RE: APPROVE MEMORANDUM OF UNDERSTANDING AND AUTHORIZE CHAIR TO
SIGN - IT'S MY VERY OWN, INC.
WHEREAS, the Board of County Commissioners of Weld County, Colorado, pursuant to
Colorado statute and the Weld County Home Rule Charter, is vested with the authority of
administering the affairs of Weld County, Colorado, and
WHEREAS, the Board has been presented with a Memorandum of Understanding
between the County of Weld, State of Colorado, by and through the Board of County
Commissioners of Weld County, on behalf of the Department of Human Services, and It's My
Very Own, Inc., commencing January 1, 2016, and ending December 31, 2016, with further terms
and conditions being as stated in said memorandum of understanding, and
WHEREAS, after review, the Board deems it advisable to approve said memorandum of
understanding, a copy of which is attached hereto and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED by the Board of County Commissioners of Weld
County, Colorado, that the Memorandum of Understanding between the County of Weld, State of
Colorado, by and through the Board of County Commissioners of Weld County, on behalf of the
Department of Human Services, and It's My Very Own, Inc., be, and hereby is, approved.
BE IT FURTHER RESOLVED by the Board that the Chair be, and hereby is, authorized
to sign said memorandum of understanding.
The above and foregoing Resolution was, on motion duly made and seconded, adopted
by the following vote on the 22nd day of February, A.D., 2016.

Department of Human Services and It's My Very Own, Inc.
Please review and indicate if you would like a work session prior to placing this item on the Board's
agenda.
Request Board Approval of a Memorandum of Understanding between the Department and It's
My Very Own, Inc.The Department wishes to continue its Memorandum of Understanding with It's
My Very Own and its project, entitled, "Bags of Love". It's My Very Own, Inc.,will provide age
appropriate toy(s), personal care items, and a handmade blanket for child(ren) who have been removed
from their home and placed into the Department's custody by law enforcement and/or the Courts.The
Department's responsibility under the Memorandum of Understanding would be to identify the level of
need to representatives of It's My Very Own,Inc. The term of this Memorandum of Understanding is
January 1, 2016 through December 31,2016.
In the past,this Memorandum of Understanding has been non-financial. The organization was utilizing
the Frederick County Building at no cost.Given that the Frederick County Building has been sold, the
organization has found rental space at the Ft. Lupton Family Resource Center at a cost of$25 per month
or$300 per year. I feel compelled to ask the Board if the Board would consider paying for the space so
the organization can continue with its work on our behalf and to show our appreciation for what they do
for the children in our custody.
If the Board does not wish to contribute the $300 per year,we would like to continue with the
Memorandum of Understanding as a non-financial agreement.
I do not recommend a Work Session. I recommend approval of this MOU as a financial or non-financial
agreement.

MEMORANDUM OF UNDERSTANDING BETWEEN THE WELD COUNTY DEPARTMENT
OF HUMAN SERVICES AND IT'S MY VERY OWN.INC.(Non-Core)
THIS MEMORANDUM OF UNDERSTANDING is entered into this bay of December 2015,
by and between the County of Weld,a body corporate and politic of the State of Colorado,by and through
its Board of County Commissioners,whose address is 1150"O"Street,Greeley,Colorado 80631
hereinafter referred to as"County,"and It's My Very Own,Inc.,a public non-profit entity,hereinafter
referred to as"It's My Very Own".
WITNESSETH
WHEREAS,It's My Very Own has developed a project,entitled,"Bags of Love";and
WHEREAS,the purpose of"Bags of Love"was inspired by a growing need of the children of
Weld County communities who are displaced due to the poor choices of their parents or guardians;and
WHEREAS,these children are innocent victims who are in need;and
WHEREAS,It's My Very Own provides"Bags of Love"to children with the immediate needs
and through donated items through the generosity of It's My Very Own and other church members of Ft.
Lupton,Dacono,Frederick and Firestone;and
WHEREAS,Human Services has children who have been placed into their custody by law
enforcement and the courts because of safety and protection needs;and
WHEREAS,Human Services,on behalf of the children in their custody,appreciates the care and
generosity bestowed by It's My Very Own.
NOW THEREFORE,in consideration of the premises and mutual promises and covenants herein
contained,the Parties agree as follows:
Term of this Memorandum of Understanding
This Memorandum of Understanding("MOU"or"Agreement")shall be effective beginning January 1„.
2016,and shall end December 31,2016.
Responsibilities of It's My Very Own
1. Furnish Human Services with one"Bags of Love",at no cost,for each child who has been
removed from their home by law enforcement or by the Courts and in the custody of Human
Services. Each one of"Bags of Love"will be filled with age appropriate toy(s),personal care
items,and a handmade blanket.
2. Discuss with Human Services if there is a need for assistance in transporting the"Bags of Love"
at least once per month to the Human Services office location or if the"Bags of Love"will be
picked-up by Human Services at the It's My Very Own office(s).
3. Maintain an available stock of"Bags of Love"inventory based on Human Services'projected
needs.
4. Meet with Human Services staff periodically to assess and/or discuss additional needs or
problems that may arise regarding the needs of children.
5. Ensure the quality and contents of each"Bags of Love",which are consistent with the safety and
protective needs of children and as approved by Human Services.

6. Submit annually a receipt to Human Services for reimbursement of annual rental fees associated
with the storage of"Bags of Love"program inventory. Reimbursement shall not exceed$300.00
annually.
Responsibilities of Human Services
Disburse each"Bags of Love"to children who are in foster or kinship care and ensure that only
one"Bags of Love"is provided to each child.
2. Provide It's My Very Own with an annual estimate of inventory needs of"Bags of Love".
3. Provide a quarterly report of inventory to It's My Very Own to detail stock located at Human
Services with the specifically identifying the types of"Bags of Love"by age and gender.
4. Meet with It's My Very Own to discuss needs,problems and other suggestions that may
positively affect the"Bags of Love"program.
5. Reimburse It's My Very Own for rental fees associated with storage of the"Bags of Love"
program inventory. Reimbursement of rental fees shall not exceed$300.00 annually and shall be
reimbursed through Child Welfare funding.
Modifications. This Agreement may be modified in whole or in part upon approval of the signers.
Termination. This Agreement may be terminated by any of the signers upon thirty(30)days written
notice.
Entire Agreement/No Third Party Beneficiary. This Memorandum of Understanding contains the
entire agreement and understanding between the parties to this Memorandum of Understanding and
supersedes any other agreements concerning the subject matter of this transaction,whether oral or written.
It is the express intention of the parties that any entity other than the undersigned parties receiving services
or benefits under this Memorandum of Understating shall be deemed an incidental beneficiary only.
No Waiver of Immunity. No portion of this Memorandum of Understanding shall be deemed to
constitute a waiver of any immunities the parties or their officers or employees may posses,nor shall any
portion of this Memorandum of Understanding be deemed to have created a duty of care that did not
previously exist with respect to any person not a party to this Memorandum of Understanding.
Severability. If any provision of this Memorandum of Understanding should be held to be invalid, illegal,
or unenforceable for any reason,the validity,legality,and enforceability of the remaining provisions shall
not in any way be effected or impaired thereby.
EN WITNESS WHEREOF,the parties hereto have duly executed the Agreement as of the day,momh,
and year first above written. /
