ORDINANCE NO. 43 /t�
IN THE MATTER OF AN AMENDMENT TO ORDINANCE NO. 25, COUNTY DEVELOP-
' MENT REVENUE BOND POLICY.
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF WELD COUNTY,
COLORADO:
WHEREAS, Ordinance No. 25, Adoption of a County Development
Revenue Bond Policy for Weld County, Colorado, was previously
passed and adopted on the 3rd day of April, 1978 , and
WHEREAS, Section 3. 2 of Ordinance No. 25 requires the appli-
cant to provide evidence that the proposed bond issue can be sold
through an acceptable underwriter or to an experienced investor
or group of investors, and
r WHEREAS, Section 4. 3 of Ordinance No. 25 requires the bond
issue to be sold at public bid, and
WHEREAS, Section 3. 2 and 4. 3 of Ordinance No. 25 are in
conflict operationally in the application process for industrial
revenue bonds, and
WHEREAS, legally, there is not a public bid required for the
issuance of industrial revenue bonds, and the County' s interest
would not be served by having a public bid procedure for the
issuance of industrial revenue bonds , and
WHEREAS, Ordinance No. 25 does not make specific provisions
for new firms applying for industrial revenue bonds in the pro-
cedure, and
WHEREAS, it is not the intent of the Board to discourage
new firms wishing to locate in Weld County from utilizing industrial
revenue bonds when appropriate.
NOW, THEREFORE, BE IT ORDAINED by the Board of County Com-
missioners of Weld County, Colorado that Section 4. 3 of Ordinance
No. 25 previously enacted be, and hereby is, repealed.
BE IT FURTHER ORDAINED that Ordinance No. 25 is hereby
amended by the addition of Section 3. 6 which states as follows:
"The Board, by majority vote, may waive
specific information required in the
written application for new concerns that
have not been in operation for the last
five (5) years. The Board, however, may
request additional information in lieu of
the information waived. "

BE IT FURTHER ORDAINED by the Board of County Commissioners
of Weld County, Colorado that an emergency exists in that in
order to consider an applicant where time is of the essence and
the normal Ordinance procedure would prevent said application
from being considered before December 31, 1978 , this Ordinance
is declared to be an emergency ordinance under the provisions of
Section 3-14 of the Weld County Home Rule Charter.
The above and foregoing Ordinance No. 43 was , on motion duly
made and seconded, adopted by the following vote on the 13th day
of December, A.D. , 1978 .

Commissioner Jacobucci made a motion to approve the low bid submitted
by Ideal Construction Services. Commissioner Carlson seconded the
motion and it carried unanimously.
PRESENT CLEANING SERVICES, FT. LUPTON - The Purchasing Director read the
following bids into the record:

Mrs. Rhoden added that this service would begin January 8, 1979. After
discussion, Commissioner Carlson made a motion to approve the bid
from Sibley Enterprises for the cleaning of both buildings at $200.00
per month. Commissioner Roe seconded the motion and it carried unanimously.
UPDATING ASSESSMENT MAPS AND AERIAL PHOTOGRAPHY - Mrs. Rhoden noted
that these bids are based on 300 maps, 525 parcels of lots of 20 or
less and 1,050 lots of 20 or more. She read the following bids into
the record and reviewed the recommendations of the County Assessor and
the County Treasurer. The bids will be considered for approval on
December 27, 1978.

HEALTH DEPARTMENT VENEREAL DISEASE CONTROL SERVICES CONTRACT: Assistant County Attorney,
Russell Anson, read emergency Ordinance #45 into the record. The ordinance
authorizes the contract between the Weld County Health Department and the
Colorado Department of Health for venereal disease control. Commissioner
Jacobucci made a motion to approve emergency Ordinance #45. Commissioner
Dunbar seconded the motion and it carried unanimously.
HEALTH DEPARTMENT SPEECH THERAPIST CONTRACT WITH MARY STEIN: Mr. Anson read emergency
Ordinance #46 into the record. This ordinance authorizes the letter of
agreement between the Weld County Health Department and Mary Stein. Commissioner
Jacobucci made a motion to approve Ordinance #46. Commissioner Roe seconded
the motion and it carried unanimously.
ORDINANCE #43, Amend Ordinance #25, Industrial Revenue Bonds: Mr. Anson read this emergency
ordinance into the record. The ordinance repeals Section 4.3 of Ordinance
#25 and provides for the addition of Section 3.6 which states as follows:
"The Board, by majority vote, may waive specific information
required in the written application for new concerns that

After review, Commissioner Roe made a motion to approve Ordinance #43.
Commissioner Dunbar seconded the motion and it carried unanimously.
