workload, and the changing role of the CVC Coordinator within the Victim Witness Unit, the CVC program staff needs to expand to meet demand and maintain a level of response required by statute and local policy and procedure. The Victim Witness (VW) Unit had an Assistant dedicated to juvenile cases for three years before the VW Unit downsized due to financial constraints in 2012. The loss of this position meant that victim contact, court accompaniment, and other duties, were spread amongst a District Court VW Assistant and the attorneys covering the juvenile caseload. In the past year, District Court has seen a 70% increase in felony juvenile trials, which makes it unsustainable for the VW Assistants who currently share the juvenile caseload to provide even the limited assistance available in these cases. A new dedicated VW Assistant handling this caseload would mean the Office could provide services to all VRA victims and properly assist attorneys with all trials. Grant dollars are being requested for the 19th JD Crime Victim Compensation (CVC) to increase the part time CVC Assistant to full time to provide direct and administrative assistance to victims of crime. Both filed and unfiled cases are processed through the CVC program, providing victims with a means of closure and resolution they might not otherwise receive. CVC expects to process 800 new applications during the grant period. Grant dollars are also being requested for a VW Assistant dedicated to the juvenile caseload to provide services to all VRA victims: felony 82 and misdemeanor 158 a year. After having to downsize the unit in 2012, the duties once assigned to a dedicated Juvenile VW Assistant were divided among two District Court VW Assistants. District Court has since experienced an increase in felony caseload, and the increasingly limited support provided to Juvenile cases has become neither effectual nor sustainable for the victims our Office serves. Application Form Page 15 02/22/2016 Applicant: District Attorney's Office, 19th Judicial District 84309308 Project: Victim Support Services: Victim Compensation and Juvenile Victim 2016-VU-16-013792 Assistance The Crime Victim Compensation (CVC) program offers assistance to crime victims in the 19th Judicial District whose cases are filed or unfiled with the Weld County District Attorney's Office. The purpose of CVC is to assist in making a victim whole from the financial losses suffered as a direct result of a criminal incident. Assistance provided by CVC might be the only form of resolution a crime victim sees in their case, and many times the swift intervention by CVC is a necessary tool for safety and stability for victims unable to afford the unexpected consequences of a defendant's actions. The program has seen a marked increase in new applicants and emergency needs over the past year, and expects to process 800 new applications during the grant period, as well as 75 emergency requests. Services provided to applicants include follow up services via phone, mail, in person, and other electronic means during the grant year. Awards for crimes range from lost support provided to misdemeanor level domestic violence victims, to assistance with funeral and burial expenses for survivors of homicide attending to the final needs of their lost loved one. Victim Witness (VW) Assistants provide proactive and continued contact and support to victims of crime moving through the criminal justice system. They are a resource for services referrals, and invaluable support during possibly the most difficult time in someone's life. The funding requested for the Juvenile VW position will allow the Juvenile VW Assistant to take over the felony cases and other duties spread thin among two District Court VW Assistants, and the attorneys handling misdemeanor case contacts. This position will expand the services being offered, and bring the level of equality needed for all VRA victims as they move through the criminal justice process.
