ORDINANCE NO. 3-1976

AN ORDINANCE AUTHORIZING THE BOARD OF COUNTY COMMISSIONERS
OF WELD COUNTY, COLORADO, TO APPROPRIATE AND TRANSFER FUNDS FROM
o` THE WELD COUNTY CONTINGENCY FUND TO THE WELD COUNTY SPECIAL ROAD
AND BRIDGE FUND.
1. WHEREAS, the Board of County Commissioners, Weld County,
Colorado, has determined that an emergency exists and that for
the public safety of the residents of Weld County, Colorado,
certain bridges must be repaired and/or reconstructed; and
2. WHEREAS, there are no funds available for this purpose
other than those funds reposing in the County Contingency Fund;
and
ti 3. WHEREAS, the Board has further determined that an
c= emergency exists which could not be reasonably foreseen and
therefore authorizes and orders that Fifty Thousand Dollars
($50, 000. 00) shall be transferred from the Contingency Fund
of Weld County, Colorado, into the Special Road and Bridge Fund
for the repair and/or reconstruction of said bridges damaged as
aforesaid; and
4. WHEREAS, pursuant to law in such cases made and provided
for, said transfer shall not be effective until after a public
hearing is had on such proposed transfer, which such public
hearing was held on May 19, 1976, at 2: 00 p.m. , in the Office
of the Board of County Commissioners, Weld County Health Building,
Greeley, Colorado.
NOW, THEREFORE,
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF
WELD COUNTY, COLORADO:
Section I. Authority of Board to transfer funds from
Contingency Fund to the Special Road and
Bridge Fund.
That the Board be, and it hereby authorizes and orders that
Fifty Thousand Dollars ($50, 000. 00) be transferred from the Con-
tingency Fund of Weld County, Colorado, into the Special Road and
Bridge Fund for the repair and/or reconstruction of county bridges.
Section II. Effective date.
Pursuant to Section 3-14 (6) of the Weld County Home Rule
Charter, the Board finds and hereby declares this ordinance to be
and emergency ordinance and that its immediate passage is
"necessary to the preservation or protection of public health,
property, or safety, " and that time is of the essence due to the
emergency that exists. The effective date of this ordinance shall
be the date of its enactment.
Section III. Safety Clause.
The Board finds, determines , and declares that in the event
this ordinance shall be interpreted to be ineffective pursuant to
court determination of the pending case, entitled William S.
(Bill) Garnsey, et al vs. the Board of County Commissioners, et al,
then in that event the RESOLUTION authorizing said action shall
remain valid and in full force and effect.
