HEARING CERTIFICATION DOCKET NO . 2016 -36 RE : A SITE SPECIFIC DEVELOPMENT PLAN AND USE BY SPECIAL REVIEW PERMIT, USR16-0001 , FOR ANY USE PERMITTED AS A USE BY RIGHT, ACCESSORY USE, OR USE BY SPECIAL REVIEW IN THE COMMERCIAL OR INDUSTRIAL ZONE DISTRICTS ( RV, BOAT, CAMPER AND PERSONAL VEHICLE STORAGE ) PROVIDED THAT THE PROPERTY IS NOT A LOT IN AN APPROVED OR RECORDED SUBDIVISION PLAT OR PART OF A MAP OR PLAN FILED PRIOR TO ADOPTION OF ANY REGULATIONS CONTROLLING SUBDIVISIONS IN THE A (AGRICULTURAL) ZONE DISTRICT- MG WOODWARD LIVING TRUST C/O MARK AND GLENDA WOODWARD A public hearing was conducted on April 6, 2016, at 10: 00 a . m . , with the following present: Commissioner Mike Freeman . Chair Commissioner Sean P. Conway. Pro-Tern Commissioner Julie A. Cozad Commissioner Barbara Kirkmeyer Commissioner Steve Moreno Also present: Acting Clerk to the Board , Tisa Juanicorena Assistant County Attorney, Bob Choate Planning Services Department representative . Diana Aungst Public Works Department representative , Janet Lundquist Planning Services Engineer representative . Wayne Howard Health Department representative , Lauren Light The following business was transacted : P I hereby certify that pursuant to a notice dated February 19 , 2016, and duly published February 24 . 2016 , in the Greeley Tribune . a public hearing was conducted to consider the request of MG Woodward Living Trust, c/o Mark and Glenda Woodward , for a Site Specific Development Plan and Use by Special Review Permit, USR16-0001 . for any Use permitted as a Use by Right. Accessory Use , or Use by Special Review in the Commercial or Industrial Zone Districts ( RV, boat, camper and personal vehicle storage) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District. Bob Choate . Assistant County Attorney. made this a matter of record . Diana Aungst, Department of Planning Services . presented a brief summary of the proposal and stated 17 referrals were sent out and 13 either did not respond or indicated no concerns. She reviewed the site located in relation to County roads and stated the application materials indicated 3 . 8 acres of the parcel will be utilized as proposed . Ms . Aungst described the access , hours of operation , and clarified the owners live on the adjacent property and have no plans for additional lighting or new structures. She explained the signage and stated staff is recommending screening ; however, the applicant is requesting to waive the screening requirement. Ms . Aungst stated the site is adjacent to the Town of Hudson and outside planning agreement area . Ms. Aungst stated staff received one ( 1 ) email from the adjacent RV storage facility with concerns to include fire, parking and emergency exit. She declared the Conditions of Approval and Development Standards will assist with mitigation . She stated the site is located within the three (3) mile referral area of the Town of Hudson and the applicant has addressed the comments from the Town of Hudson and intends to put in culverts. Ms . Aungst mentioned that the Planning Commission requested the applicant speak to the Hudson Fire Protection District. and the comments regarding this communication were received yesterday . She displayed images of the site and surrounding properties and entered the favorable recommendation of the Planning Commission into the record as written . In response to Commissioner Cozad , Ms. Aungst stated the RV storage facility across the street has no screening . In response to Commissioner Kirkmeyer. Ms . Aungst clarified the number of access points. P Janet Lundquist, Department of Public Works . provided a brief overview of the transportation plans and requirements regarding the relevant County roads and stated an Access Permit has been approved , AP#16-00030 . She explained the applicant has closed one ( 1 ) access to open one ( 1 ) small commercial access with no net increase and that the new access is in a better location . Ms . Lundquist provided the average daily traffic counts and stated the traffic narrative indicated 10-20 users per day and staff is requiring tracking control : however, an Improvements Agreement will not be required at this time. Wayne Howard , Planning Services Engineer representative. presented the requirements related to drainage to include a stormwater detention pond , which has been reviewed and found to be acceptable; however, the applicant needs to submit a final drainage report to be in compliance with the requirements and drainage related arrows and features must be shown on the plat. He reviewed the typical requirements related to a Grading Permit and relevant Development Standards related to drainage features and historical flow patterns . P Lauren Light, Department of Public Health and Environment. reviewed the water and sewer provisions stating the existing home is served by domestic well and septic system which are not part of the business. She clarified the business is not planning to have a septic system or water service; therefore , a portable toilet with hand sanitizer and bottled water are acceptable and typical with other RV sites . Ms . Light stated Development Standards (DS) #16-22 address relevant Environmental Health items . Mark Woodward . applicant, stated it is a small three (3) acre lot enclosed with chain link fencing and covered with recycled asphalt. In response to Commissioner Conway, Mr. Woodward clarified the adjacent RV Park does not belong to him . Pa Chris Hamilton , surrounding property owner, stated she owns the RV storage lot across the street and attended the Planning Commission to share her concerns regarding the drainage under County Road (CR) 41 as being problematic because the culvert is too low and the water backs up when it rains and floods across the Woodward property. Ms . Hamilton submitted a picture as an Exhibit. and stated she has been in contact with Brian Garcia in Public Works. In response to Commissioner Conway, Ms . Lundquist interjected that Mr. Garcia will investigate and pursue any corrections . Ms . Hamilton further stated a concern she had mentioned at Planning Commission 2016- 1177 PL2418 HEARING CERTIFICATION - MG WOODWARD LIVING TRUST C/O MARK AND GLENDA WOODWARD ( USR16-0001 ) PAGE 3 and asked if this correspondence has been filed . Ms. Aungst responded the correspondence has been added to the record . `. In response to Commissioner Cozad . Mr. Woodward stated he is not planning on any opaque fencing for screening and stated he has investigated other RV storage facilities in the area and provided pictures of what they intend to install for the entryway . signage, lighting . fencing and he reviewed the plans for landscaping . In further response to Commissioner Cozad , Mr. Woodward stated he is not planning on additional employees . Commissioner Moreno suggested a change to the hours of operation as well . Mr. Woodward stated he does not want late traffic. Commissioner Cozad clarified possible changes to prevent issues with compliance regarding additional employees or hours of operation . In response to Commissioner Conway, these hours are not based on input from neighbors . Chair Freeman suggested a change to 24 hours a day and seven days a week for compliance . After further discussion and input from staff,. the Board agreed to delete DS #4 regarding the hours of operation . Commissioner Cozad recommended amending DS #3 to reflect up to two (2) on-site employees . The Board agreed . Commissioner Kirkmeyer suggested deleting the second sentence on DS #3 , and the Board Y 99 concurred . She further suggested a change to DS #6 to reflect the vehicles stored in the designated storage area . The Board agreed . In response to Commissioner Kirkmeyer, Mr. Woodward described the entryway distance from the road to prevent traffic issues . Commissioner Kirkmeyer recommended deleting Condition of Approval (COA) # 1 . B and #1 . C . 6 . to which the Board agreed . Lastly, she suggested a clarification to COA # 1 . C . 9 to delineate one ( 1 ) access for residential and one ( 1 ) access for commercial . The Board concurred . I/ Commissioner Cozad recommended a minor grammar correction to DS #7 and deleting DS #9 . The Board agreed . Chair Freeman reviewed the changes for the applicant. a In response to Chair Freeman . Mr. Woodward indicated they have reviewed . and agree to abide by. the Conditions of Approval and Development Standards . as amended . P Commissioner Kirkmeyer stated her appreciation to the applicant for a conscientious application and to the public for the helpful input: and thereafter, moved to approve the request of MG Woodward Living Trust, c/o Mark and Glenda Woodward , for a Site Specific Development Plan and Use by Special Review Permit. USR16-0001 , for any Use permitted as a Use by Right . Accessory Use . or Use by Special Review in the Commercial or Industrial Zone Districts (RV. boat. camper and personal vehicle storage) provided that the property is not a lot in an approved or recorded subdivision plat or part of a map or plan filed prior to adoption of any regulations controlling subdivisions in the A (Agricultural) Zone District, based on the recommendations of Planning staff and the Planning Commission . with the Conditions of Approval and Development Standards as amended and entered into the record . The motion was seconded by Commissioner Conway, and it carried unanimously.
