That lease is included with this correspondence as reference. The access point at Weld County Road 388 is the only access onto the Ranch that is owned, approved, and controlled by 70 Ranch. The small, weight restricted bridge north of County Road 69 is not located on Ranch property. Instead, the subject bridge is located on Colorado State Land Board lands and is therefore not under the control of 70 Ranch. We would like to emphasize that Blue Grama's application for the Riverside Station will alleviate traffic on County Road 388. Specifically, a significant number of truck trips on County Road 388 currently used to export crude oil from the Ranch will now be contained within the boundaries of the Ranch. We are open to meeting with Weld County to determine how applications like USR1S-0062 can benefit local communities by reducing traffic on County roads. In addition, Condition of Approval 1C for Subdivision Exemption, SUBX15-0028 requests similar confirmation. This information provides written evidence to Weld County for both SUBX15-0028 and USR15-0062 that the 70 Ranch has provided an access route to Blue Grama Land Corporation. Attached you will find a copy of the Recorded Surface Lease Agreement. Prentice Ave., Suite 100, Greenwood Village, CO, 80111 ("Terminus North") and Blue Grama Land Corporation, a Colorado Corporation having an address of 3773 Cherry Creck Drive North, Denver CO 80209 ("Blue Grama"). Terminus North and Blue Grama may be referred to individually as a "Party" and collectively as the "Parties". This Lease is granted for the purpose of allowing Blue Grama the right to apply for permits to use said premises for the purpose of erecting, installing, maintaining, operating, altering, replacing, repairing, and removing electrical meters and pump facilities, tanks, outbuildings, office space, truck loading and unloading sites, pipelines, including appurtenances thereto and for oil and gas storage in tanks, shipment by trucks and pipeline, measurement and other purposes and uses in connection therewith. Lessee shall have the right and obligation to do and perform such acts on adjacent land as may be necessary to protect Lessor's and its property in case of fire or flood and to prevent spread and loss of oil. Blue Grama shall have the use of the surface of the Lands during the term of this Lease. Blue Grama shall also have the right of ingress and egress to and from the Lands and across the adjoining lands owned by 70 Ranch, subject to the terms of the Surface Use Agreement. Pursuant to discussions at our meeting; please accept this Letter of Intent as our commitment to work with the County to negotiate and ultimately enter into a Road Maintenance Agreement that equitably apportions the maintenance cost for the road between the 70 Ranch, the County, and other entities whose use of the road has created traffic impacts greater than the historic baseline. Lembke EXHIBIT V I .0 -13 tI its - oob2 Notes About 70 Ranch Access 1 . Until present ownership, the historic and main access into the 70 Ranch has always been via CR 69. In fact, present signage at US 34 designates CR 69 as the entrance to the 70 Ranch . 2 . All commercial transport in and out of the National Hog Farm was conducted via CR 69 over the existing canal bridge. This can be confirmed by the ranch manager, former Hog Farm employees, and numerous locals. 3 . Has a certified, objective engineer ever authenticated the 8000 pound weight limit for the canal bridge? During the Hog Farm years, cement and gravel trucks, grain trucks, manure trucks, and thousands of full trailer loads of hogs crossed the existing canal bridge. These trucks weigh in the range of 50,000 to 100,000 pounds. 4. Why would Weld County have built a multimillion dollar bridge to nowhere over the South Platte River? The river bridge was obviously built to facilitate quick access into the Hog Farm/70 Ranch via CR 69. Does it make sense to throw away this wonderful taxpayer funded asset, which leads directly into the heart of the 70 Ranch ? 5. Right now, trucks weighing over 8000 pounds are crossing over the canal bridge into the 70 Ranch. This can easily be confirmed by using the 70 Ranch's own video camera at the bridge. 6. The CR 388 gate used to be locked, opened only as emergency access into the 70 Ranch when the river flooded . This is validated by the Weld County road sign located near CR 61 which says that CR 388 is "not a thru road." Even so, the 70 Ranch has made CR 388 a "thru road" by making it the access for oil and gas traffic. 7. There are still tens of thousands of acres to be developed on the 70 Ranch.
