RE: GRANT ZONING PERMIT FOR ACCESSORY STORAGE, ZPAS16-0002 -CARR, LLC,
C/O MONICA SWEERE
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board of County Commissioners of Weld County, Colorado, on the 1st
day of June, 2016, considered the request of CARR, LLC, do Monica Sweere, 2138 Mainsail
Drive, Fort Collins, Colorado 80624, for a Zoning Permit for Accessory Storage, ZPAS16-0002,
for a semi-trailer to be used for the storage of personal items, and
WHEREAS, said accessory structure is to be occupied in an A (Agricultural) Zone District
on a parcel of land being more particularly described as follows:
Lots 2 thru 15, Block 10, in the Townsite of Carr,
located in Section 27, Township 11 North, Range 67
West of the 6th P.M., Weld County, Colorado
WHEREAS, the Board of County Commissioners heard all of the testimony and
statements of those present, studied the request of the applicant and the recommendation of the
Weld County Department of Planning Services and all of the exhibits and evidence presented in
this matter and, having been fully informed, finds that this request shall be approved for the
following reasons:
1. The submitted materials are in compliance with the application requirements of
Section 23-4-910 of the Weld County Code.
2. It is the opinion of the Board that the applicant has shown compliance with Section
23-4-900 of the Weld County Code.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the request of CARR, LLC, do Monica Sweere, for permission to place a
semi-trailer to be used for the storage of personal items on the above described parcel of land,
which was found to be in compliance with Chapter 23, Article IV, Division 3, of the Weld County
Code, be, and hereby is, granted, subject to the following conditions:
1. Electricity is the only utility that may be connected to the semi-trailer(s) used for
accessory storage. The applicant shall apply for, and be issued, an electrical
permit through the Department of Building Inspection.
2. No structural component of the semi-trailer(s) used for accessory storage will be
removed and thereby result in the semi-trailer being unmovable.

3. This permit is granted for accessory use of a semi-trailer being used for storage
during construction of a single-family dwelling on the parcel, being no more than
eighteen (18) months from June 1, 2016. Such accessory use shall end if a
complete building permit application for said single-family dwelling is not submitted
to the Weld County Department of Planning Services by September 19, 2016.
4. The semi-trailer used for accessory storage will not be used on any basis as a
dwelling or as overnight or temporary housing for any person.
5. The semi-trailers(s) used for accessory storage will not be allowed to deteriorate
into a state of disrepair. Such disrepair would include, but not be limited to,
semi-trailer(s) for accessory storage partially or totally damaged by fire,
earthquake, wind or other natural causes, or is in a state of general dilapidation,
deterioration or decay resulting from a lack of maintenance, vandalism, or
infestation with vermin or rodents. Any such semi-trailer(s) shall be restored to,
and maintained in, the original condition upon being placed on the site or shall be
removed from the site.
6. The semi-trailer(s) used for accessory storage will be removed from the property
upon cessation of such use.
7. The semi-trailer(s) used for accessory storage will not in any manner be used to
display a sign(s).
8. This permit will not be transferable by the applicant and/or owner to any successor;
the zoning permit shall terminate automatically upon conveyance or lease of the
property.
9. Approval of this application for a zoning permit application shall not be considered
to release the applicant from complying with any private covenants in place.
10. All proposed or existing structures will meet the minimum setback and offset
requirements for the zone district in which the property is located. Pursuant to the
definition of setback in the Weld County Code, the required setback is measured
from the future right-of-way line. No building or structure as defined and limited to
those occupancies listed as Groups A, B, E, F, H, I, M and R in Section 302.1 of
the 2012 International Building Code, shall be constructed within a 200-foot radius
of any tank battery. or within a 150-foot radius of any wellhead. Any construction
within a 200-foot radius of any tank battery or 150-foot radius of any wellhead shall
require a variance from the terms of the Section 23-3-10 of the Weld County Code.
11. The property is in violation of Chapter 23 of the Weld County Code (Violation
ZCV16-00004). The applicant shall schedule a final inspection with the Weld
County Zoning Compliance Officer to ensure compliance of the property.
12. Any future structures or uses on the site must obtain the appropriate zoning and
building permits.

13. Should noxious weeds exist on the property, or become established as a result of
the proposed development, the applicant/landowner shall be responsible for
controlling the noxious weeds, pursuant to Section 15-1-10 of the Weld County
Code.
14. The applicant has not obtained an Access Permit through the Weld County
Department of Public Works. Prior to submittal of a building permit for a primary
residence, the applicant shall provide proof that the access permit has been
approved.
15. The applicant shall maintain compliance with Section 23-4-900 of the Weld County
Code at all times.
The above and foregoing Resolution was, on motion duly made and seconded, adopted

Sec. 23-3-30.- Accessory Uses
The Following BUILDINGS,STRUCTURES and USES shall be allowed in the A (
Agricultural ) zone District so long as they are clearly incidental and ACCESSORY
to the USES allowed by right in the A (Agricultural) Zone District.Such
BUILDINGS,STRUCTURES and USES must be designed , constructed according to
Sec. 23-3-50 below. ACCESSORY USES wihtin the A (Agricultural) Zone District
shall be subject to additional requirements contained in Articles IV and V of the is
Chapter. Note: The combined GROSS FLOOR AREA of all ACCESSORY
BUILDINGS constructed after August 25,1981 on LOTS in an approved or recorded
subdivision plat or LOTS part of a map or plan filed prior to the adoption of any
regulations controlling subdivisions of less than ten (10) acres shall not exceed four
percent(4%) of the total LOT area, except in Regional Urbanization Areas,which shall
adhere to RUA development standards. However, in no case shall such an ACCESORY
BUILDING exceed twice the GROSS FLOOR AREA of the primary residence on the
LOT except by variance. ANY acessory structure made nonconfroming by application
of this section may be repaired , replaced or restored in total.
Sec. 23-1-90.- The words "incidental" and "accessory" are undefined in
Weld County Code. In leiu of Weld County Denfintions the Blacks Law
Dictionary will be used to define "incidental" and "accessory"
Blacks Law Defines incidental: this means depending on something else, it
likely to happen or happening in addition to another event.
Blacks Law Defines accessory:Goods used in the opertations process,
marketing,or administration. They are not part of the final product.Or a
party who is the main culprit but connected.
Sec.23-3-30. Accessory Uses in A ( Agricultural) Zone Districts are
allowed only when there is a " clearly incidental and Accessory USE" In
the case of the Carr LLC property the semi- trailer was placed on the Carr
LLC property in the winter of 2016. The semi-trailer has remained there as
such untouched, unmoved, and without any "clear incidental" pupose.The
Colorado Secratary of State lists Dan Kiekel as a party associated with the
Carr LLC. The residents of Can have not witnessed such party on Carr
LLC property since the time the semi-trailer was unloaded. The parties
listed on the Can LLC and the semi-have not met the defintion of
"incidental and accessory use". The semi-trailer on the Carr LLC property
is in no way needed or "dependant" on what is taking place on the
property. For example, they are not growing watermelons and then loading
the semi-trailer to take the watermelons to market.Thus, the watermelons
are not"dependant" on the semi-trailer. The semi-trailer parked on the Carr
LLC property is not " Good(S) used in the operations process. " The semi-
trailer has served no purpose of any sort of clear operation. If Carr LLC did
in fact have a building permit to build a family dwelling they might be
using the semi-trailer to bring in wood thus, the "goods" used in the
operation. However, no such action had been taken. Thereby, there is no
"clearly incidental accessory use " of the semi- trailer to be parked in the
center of the residental community of Can. The semi-trailer was placed on
the property pervious to any Accessory Use Permit being issued and as
such has been in violation of Weld County code for the past six months.
Carr LLC since the inception of the formal complaint has informed Carr
residents and neighbors that they intend to build a home on the 24137 L2
thru 15 BLK10 AND ADJ VAC ALLEYS CARR. If Carr LLC's true
intention is to build a home our friends who have so fondly become family
would warmly welcome new neighbors. However, upon being told that
they were " waiting on building permits" further research was conducted.
According to the Weld County webiste there have been no Buiding Permits
or Health Department Permits applied for in reference to the Carr LLC
property. If Carr LLC had applied for a Building Permit or a Well Permit
from the State of Colorado one could argue indeed a semi-trailer may be
needed on the property to store matierals to build a house thus, potnetially
meeting the "clearly incidental accessory use" definition. However, since
such permits have not been applied for the semi-trailer on Carr LLC has no
" Clearly Incidental or accessory use " the permit shall be denied. It can
also be noted if the Carr LLC property owners are able to apply for an
Accessory Use permit surely the Weld County Building and PLanning
Planners could aid them in applying for a building permit if so desired.
It also appears suspect to have all of the lots needing this variance for one
house in total.According to Weld County Code since Can LLC property is
part of the plat of Carr subdivision there would be no need to apply for a
Accessory Storage Permit inorder to simply build a residental building.
One question must be considered, " Why incorporate as Can LLC to buy
land and build a house?" The majority of land owners in general purchase
land in their personal name and apply for buiding permits in their personal
name in order to build a personal residence. The next question that must be
considered," Since Carr LLC is a copperation and based on evidence is not
a single family looking to build a home in Can is there another unclear
purpose they intend to use the Can property for?
Therefore, condsidering Carr LLC does not meet the "clearly incidental and
accessory use" poilcy that is so clearly written in 23-3-30. Accessory Use
we the neighboring property owners and residents of Carr Colorado ask the
Planning Board to defer reccomending an Accessory Storage Permit be
granted to the Carr LLC. If at a furhter time the Carr LLC members can
present evidence and produce the documents that building permits were
filed with Weld County to build a personal residence on the said Carr LLC
property we the Carr residents would see the need for an Accessory Use
Storage permit.However, until such evidence is produced the semi-trailer
in the center of our community with no clear use or vaule should be
removed considering it has already been in violtion for the past 6 months.

Upon review of my case files and computer, an active Zoning Violation (ZCV16-00004) was noted . This
violation was initiated due to the presence of a semi trailer as a storage unit, among other violations,
without first obtaining the required ZPAS permit. This case has not been presented to the Weld County
Court Magistrate through the Violation process. Since this application was submitted prior to an actual
court date being scheduled , no investigation fee is required .
This application if approved by staff, will correct a portion of the violation . If this application is denied the
semi trailer shall be removed from the property; otherwise, the violation case will proceed accordingly.

Dear Wendi,
Thank you for taking the time to explain what is happening with the "storage of a semi trailer to be
used for personal storage".
My response to this request is a very resounding, "NO".
Here is my rationale for the "NO" vote on this issue.
Carr, Colorado was founded a long time ago and homesteaded by many who wanted to make this
home. The pioneers of this wonderful land had many struggles, but all in all, this was a place of
community where everyone took care of each other, where the school and the church were the
meeting places for the community, whether it be for "Carr Cactus Club", weddings, funerals and
great basketball games. Most of those who made all of this happen are now gone, except for those
of us who are the children of those homesteaders. They infused in us the need to be proud of this
land, of the people. We are proud to this day.
At one time, there were two grocery stores (one owned by my father and grandfather Colgin &
Son), the other owned by the Chadwick's until the store burned to the ground. There was a hotel
(owned by my grandparents, George & Anna Colgin). The Union Pacific ran right through "town"
and many who worked on the railroad stayed at the Colgin's Carr Hotel where they also boarded,
and my grandmother fed, the crews from the railroad. The church was given to be a community
Presbyterian church and the school was the great meeting place for the Carr basketball games
(really exciting times when they won and that was often!), where my own mother and her sister
graduated from Carr High School, and for the Carr Ladies Aide Society to bring their beautiful
handiwork for sale to help with the church, school and other community needs.
There are many other special thoughts and memories of Carr, Colorado.
However, this vote is not to be made on an emotional and sentimental reason, but rather to continue
to keep Carr, Colorado a beautiful place in the middle of the Colorado prairie where the land is
disrespected when people violate zoning laws. That should NOT include a semi trailer parked there.
It would be an eye sore and prove to look like a junk yard. The people of Carr have tried to do a
major clean up of the little town and its environs—let Carr continue to be proud of their efforts.
The semi trailer/storage unit is a zoning violation. It is completely disrespectful of the citizens of
Carr and of the land, to go against zoning violations. In making the decision on this case, please
consider the Can LLC is already in violation. Why would they be given the privilege to go against
the law and policy for their own benefit? That would make no sense.

Please note my objection to the proposed zoning change and the allowance of outdoor storage. My objections to
the revision are as follows:
• Can has a history of people looking for an"in the middle of nowhere" location for criminal endeavors.
We had a home blow up from hash oil extraction. Routinely cars meet up to exchange marijuana which
is transported into Wyoming and other states. The mere presence of multiple storage containers in this
community will attract criminal enterprises including, thefts, burglaries, marijuana grows, organized
crime and criminals looking at adjacent properties and opportunities. The sheriffs office will not be able
to provide adequate and economic law enforcement. Further the lack of monitoring increases an
unnecessary burden on adjacent property owners and law enforcement.
• The containers are at high risk of blowing over. Semi's routinely blow over every year in the area due to
high winds. This alone poses danger to surrounding homes and livestock. Further they provide habitat
for rodents and rattle snakes increasing the dangers to surrounding people and livestock.
• The fire and hazardous material risk is also concerning. The Nunn fire department is well over 15 miles
away. Without monitoring, immediate access to a large quantity of water, the risk of combustion inside
these types of containers is very high. In remote locations people are less likely to follow the rules or be
conscious of dangerous behavior. Especially when gasoline, other flammables including engines, small
equipment and the like are stored. Further the storage inside an unstable structure like a semi-trailer
which is likely to be blown over will result in chemical spills and fires. This affects our water and puts
our homes in danger.
• Lastly the rezoning request is concerning. This is an agricultural community and it is our desire to retain
this focus. People don't rezone agriculture to industrial in order to build a house and put a horse or two
outside. A storage facility is not the culture of the community. This property doesn't even have water
storage increasing the burden on adjacent property owners when something goes wrong.
Can is a quiet community with families and agriculture. Please help us preserve its beauty, safety, and minimal
crime. Let the commercial and industrial operations locate in the cities.

like a cheap living arrangement and not a tiny house that is pleasing. I already have a neighbor who likes to
store junk on the side of their garage where they don't have to look at it but I do. I forsee this as being an even
bigger eye sore.

the Driver Privacy Protection Act.

• Semi-trailer along with two other trailers was moved to the Carr LLC property.

• A complaint was filed with Weld County regarding the semi-trailer on the Carr LLC property.
March 4, 2016
• Carr LLC applies with Weld County for an Accessory Storage Permit for all 13 blocks that are
owned.

• Weld County Planning sends notices of request of Accessory Storage Permit to all 30 residences
in Carr that are within 500 ft. of the Carr LLC property.
April 25,2016
• Weld County Planning receives 15 letters of objection (from those within 500 ft.to the Carr LLC
Property)to the Accessory Storage Permit. Weld County prior to April 25, 2016 received an
additional 8 objections from Carr residents. On May 18, 2016 Weld County received an
additional 5 objections from residents of Carr.

Agricultural Zone A
Chapter 23 Articles III -Zone Districts Division 1
The unincorporated town of Carr under Article III -Zone Districts Division 1 is zoned A Agricultural.
Sec. 23-3-10.-Intent States the following," Agricultural in the COUNTY is considered a valuable
resource which must be protected from adverse impacts resulting from uncontrolled and undirected
business, industrial and residential land USES.The A(Agricultural) Zone District is established to
maintain and promote agriculture as an essential feature of the COUNTY.The A(Agricultural )Zone
district is intended to provide areas for the conduct of agricultural activities and activities related
to agriculture and agricultural production without the interference of other incompatible land
USES.The A(Agricultural) Zone District is also intended to provide areas for the conduct of USES by
Special Review. Which have been determined to be more intense or to have a potentially greater
impact than USES Allowed by Right.The A(Agricultural)Zone district regulations are established to
promote the health,safety and general welfare of the present and future residents of the
COUNTY.
• Dear Commissioner as you read this document take into consideration the health,
safety and welfare of the present residents of Carr Colorado. Please also consider
that the majority of those residents opposing the semitrailer in the center of Carr do
reside in Carr however,the owners of the Carr LLC do not live in Carr but rather live
away from the semi trailer and reside in Fort Collins.
Sec. 23-3-30. -Accessory Uses
The Following BUILDINGS, STRUCTURES and USES shall be allowed in the A(Agricultural )Zone
District so long as they are clearly incidental and ACCESSORY to the USES allowed by right in the A(
Agricultural)Zone District.Such BUILDINGS,STRUCTURES and USES must be designed, constructed
according to Sec. 23-3-50 below.ACCESSORY USES within the A(Agricultural)Zone District shall be
subject to additional requirements contained in Articles IV and V of this Chapter. Note:The
combined GROSS FLOOR AREA of all ACCESSORY BUILDINGS constructed after August 25, 1981 on
LOTS in an approved or recorded subdivision plat or LOTS part of a map or plan filed prior to the
adoption of any regulations controlling subdivisions of less than ten (10) acres shall not exceed four
percent (4%) of the total LOT area, except in Regional Urbanization Areas,which shall adhere to RUA
development standards. However, in no case shall such an ACCESORY BUILDING exceed twice the
GROSS FLOOR AREA of the primary residence on the LOT except by variance.ANY accessory
structure made nonconforming by application of this section may be repaired, replaced or restored
in total.
• Sec. 23-1-90. -The words "incidental" and "accessory" are undefined in Weld County Code.
In lieu of Weld County Definitions the Black's Law Dictionary will be used to define
"incidental" and "accessory"
• Blacks Law Defines incidental:this means depending on something else, it likely to happen
or happening in addition to another event.
• Blacks Law Defines accessory: Goods used in the operations process, marketing, or
administration.They are not part of the final product. Or a party who is the main culprit but
connected.
• Sec.23-3-30. Accessory Uses in A (Agricultural) Zone Districts are allowed only when there
is a " clearly incidental and Accessory USE" In the case of the Carr LLC property the semi-
trailer was placed on the Carr LLC property in the winter of 2016.The semi-trailer has
remained there as such untouched, unmoved, and without any"clear incidental" purpose.
The Colorado Secretary of State lists Dan Kiekel as a party associated with Carr LLC.The
residents of Carr have not witnessed such party on Carr LLC property since the time the
semi-trailer was unloaded.The parties listed on Carr LLC and the semi-have not met the
definition of"incidental and accessory use".The semi-trailer on the Carr LLC property is in
no way needed or"dependent" on what is taking place on the property. For example,they
are not growing watermelons and then loading the semi-trailer to take the watermelons to
market.Thus, the watermelons are not"dependent" on the semi-trailer.The semi-trailer
parked on the Carr LLC property is not"Good(S) used in the operations process."The
semi-trailer has served no purpose of any sort of clear operation. If Carr LLC did in fact have
a building permit to build a family dwelling they might be using the semi-trailer to bring in
wood thus,the "goods" used in the operation. However, no such action had been taken.
Thereby, there is no "clearly incidental accessory use "of the semi-trailer to be parked in the
center of the residential community of Carr.The semi-trailer was placed on the property
pervious to any Accessory Use Permit being issued and as such has been in violation of Weld
County code for the past six months.
• Carr LLC since the inception of the formal complaint has informed Carr residents and
neighbors that they intend to build a home on the 24137 L2 thru 15 BLK10 AND ADJ VAC
ALLEYS CARR. If Carr LLC's true intention is to build a home our friends who have so fondly
become family would warmly welcome new neighbors. However, upon being told that they
were "waiting on building permits"further research was conducted.According to the Weld
County website there have been no Building Permits or Health Department Permits applied
for in reference to the Carr LLC property. If Carr LLC had applied for a Building Permit or a
Well Permit from the State of Colorado one could argue indeed a semi-trailer may be
needed on the property to store materials to build a house thus, potentially meeting the
"clearly incidental accessory use" definition. However, since such permits have not been
applied for the semi-trailer on Carr LLC has no "Clearly Incidental or accessory use "the
permit shall be denied. It can also be noted if the Carr LLC property owners are able to apply
for an Accessory Use permit surely the Weld County Building and Planning Planners could
aid them in applying for a building permit if so desired.
• It also appears suspect to have all of the lots needing this variance for one house in total.
According to Weld County Code since Carr LLC property is part of the plat of Carr subdivision
there would be no need to apply for an Accessory Storage Permit in order to simply build a
residential building.
• One question must be considered, "Why incorporate as Carr LLC to buy land and build a
house?"The majority of land owners in general purchase land in their personal name and
apply for building permits in their personal name in order to build a personal residence.The
next question that must be considered,"Since Carr LLC is a corporation and based on
evidence is not a single family looking to build a home in Carr is there another unclear
purpose they intend to use the Carr property for?
• Therefore, considering Carr LLC does not meet the "clearly incidental and accessory use"
policy that is so clearly written in 23-3-30.Accessory Use we the neighboring property
owners and residents of Carr Colorado ask the Planning Board to defer recommending an
Accessory Storage Permit be granted to Carr LLC. If at a further time the Carr LLC members
can present evidence and produce the documents that building permits were filed with
Weld County to build a personal residence on the said Carr LLC property we the Carr
residents would see the need for an Accessory Use Storage permit. However, until such
evidence is produced the semi-trailer in the center of our community with no clear use or
value should be removed considering it has already been in violation for the past 6 months.
Sec.23-3-30. L
Semi-Trailer used accessory storage. One (1) semi-trailer used as accessory storage may be
permitted on LOTS in an approved or recorded subdivision plat, or LOTS which are part of a map or
plan filed prior to the adoption of any regulations controlling subdivisions in the A (Agricultural)
Zone District, according to the procedure and zoning permit requirements outlined in Section
23-4-900 of this Chapter for purpose of storing goods inside the unit. Up to two (2) semi-trailers may
be used as accessory storage on agricultural parcels not in an approved or recorded subdivision plat,
or LOTS which are part of a map or plan flied prior to the adoption of any regulations controlling
subdivisions in the A (Agricultural) Zone District,without a permit.Additional semi-trailers used as
accessory storage may be allowed on all lot sizes and types, as described in Subsection 23-3-40.V.
below.
Sec. 23-3-40.V.
More than one (1)semi-trailer when used as personal storage unit, on lots in an approved or
recorded subdivision plat or LOTS which are part which of a map or plan file prior to the adoption of
any regulations controlling subdivisions; and more than two(2)semi-trailers on agricultural parcels
not in an the approved or recorded subdivisions plat or LOTS which are part of a map or plan filed
prior to the adoption of any regulations controlling subdivisions in the A(Agricultural)Zone District.
• According to Weld County Sec. 23.-1-90. Definitions. "Personal Storage" remains
undefined in Weld County Code. However, Carr LLC has bought the property as an entity.
What"personal" property is being stored by a Limited Liability Corporation? For what
purpose is a LLC trying to gain an Accessory Storage Permit for"personal" property?
Application
Division 11-Semi-Trailers as Accessory Storage Sec. 23-4-900-Intent and Applicability
A. One (1) semi-trailer used as accessory storage on lots in an approved or recorded subdivision plat,
or LOTS which are part of a map or plan filed prior to the adoption of any regulations controlling
subdivisions in the A (Agricultural) Zone Districts, may be permitted through issuance of the Permit
for a Semi-Trailer as Accessory Storage.
Sec.23-4-910:Semi-Trailer as accessory storage permit requirements
An application for a Zoning Permit for a semi-trailer as Accessory Storage shall include the following:
According to Sec. 23-4-910.Semi-trailers as accessory storage permit requirements.
• According the Carr LLC's application available on the Weld County website the following
criteria was not met.
• The Carr LLC has not fully completed the application per Weld County's request. Document
labeled Zoning Permit Accessory Storage (ZPAS)Application. Carr LLC is asked the following,"
Detailed statement as to what type of structure is being used,what will be stored inside the
structure,AND THAT NO OTHER ALTERNATIVE EXISTS: Carr LLC states the following,"
semi-trailer, boxes,furniture." Carr LLC failed to explain that there were no other means in
which to store boxes and furniture. Carr LLC when asked for an address offers 2138 Mainsail
Drive Fort Collins Colorado 80524.The address listed on the application surely may have
room to store "boxes and furniture"?See Exhibit 1( Document from application)
• The Carr LLC has not fully completed the application per Weld County's request. Document
labeled Access Permit Application Form under PROPOSED USE the applicant is given seven
options in which to mark they read as follows:Temporary,Small Commercial, Field,Single
Resident, Large Commercial, Industrial, and Subdivision.As stated in Weld County Code the
A(Agricultural)Zone district regulations are established to promote the health,safety and
general welfare of the present and future residents of the COUNTY. If the applicant Carr
LLC is not clear with Weld County and the residents of Carr Colorado of their PROPOSED USE
of the property how can Weld County ensure the present Carr residents that their"health,
safety, and general welfare" will be protected? Lastly, if Carr LLC's true intentions were to
build a residential dwelling on the said Carr LLC'S property why did Carr LLC not mark
SINGLE RESIDENT under the PROPOSED USE section of the Accessory Storage Permit?See
Exhibit 2( Document from Application)
• Sec.23-4-910. D. Evidence of interest in the subject land held by the applicant.Although a
Warranty Deed was produced by the applicant. Carr LLC still is yet to inform Weld County
and the residents of Carr of what their true interest in the Carr LLC property is.The center of
the town is not drop off location for unwanted items.The unincorporated town of Carr is a
thriving, growing, involved community who welcomes new residents but,does not welcome
a storage facility in the heart of town.
• Sec. 23-4-910. G. Evidence that the semi-trailer is currently licensed.The application that
has been provided by Carr LLC to Weld County Building and Planning does not provide any
evidence that the semi-trailer that currently remains at the Carr LLC is currently licensed. In
fact the Logo on the side of the semi-trailer indicates according to the Colorado Secretary of
State the semi-trailer may be owned by a man by the name of Andrew Clark Nichols.The
Federal Law known as the Driver Privacy Protection Act prevents the public from gaining
access to driver registration records. However, simple observation of the current license
plates on the semi that resides on the Carr LLC property reveals that the semi-trailer has not
had current plates and registration since 2002. See Exhibit 3 (Photo of Plates).Therefore,
considering under Weld County Sec. 23-4-910.G. requires the applicant provide proof that
the semi-trailer is currently licensed we ask the applicant provide such proof to Weld
County.
• Sec.23-4-910.H.Weld County Road Access information sheet.Sec.23-4-910.I.A sketch plan
of the site at the scale of one inch represents fifty(50)feet or other suitable scale to show:
• According to the above Sec.23-4-910.H. a sketch is to be drawn to scale.The map produced
by Carr LLC and provided to Weld County Department of Planning Services is not drawn to
scale.See Exhibit 4( Map provided by Carr LLC to Weld County)
1.The proposed location of the semi-trailer, including distances from the
property LOT line and other structures on the property.
Since the map produced by Carr LLC and provided to Weld County Department
of Planning services is not drawn to scale how can the Commissioners possibly
clearly determine the location and or distances of the semi-trailer from the
property lines?That being said if no accurate distances are provided by the Carr
LLC how can the Commissioners possibly determine if the current semi-trailers
location is safe for the surrounding land owners?
2.Access to the semi-trailer, including distances from the property LOT lines and
other structures on the property.
Again, if the map produced by the Carr LLC is not drawn to scale how can
distance from property lot lines and other structures be determined? If accurate
distances cannot be determined and we cannot ensure what is inside the
semi-trailer, how can the Commissioners ensure that a fire danger does not
exist? Remember, residents in Carr have are more than 15 miles from a fire
station.
3. Location and measurements of and easements or right of ways.
As noted above the map provided is not drawn to scale and does not provide
location and or measurements of the easements or right of ways.
4.Amount of road frontages.
The map provided by Carr LLC does not include a frontage road listed and or the
distance/amount of such road.
5. Identification of any county,state or federal roads or highways.
The map provided by Carr LLC to the Department of Planning Services is
incomplete although 4th Street and Warner Street no other Federal Roads or
Highways are listed.
6. Existing structures on the property.
Currently,the Carr LLC property houses a semi-trailer, mini trailer and a boat
trailer neither the mini trailer or boat trailer are drawn on the map. It is quite
possible that such items were not added to the map provided by Carr LLC so that
it would not appear that the Carr LLC is beginning to resemble a storage unit
property rather than a residence?The question than begs to be asked if the land
owners have failed to thoroughly complete a simple map and failed to note
pertinent information that was required in the application,will the Carr LLC land
owners if granted a permit for Accessory Storage follow the following regulations
found in Sec. 23-4-900.B.4.5.
4. No Structural component of the semi-trailer used for accessory storage will be
removed and thereby result in the semi-trailer being unmovable.
According to Colorado State Law 42-3-114 road worthy vehicle to be deemed road
worthy must have current license plates and tags. Reviewing Exhibit 3 the semi trailer
parked on the Carr LLC property is not deemed road worthy and therefore, unmoveable.
Clearly,this Sec.23-4-900B.4. already failed to be met.
5.The semi-trailer used for accessory storage will not be allowed to deteriorate into a
state of disrepair. Such disrepair would include, but not limited to, a semi-trailer for
accessory storage or partially or totally damaged by,fire, earthquake,wind, or other
natural causes,or a semi-trailer in a state of general dilapidation, deterioration or decay
resulting from a lack or maintenance,vandalism or infestation with vermin or rodents.
Any such semi-trailer shall be restored to and maintained in the original condition upon
being placed on the site or shall be removed from the site.
If such carelessness was taken when completing the map section on the Weld
County Application for Accessory Storage and if an Accessory Storage Permit is
granted how long before the semi-trailer is deteriorating or infested with vermin
or rodents?Since the members of the Carr LLC do not reside on the property is
the semi-trailer already deteriorating and or invested with vermin or rodents?
Referral Process After Application has been Deined By Department
of Planning Services
Sec.23-4-920. Referral Process.
Upon determination that the application submittal is complete, the Department of Planning Services
Shall:
A. Refer the application to applicable referral agencies for review and comment.Agencies can
include the Department of Public Works and any other deemed necessary.The agencies shall
respond within twenty-one (21) days after the mailing of the application by the COUNTY.The
reviews and comments solicited by the COUNTY are intended to provide the COUNTY with
information about the proposed USE.The COUNTY may consider all such reviews and comments
and may solicit additional information if such information is deemed necessary.The reviews and
comments submitted by referral agency are recommendations to the COUNTY.
• It must be noted the agencies that received the application for Accessory Use Permit on the
Carr LLC property did not receive a completed application. Upon reviewing any comments
from other agencies within Weld County the Commissioners must take into account that
such agencies never reviewed and completed application or were ever truly informed of the
true intent or purpose of an Accessory Storage Permit on the Carr LLC property.
B. Send a request for comment in support or opposition regarding the Zoning Permit for a
semi-trailer as accessory storage to those persons listed in the application as owners of
property located within five hundred (500)feet of the parcel under consideration. Such
notification shall be mailed, first-class, upon receipt of the application. Inadvertent errors by
the applicant in supplying such list or the Department of Planning Services in sending such
notice shall not create a jurisdictional defect in the permitting process, even if such error
results in the failure of a surrounding property owner to receive such notification.
• The list of residents that reside within 500 feet of the semi parked on the Carr LLC
property totaled thirty (30) people. Of the thirty (30) people who received a letter
for comment of the semi-trailer fifteen (15) of those residents objected to a
semi-trailer parked in the heart of our very community. Many objected for the
following reasons: Please see Exhibit 5 the original objection letters for more
thorough and complete objections
• "I live across the street and it looks like trouble." Denny 9495 Warner Ave.
• "Carr, Colorado is a beautiful place in the middle of the Colorado prairie where land
is disrespected when people violate zoning laws. That should NOT include a
semi-trailer parked there. It would be an eye sore and prove to look like a junk yard.
The people of Carr have tried to do a major cleanup of the little town and its
environment. Let Carr continue to be proud of their efforts. The semi/storage unit is
a zoning violation. It is completely disrespectful of the citizens of Carr and of the
land,to go against zoning regulations. When making the decision on this case, please
consider Carr LLC is already in violation. Why would they be given the privilege to go
against the law and policy for their own benefit?That makes no sense? " Bev Collier

• In the application the applicant has not specified exactly what they will be doing on
the property. I cannot give my approval without knowing what the property will be
used for. If it is for semi-trailers to be used for storage I am concerned what might
be stored. It states in the application that it is for personal use, but a corporation
(Carr LLC) indicates it's a business .Therefore, I object for safety concerns. We are 20
miles from a fire department and 40 miles from a sheriff's department. Willa

Sec.23-4-930.-Delegation of authority.
A.The Board of County Commissioners delegates the authority to issue a zoning permit for a
semi-trailer which otherwise requires the approval of the Board of County Commissioners through a
public hearing process to the Department of Planning Services upon a determination by the
Department that:
1.The applicant is in compliance with the criteria identified in this chapter for the specific category
of zoning permit for which the application is made.
• As noted under Sec.23-4-910.-Semi-Trailer as accessory storage permit requirements of
this report it becomes evident that the criteria of an Accessory Storage Permit has not been
met by the Carr LLC.
• An Accessory Storage Permit was not applied for prior to moving the semi-trailer on the Carr
LLC Property.
• Sec. 23-3-30. Carr LLC has not demonstrated how they have met the definition of"incidental
and accessory use" thereby demonstrating why an Accessory Storage Permit is justified.
• See Exhibit 1 Carr LLC has not demonstrated that"no alternative" for"personal storage"
exists. Carr LLC lists an address in Fort Collins as their residents.Why are they unable to
store items at their residents?
• Sec.23-4-910.G.The application for an Accessory Storage Permit requires the semi-trailer is
"currently licensed" according to Exhibit 3 the semi-trailer on the Carr LLC property has not
had current license plates since 2002.
• Sec. 23-3-910.i. Mapping is incomplete.The map provided by Carr LLC to Weld County fails
to include all the qualifications that are required in the Accessory Use Permit Application.
Thereby, an incomplete map and application can be used as evidence that not near due
diligence was taken when completing this application.
2.The Department of Planning Services has sent notice and has not received signed notification of at
least thirty(30%) percent of the surrounding property owners within five hundred (500)feet of the
subject property in opposition to the location of the semi-trailer. If opposed,the petition shall
indicate that the surrounding land owners who have signed the notification have objections to the
issuance of a zoning permit for the semi-trailer.
• As noted earlier thirty (30) residents in Carr reside within 500 ft.of the semi-trailer on the
Carr LLC property. Fifteen (15) of those residents objected to the semi-trailer stationed in
the center of town. Producing a percentage of fifty (50%") percent of people within 500 ft. of
the trailer object to a semi-trailer in the center of town.According to this section Sec.
23-4-930.The Department of Planning Services has already received greater than a thirty
(30) percent objection and by nature of the code denied Carr LLC the permission to be
granted an Accessory Storage Permit.The only reason this Permit is still being considered or
better said being reconsidered is due to the appeals process.
B. If the Department of Planning Services denies the Permit, the applicant may appeal in
writing to the Director of Planning Services, within ten (10) days of receipt of the denial
notice. A meeting shall be scheduled with the Board of County Commissioners to provide the
landowner an opportunity to appeal the denial, for good cause shown. If the landowner does
not submit a written appeal, the denial becomes final.
• According to the Weld County Website case number ZPAS16-0002 there has been not
a formal letter from Carr LLC uploaded to the website within the 10 day period asking
for an appeal. Which according to Weld County Code means the original ruling of
denying the Accessory Storage Permits should prevail. If such a letter from Carr LLC
was provided to Weld County what is Carr LLC's reason of"good cause"to appeal The
Department of Planning Services original ruling of a denial of an Accessory Use
Permit?The residents of Carr are trying to harm Carr LLC by requesting the original
ruling from The Department of Planning Services stand but, rather the Carr LLC land
owners surely need to understand in a small community as ours it is essential to
protect our land interests, rural agricultural roots, and thriving residential growth
thereby, housing a semi-trailer in the center of town negates the heart of Carr.
• C. If the Department of Planning Services does receive signed notification that thirty
percent (30%) or more of surrounding property owners within five hundred (500)
feet of the subject property are in opposition to the permitting of a semi-trailer as
accessory storage, the Board of County Commissioners shall review the application
for compliance with the criteria set out in this Section at a regularly scheduled
meeting of the Board:
• 1.The Department of Planning Services will notify the applicant, granting ten (10)
business days to determine if he or she wants to proceed with the application.
• 2. If the applicant notifies the Department of Planning Services of his or her desire to
proceed with the application, the Department will request a hearing date and time
from the Clerk to the Board and prepare a staff report.
A hearing date was chosen and posted on corner of 4th and Warren.Thank you
Department of Planning Services.
3. The Board of County Commissioners shall give notice of the application for a zoning
permit and the meeting date to those persons listed in the application as owners of
property located within five hundred (500)feet of the parcel under consideration. Such
notification shall be mailed,first class not less than (10) days before the scheduled
meeting. Such notice is not required by state statute and is provided as a courtesy to
surrounding property owners (the surface estate). Inadvertent errors by the applicant in
supplying such list or the Department of Planning Services in sending such notice shall not
create a jurisdictional defect in the permit process even if such error results in the failure of
a surrounding property owner to receive such notification.
• It is unclear as to whether letters were received from land owners within 500ft of
the Carr LLC property.
4. The Department of Planning Services shall post a sign for the applicant on the property in
question indicating that one(1) semi-trailer as accessory storage has been requested for the
property,the meeting date and a telephone number where further information may be
obtained. The sign shall be posted at least ten days prior to the meeting date and evidenced
with a photos graph.
• A sign was posted on the Carr LLC property. However since the Ussr for the Sullivan
Property in Carr Weld County Department of Planning had agreed to also post all
notices reguarding Carr in the Post Office, that commitment was not kept in this
matter.
In the appeals process lined out in Sec. 23-4-930.C.5. It reads as follows,"The Board of
County Commissioners shall consider any testimony of surrounding property owners
concerning the effects of the semi-trailer as accessory storage on the surrounding
properties and its compliance with the criteria set out in this Section."
• Sec. 23-4-900.B.8. Reads The semi-trailer used for accessory storage is compatible
with the surrounding area.
• The Carr Community is comprised of many single family homes and ranch land
families. We are a residential/rural community. Our community is comprised of
families, a church and a post office along side a variety of grassland and livestock
which sustain our families. An unsupervised semi-trailer in the center of Carr is
uncompatiable with the surrounding area and families for the following reasons.
• The mere presence of multiple storage containers in this community will attract
criminal enterprises including,thefts, burglaries, marijuana grows, organized crime
and criminals looking at adjacent properties for opportunities. The sheriff's office
will not be able to provide adequate and economic law enforcement. Further the
lack of monitoring from the Carr LLC( not current residents of Carr) land owners
increases an unnecessary burden on adjacent property owners and law
enforcement. Increased potential for crime and in adequate law enforcement is not
compatible with Carr.
• The containers are at high risk of blowing over. Semi's rountinely blow over every
year in the area due to high winds . This alone poses danger to surrounding homes
and livestock. Further, they provide habitat for rodents and rattle snakes increasing
the dangers to surrounding people and livestock for these reasons a semi-trailer in
the center of Carr is uncompatiable with surrounding land use.
• The fire and hazardous material risk is also concerning . The Nuun Fire Department is
well over 15 miles away. Without monitoring from the Carr LLC, immediate access to
large quanities of water, the risk of combustion inside these types of containers is
very high. In remote locations people are less likely to follow the rules or be
conscious of danger behavior. Further the storage inside an unstable structure like a
semi-trailer which is likely to be blown over will result in chemical spills and fires
which puts our water and livelihood at risk thus, a semi-trailer in the center of town
is uncompatible with current land use.
• Commissioners please consider the health, safety and well being of the Carr
Community and it's residents and deny this Application of Accessory Storage.
If Commissioners Decide to Proceed
• If after a complete review the Commissioners feel it safe and in Carr's best interest
to allow for the semi-trailer parked in the center of Carr we the residents ask that
the following be completed:
• The applicant come into full compliance with what is required in the application
within 30 days.
A full and complete explanation as to how the Carr LLC semi-trailer meets the
qualifications of"incidental and accessory".
A full explantion to Weld County and Carr residents of the proposed use of the
property.
A full and complete explanation as to why there is no other storage
alternatives for the items stored in the semi-trailer.
A full and complete map provided to Weld County and Carr Residents of the
Carr LLC property meeting all the standards in the Section 23.
Evidence provided to Weld County the semi-trailer is currently licensed and
has current tags per Weld County Application Code.Thus,the semi-trailer is
moveable.
• A WELD COUNTY INSCPECTOR INSPECTE THE TRAILER FOR SAFETY PRECAUTIONS.
• The applicant only be allowed one semi-trailer on property.
• The applicant's permit for Accessory Storage Permit only be valid for one year.

Dear IIonorable Board Members,
I am contacting you regarding the Resolution of the Board dated June 1, 2016, related to Carr LLC and our
Zoning Permit application, ZPAS16-0002.
Following our company's application for a Zoning Permit for Accessory Storage and the subsequent hearing by
the Board on June 151, 2016, our Company and its members relied upon your formally executed Resolution,
signed by all Board Members, the County Attorney, and the Deputy Clerk to the Board, as attested by the Weld
County Clerk to the Board.
As such, we believed our zoning permit was granted to store our trailer on our property for a period of 18
months.
We do not understand why we cannot rely upon such formal document.
Our company, comprised of family members, purchased the property in order to build a family home. We had a
dream of building a small house, of subsisting on food which we would grow upon the property, and of living a
simple life free of institutional debt by paying for our new home and the improvements with cash. We have
been saving building components and materials in the trailer which we then moved to our land in preparation
for ultimate execution of our plans. As we are paying cash for all improvements, design, engineering, and
permitting will take several months to achieve.
Prior to purchasing the property, we visited with and introduced ourselves to a few of the neighbors. We found
them to be generally welcoming and kind. We mentioned to them that we had hopes of moving to the area and
building a home. Following such nice interactions which seemed welcoming, we proceeded to buy the land.
While we regret our failure to investigate the zoning regulations prior to placing the trailer on our property, we
sincerely believed it was an allowed use, as other neighboring property owners also have such trailers or
shipping cargo containers on their property, as well. We do not understand why other neighboring property
owners are allowed to place trailers and cargo containers on their property, while we are not. This does not
seem inherently fair.
During the Zoning Application Notice process to the community, things began to change. The process seemed
to invite discord. Our intentions have been maligned by rumor-mongering, threats against our property, and
general hostile activities. We were directly contacted by two neighbors prior to the hearing. One genuinely
wanted to know our intentions and we told them that we wanted to build a home. This neighbor thanked us for
responding to their inquiry and did not attend the hearing nor write an objection letter to the Board. Another
left anonymous voice messages threatening to destroy our trailer if we didn't remove it. It seems ridiculous to
us that anyone could think our property could reasonably be used for anything other than housing. Also, that
we could be responsible for other general problems with the area such as light pollution, crime, or dangers of
any sort, as mentioned by neighbors in responses to the Board both written and verbal; especially since we
simply own the vacant land.
Monica attended the hearing and was quite disturbed by the behavior of the neighbors. It was difficult for her to
describe or even relay the workings of the Board following the hearing. After our family has endured this
process in order to simply enjoy the use of our property, and has responded with dignity and poise in the face of
such hostility, we hope that you will be generous in correcting your error regarding the Resolution. I guess we
are all human and make mistakes.
Please consider honoring your original Resolution, as executed, or consider allowing us the most time possible
for us to save funds, design our new home, and proceed with the plans for our family.
